Public Works finds the Drainage Investigation & Erosion Control Report for Markham PUD, dated January 28 2005, by Dennis R. Messner, P.E., (Colorado P.E. 26109) with Messner Engineering, Inc. (Project No.GRD-416-01)acceptable. o The retention pond proposed in the drainage report is shown outside of the PUD. Public Works recommends that the retention pond reside within the PUD boundaries to control and preserve the facility by the lot owners. The applicant should look into the possibility of creating an 'open space' for the detention pond location shown on the drainage plan. ❑ The Change of Zone Map - Markham P.U.D. (Revised 04-Feb-2005) by Frederick Land surveying, Inc. submitted by the applicant is acceptable to Public Works. Recommendation ❑ The Public Works Department recommends approval of this change of zone. The applicant shall address the comments listed above at the specific step of the review process stated. Comments External Roadways: ❑ SH 56 is classified by the National Highway System as a State Highway. The applicant shall coordinate with Colorado Department of Transportation (CDOT) the requirements for right-of-way, access, improvements and any traffic / transportation requirements on SH 56. The applicant, on the change of zone plat, shall show and label the right-of-way recognized by CDOT. This SII 56 is paved and maintained by the State of Colorado. ❑ Based on the proposal of limited development and apparent low traffic impact, a traffic study is not currently required by Public Works. This 6-lot development will add approximately 57 trips per day to the transportation system. nternal Roadways: ❑ The internal roadway right-of-way shall be 60-feet in width including cul-de-sacs with a 65- foot radius, and dedicated to the public. The typical cross-section of interior road shall be shown as two 12-foot paved lanes with 4-foot gravel shoulders on the change of zone plat. The cul-de-sac edge of pavement radius shall be 50-feet. A( The internal roadway/ cul-de-sac shall be extended south to Lot #3 and Lot #4. This will provide direct access to the public internal roadway,eliminate adjacent extended driveways,and diminish potential future access conflicts. The applicant shall provide a pavement design prepared by a professional engineer along with the final plan submittal. jX Stop signs and street name sign locations must be shown on the final roadway construction plans. U Intersection sight distance triangles at the development entrance will be required. The applicant shall submit this drainage study with the change of zone application materials for review by Public Works prior to scheduling any public hearings. An initial drainage review at change of zone is warranted. The study does may be preliminary. Ai A final drainage report stamped, signed and dated by a professional engineer licensed in the State of Colorado shall be submitted with the final plan application. The 5-year storm and 100-year storm drainage studies shall take into consideration off-site flows both entering and leaving the development. Increased runoff due to development will require detention of the 100-year storm developed condition while releasing the 5-year storm existing condition. The final drainage report shall include a flood hazard review documenting any FEMA defined floodways. The engineer shall reference the specific map panel number, including date. The development site shall be located on / the copy of the FEMA map. E1 The applicant shall prepare a construction detail for typical lot grading with respect to drainage for the final application. Front, rear and side slopes around building envelopes must be addressed. In addition, drainage for rear and side lot line swales shall be considered. Building envelopes must be planned to avoid storm water flows, while taking into account adjacent drainage mitigation. Final drainage construction and erosion control plans (conforming to the drainage report) stamped, signed and dated by a professional engineer licensed in the State of Colorado shall be submitted with the final plan application. Department of Public COLORADO Health and Environment CASE NO.: CZ-1077 NAME: Harvey Markham/Winterset Estates The Weld County Health Department has reviewed the percolation data and drainage report submitted to complete this application. The lots have been realigned slightly (from the plat submitted October 2004) to better accommodate access to Lot 4. There are no substantial changes to the lot sizes. A preliminary percolation report from Earth Engineering Consultants, dated December 17, 2004 indicated the eastern portion of the site may require engineered systems due to percolation rates, while the western portion of the site had good perc rates. The applicant has placed primary and secondary septic envelopes on all lots that appear to be adequately sized (may possibly be slightly undersized for engineered systems, depending on bedrooms and actual percolation rates). The drainage report proposes a retention pond on Lot A of RE-3667, technically not a part of this application, but the Markham's residence. This Department understands the applicant has a water agreement with Little Thompson Water District, however, a copy of that agreement has not been forwarded to this Department at this time. The Department recommends approval with the following conditions: 1. Water service shall be obtained from Little Thompson Water District. 2. This subdivision is in rural Weld County and is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment,Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement,or modification of the system. 3. Primary and secondary septic envelopes have been placed on each lot. 4. Language for the preservation and/or protection of the absorption field envelopes shall be placed in the development covenants. The covenants shall state that activities such as permanent landscaping, structures,dirt mounds or other items are expressly prohibited in the absorption field site. 5. If required, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the down gradient portion of the site during all parts of the construction phase of the project. 6. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. The applicant proposes a 6 lot PUD on 16.8 acres. The minimum lot size is 2.5 acres, and coupled with the overall density of one septic system per 2.8 acres does meet current Department policy. This proposal was previously reviewed under sketch plan number S-480 in 1998, Change of Zone Z-534 in 1999 (continued) and Change of Zone Z-545 in 2000 (approved). The application has not satisfied Chapter 27 of the Weld County Code in regard to water and sewer service. The application states that water service will be provided by Little Thompson Water District; however no letter of availability from Little Thompson Water District has been submitted in the application materials. Sewer is proposed to be provided by individual sewage disposal systems. No preliminary information regarding percolation data was included in the application materials. Therefore, no comments regarding the expectancy of the septic systems can be offered at this time. An existing septic system on the property(presumably Lot A of RE-3667)was reviewed under a Statement of Existing in 2003. The application states that primary and secondary septic envelopes will be placed on the Final Plat. In all the previous reviews of this proposal, no preliminary geotechnical information was provided concerning the percolation rate and/or soil boring findings. In the 1999 application submittal there was a Geologic Hazards Evaluation conducted by Earth Engineering Consultants, dated November 11, 1999 which reviewed Soil Conservation Service maps of the area only. Therefore, septic envelope sizes must be based on preliminary geotechnical data and approved by the Department of Public Health and Environment prior to recording any plat. Septic envelopes may not be required; however, that conclusion will also be based on the preliminary geotechnical data review. The Department recommends approval with the following conditions: 1. The sheriff's office requests that builders and developers designate an area by the entrance of the sub-division in which to place a shelter for school children awaiting the school bus. This area should also include a pull off for the school bus which enables it to safely load and unload children out of the roadway in the event the bus is unable to drive down the street due to road conditions. 2. Either a mail distribution within the sub-division or a central drop off location within the sub-division should be developed so that residents do not have to cross a county roadway to obtain their mail. 3. The name of the street and address numbers within the sub-division should be presented to the sheriff's office for approval. This will eliminate duplication of street names within the county. 4. A permanent sign should be placed at the entrances to the sub-division detailing the name of the sub-division, and address. There should be a plan developed to maintain this sign. Individual addresses also need to be clearly visible for each residential site. 5. If the roadways within this sub-division are not maintained or adopted by the county, individuals purchasing property in this sub-division should be notified that the sheriffs office will have limited traffic enforcement powers. 6. A plan should be developed to maintain roadways within the sub-division especially during inclement weather conditions for emergency vehicles. 7. The sheriffs office is very supportive of homeowner funded homeowners associations. These associations provide a contact for the sheriff's office and a means for maintaining common areas. 8. If there is an oil or gas well within this sub-division. This needs to be fenced off in order to mitigate the potential for tampering. These facilities are known to create an attractive nuisance for young people. Tampering not only creates a significant danger to safety but also of environmental damage with extensive mitigation and clean-up costs. The Sheriffs Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Board of County Commissioners or as indicated by growth not considered at the time the plan was developed. I have no other comments on this proposal. (see attached memorandum). These actions include, but are not limited to lot line adjustments, zone change requests, special use land, and division by exemption. The material submitted this time appears to be only for a change in zoning on the proposed Winterset Estates previously known as Markham PUD. However, we have reviewed the submitted material and in an effort to assist the county, we will provide the following comments. We have previously commented on the Markham PUD by our letters dated December 1, 1998 and February 19, 1999 when the proposal was to subdivide a 20.02-acre parcel into 5 single-family residential lots. The information from this referral indicates that the intent is to subdivide a 16.41-acre parcel into 6 residential lots. The Little Thompson Water District (District) will provide water for the six residential lots. In our letter dated February 19, 1999 we indicated that the District has agreed to serve five residential lots in the Markham PUD per terms and conditions of the District. Therefore, the comments from our letter dated February 19, 1999 (copy attached) still apply. However, since the proposal is to create six residential lots the applicant needs to obtain an additional commitment for service from the District for this subdivision. The parcel is currently agricultural land and generally cannot be considered as critical habitat for any wildlife species. According to the Colorado Division of Wildlife Natural Diversity Information Source Map for Weld County, the area provides winter range for bald eagles, foraging areas for ducks and geese, and is within the overall range for pheasant and mule deer and white-tailed deer. Coyote, fox,raccoon, skunk, songbirds, other raptors and herptofauna may also occur in this area. Upon disturbance of any areas,noxious weeds should be monitored and controlled. Homeowners should also be aware that planting trees, shrubs and other herbaceous plants may attract wildlife. Subsequently, ornamental landscaping may be damaged by wildlife. Homeowners will need to be responsible for damages incurred and will not be eligible for any reimbursement by the Colorado Division of Wildlife. Chronic Wasting Disease has been diagnosed within deer herds west of this parcel. Management efforts to control this wildlife disease will continue in the future, including culling of herds associated with infected animals. Homeowner and landowner cooperation has played a crucial role in Colorado Division of Wildlife management efforts and will continue to be essential in the future. Homeowners should be aware of this disease and management efforts associated with maintaining healthy deer populations. Homeowners should be aware that feeding big game animals, including deer, in Colorado is prohibited. Attracting and concentrating herds of deer by supplemental feeding may play a role in the prevalence and spread of chronic wasting disease. Homeowners should be made aware of the presence of native predators. Pets should not be allowed to roam free. All domesticated livestock and farm animals should be secured with wildlife proof fencing appropriate for the species being raised. Pets as well may negatively interact with wildlife even on the home-sites and homeowners will be responsible for handling these problems. Homeowners should secure pet and animal feeds,trash containers,and charcoal/gas grills. Pets should have current shots. All control of nuisance wildlife will be the homeowner's responsibility with the possible exception of bears and mountain lions. The district would only require the turn around to be 100 feet in diameter unless on street parking is anticipated. So long as the fire flow in the available hydrant meets the departmental minimum of 1,000 GPM. The subdivision is approved by the fire district for homes up to 3,600 square feet. Homes larger than that will require larger a fire flow as determined by table A-III-A- 1. of the Uniform Fire Code. In the event that there is insufficient fire flow available, alternative fire protection methods must be employed. This generally means that residential fire sprinklers will be required. Such systems must be reviewed, approved, and inspected by the district. The Berthoud Fire Protection District is also considering the implementation of an ongoing inspection program for residential sprinklers in the future. In the event a sprinkler system is required, approved contractors must do the work. Both the sprinkler contractor and the excavation contractor(who installs the sprinkler system supply line)must be licensed by the State of Colorado, Department of Fire Safety. Proof of such licensure must be provided to the district. A flow and pressure test is required on the supply line from the main to the structure before the line is covered. Construction requirements for the Berthoud Fire Protection District are currently drawn from the 1997 Uniform Fire Code. From time to time these source documents are updated or amended. In the event that there is a conflict between the requirements of this letter and updated requirements, the newer requirements in effect at the time of building permit submittal shall apply. We would request that these requirements bed included in the final plat, and that compliance be required prior to the issuance of any building pennits.
