HomeMy WebLinkAbout810806.tiff 1 lap town comen 81 _n.)1401981 MINUTES WELD COUNTY COUNCIL c"°'` June 4, 1981 The Weld County Council met in regular session in full conformity with the Weld County Home Rule Charter at 915 Tenth Street, Greeley, Colorado, June 4, 1981, at 1:30 p.m. ROLL CALL The following members were present in person: Patricia Anderson, Ralph Waldo, De Ann Emerson, Robert Martin, Howard Foster. Also present were Commissioners C. Carlson., N. Carlson, Martin, and Steinmark, three members of the press, and council secretary, Susan Elton. MINUTES APPROVED Councilman Ralph Waldo made a motion to approve the minutes of the County Council 's meeting of May 7, 1981, as written. Councilman Howard Foster seconded the motion and it carried unanimously. CORRECTION TO AGENDA: HowardFoster's mileage payment $26.00, not $20.00 APPOINTMENTS Pat Anderson will attend the next elected official 's meeting, June 8, 1981, 2:00 p.m. The next Council meeting will be June 18, not July 2. CORRESPONDENCE The Council discussed the memo from Don Warden regarding the Target Budget Amounts for 1982. Council 's gross appropriations for 1981 were $56,351. The 1982 target amount is $28,351. Ralph Waldo made a motion to approve of this amount. The motion was seconded by Pat Anderson1an�irit carried unanimously. The Council received an anonymous:$rom a "concerned tax payer" advising the Council that there were certain areas in the county that needed investigating. The Council suggested that such parties need to contact the Council directly and give specific details before the Council can take any action. The remaining correspondence was passed around for everyone to inspect. REPORTS Ralph Waldo attended the Commissioners' Board Meeting May 27, 1981. He had nothing to add to what had been said in the minutes of the Commissioners' meeting. UNFINISHED BUSINESS Council received the legal opinions from attorney, Robert Ray. The first was an opinion concerning the investigation of Greeley-Weld Municipal Airport. It was the opinion of Mr. Ray that the Weld County Council does not have authority to investigate the Greeley-Weld Municipal Airport, since the same is an airport created pursuant to the "Public Airport Authority Law" , as set forth in C.R.S. 41-3-101, et seq. , 1973, as amended. It was also his opinion that an investigation of the Greeley-Weld Municipal Airport.-by the Weld County Council would not constitute a ". . . review of all aspects of county government. . ." (as stated in the Weld County Home Rule Charter), because the airport is not a subdivision of the county. However, "the County Council certainly has it within its powers to investigate the propriety of the expenditures of monies from Weld County for the creation and maintenance of the airport. . .to review its books and records." , but no authority to investigate the inner workings of the airport. The second opinion was concerning the necessity for approval of the commissioners when Council is hiring a performance auditor. The opinion read that the Weld County Council does not have to obtain such approval prior to hiring a performance auditor. There is only one reading possible of Section 13-8(7) of the Home Rule Charter for Weld County, Colorado, and that is that the Weld County Council determines solely who it will hire for a performance auditor, determines solely the qualifications for such a performance auditor, and determines solely the compensation to be paid to such performance auditor. However, the attorney feels that the Weld County Board of Com- missioners could refuse to make payments to any such performance auditor if it were clear that the requested payments were totally unreasonable, or were for work which was clearly outside of the scope of the Weld County Council . 810806 , - ---- t f'1 MINUTES, WELD COUNTY COUNCIL June 4, 1981 Page 2 Councilman Ralph Waldo m;.de a motion to not even look at the airport's booKs because what the council wanted to look at had nothing to do with the airport financing. However, after further discussion he vitndrew his motion because other members were reluctant to let go of the issue. The council proclaimed that it was still unhappy about the provision that the performance auditor identify departments being investigated on his monthly bills. Council decided it would like to have the commissioners recind their resolution regarding the latest contract with Hyland Associates. Ralph Waldo made a motion that the council study the opinions further and then schedule a work session with the commissioners to discuss them. Pat Anderson seconded the motion and it passed unanimously. The commissioners explained to the council that the reason they put limits on the investigative contract was because they felt they could not authorize funds for a performance audit they felt was unauthorized. June Steinmark said she did not feel that what the council wanted to investi- gate was a proper expense for the commissioners to sign off on. She pointed out that the commissioners are the only ones who can sign contracts for the county, and suggested that the council might be able to hire its performance auditors as part- time employees of the county through the personnel office to avoid problems in the future. The third opinion concerned whether the county commissioners have the right to require building permits for agricultural buildings. There was no discussion regarding this opinion since action has already been taken by the commissioners regarding said permits. The council members and the commissioners held a discussion regarding salaries of commissioners and other elected officials. The council has to set the salaries for the commissioners for the years 1985-86, and the salaries for other elected officials for the years 1983-86. June Steinmark stated that the qualifications of all elected officials are the same, therefore they should get paid the same, unless they are required to have special training for the job (such as the sheriff). It was the consensus that individual personalities should not enter into the decision regarding the setting of salaries; it's the position that should have a specific salary attached to it. The council was reminded that Weld County Commissioners are employed full time, whereas other county commissioners in Colorado are only part-time. Yet, the salaries of Weld Commissioners fall somewhere close to those paid to the part-time commissioners in other counties. However, most agreed that a person doesn't run for commissioner to make money, but also, that person who takes the job should not have to make a sacrifice when he does become commissioner. Fringe benefits were talked about, and also the figures used by the state legislature to arrive at their decisions on salaries. NEW BUSINESS A motion was made by Bob Martin to approve mileage payments to Pat Anderson ($12.80) and Howard Foster ($26.00) . Motion seconded by Ralph Waldo and carried unanimously. At 3:42 p.m. council passed a motion to go into a brief executive session. The meeting reconvened at 3:57 p.m. ADJOURNMENT There was no further business. Upon motion made and seconded, the meeting was adjourned. The time of adjournment was 3:58 p.m. , June 4, 1981.
