HomeMy WebLinkAbout20051973.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JULY 11, 2005 TAPE #2005-29 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, July 11, 2005, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair Pro-Tem and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner William H. Jerke, Chair- EXCUSED Commissioner M. J. Geile, Pro-Tem Commissioner David E. Long - EXCUSED Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Jenny VanEgdom Controller, Barbara Eurich MINUTES: Commissioner Vaad moved to approve the minutes of the Board of County Commissioners meeting of July 6, 2005, as printed. Commissioner Masden seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Vaad moved to approve the Certification of Hearings conducted on July 6,2005,as follows: 1)Heating to show whether good cause exists for revocation of USR #1456, Barbara Schottelkotte. Commissioner Masden seconded the motion,which carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: No public input was given. CONSENT AGENDA: Commissioner Vaad moved to approve the consent agenda as printed. Commissioner Masden seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports. WARRANTS: Barbara Eurich, Controller, presented the following warrants for approval by the Board: All Funds $1,738,264.46 Commissioner Vaad moved to approve the warrants as presented by Ms. Eurich. Commissioner Masden seconded the motion, which carried unanimously. 2005-1973 BC0016 �7-/S—Or NEW BUSINESS: CONSIDER 2006 ANNUAL PLAN AND BUDGET FOR AREA AGENCY ON AGING AND AUTHORIZE CHAIR TO SIGN: Walt Speckman, Director of Human Services,stated the 2006 Annual Plan and Budget, in the amount of$148,809.00,supports programs for older adults. Responding to Commissioner Masden, Mr. Speckman stated the amount of the budget is larger than the previous year's budget. Commissioner Vaad moved to approve said budget,and authorize the Chair to sign. Seconded by Commissioner Masden, the motion carried unanimously. CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES-VARRA COMPANIES, INC.: Raelene Anderson, Assessor's Office, stated the taxpayer reported the cost of equipment incorrectly and staff recommended approval. Commissioner Masden moved to approve said petition. The motion,which was seconded by Commissioner Vaad, carried unanimously. CONSIDER ENTRY UPON VARIOUS LANDS BY WELD COUNTY VEGETATION MANAGEMENT SPECIALIST: Tina Booton, Department of Public Works,stated the landowners of properties with noxious weeds have received a ten-day legal notice and have failed to comply with the request to control the weeds. She stated the County will enter the designated properties and control the noxious weeds at the landowner's expense. Commissioner Masden moved to approve said entry. The motion, which was seconded by Commissioner Vaad, carried unanimously. CONSIDER RESOLUTION RE:AUTHORIZE BOARD OF COUNTY COMMISSIONERS TO CONVENE AS BOARD OF EQUALIZATION FOR CALENDAR YEAR 2005: Bruce Barker,County Attorney,stated the draft resolution allows the Board of Equalization to convene until August 5, 2005. Commissioner Vaad moved to approve said resolution. The motion,which was seconded by Commissioner Masden, carried unanimously. CONSIDER ASSESSED VALUATION OF ALL TAXABLE PROPERTY AND MASTER PROTEST LOG- REAL AND PERSONAL PROPERTY:Christopher Woodruff,Assessor's Office,submitted preliminary data of taxable property,marked Exhibit A. Mr.Woodruff stated the County had an overall increase of seventeen percent assessed value this year,due to the increases in construction,oil and gas production,and vacant land values. He stated the residential assessment rate of 7.96 percent did not drop this year,and there was a significant increase of fifteen percent in commercial value,primarily due to new construction. He further stated the agricultural assessment rate has decreased because of the impact of the drought, and movement of agricultural land out of production into developed subdivisions. He further stated the state assessed valuation is not complete; however, the first Certification of Value will be completed by August 25,2005. Mr.Woodruff stated there was an overall increase of twenty percent for real property,and one percent increase for personal property. He stated 4,448 protests were received for real property, a decline in percentage overall from previous years; and 2,600 of the protests were adjusted, 1,800 were denied,and 68 were voided. He further stated staff received 160 protests for personal property and oil and gas,with 101 receiving adjustment,55 being denied,and four being withdrawn. He stated 1,344 equipment schedules were not filed, and have been placed on an audit list for staff to visit. Responding to Commissioner Vaad,Carol Harding,Deputy Clerk to the Board,stated 30 to 40 appeals have been received for the Board of Equalization;however,the deadline to file is Friday,July 15,2005. She further stated based on 2003 percentages,300 to 350 appeals should be expected. Responding to Ms. Harding, Mr.Woodruff stated the Assessor's Office will reexamine the appeals,and hope to have no more than 150 appeals come before the Board. Responding to Commissioner Geile, Mr.Woodruff stated that Larimer County received over 12,000 protests; however, other surrounding counties have seen a decline in protests. He further stated that Larimer County issues many administrative denials,and uses a referee system when protests are presented. Responding to Commissioner Geile, Mr.Woodruff stated the oil and gas figures reflect the recent rulings of the Supreme Court. Commissioner Vaad moved to approve said valuation. The motion, which was seconded by Commissioner Masden, carried unanimously. Minutes, July 11, 2005 2005-1973 Page 2 BC0016 SECOND READING OF ORDINANCE#2005-5, IN THE MATTER OF REPEALING AND REENACTING CHAPTER 30 SEWAGE SYSTEMS,OF THE WELD COUNTY CODE: Commissioner Vaad moved to read by title only. Seconded by Commissioner Masden,the motion carried unanimously. Mr. Barker read said title into the record. Commissioner Vaad moved to approve said Ordinance on Second Reading. The motion, which was seconded by Commissioner Masden, carried unanimously. SECOND READING OF ORDINANCE#2005-6, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 14 HEALTH AND ANIMALS, AND CHAPTER 23 ZONING, OF THE WELD COUNTY CODE:Commissioner Masden moved to read by title only. Seconded by Commissioner Vaad,the motion carried unanimously. Trevor Jiricek, Department of Public Health and Environment,stated the Domestic Septage and Biosolid Regulations are being moved from Chapter23,Zoning,to Chapter 14, Health and Animals. Commissioner Masden moved to approve said Ordinance on Second Reading. The motion, which was seconded by Commissioner Vaad, carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. Ordinances#2005-5 and #2005-6 were approved on Second Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
