HomeMy WebLinkAbout20052930.tiff 362 RESOLUTION RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT #1191 - ANDREA YOUNG, C/O PROPERTIES AULT, LLC WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,by Resolution dated September 30, 1998,the Board approved Use by Special Review Permit#1191 for Stanley Heinze on the following described real estate, to-wit: Lot A of Recorded Exemption#902; being part of the SW1/4 of Section 10, Township 7 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS,the Board has received a request from current property owner Andrea Young, c/o Properties Ault, LLC, 15415A Highway 14,Ault,Colorado 80610,to vacate said Use by Special Review Permit#1191, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and,having been fully informed, deems it advisable to approve said vacation. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Use by Special Review Permit#1191 be, and hereby is, vacated. FROM: Sheri Lockman, Planner II SUBJECT: Vacation of USR-1191 The Department of Planning Services has received the attached letter received November 2, 2004 from Andrea Yount. Ms Young is requesting that USR-1191 be vacated since the use is no longer being performed on the property. Background information: Legal Description: Lot A RE-902 being part of the SW4 Section 10, T7N, R66W of the 6th P.M., Weld County, CO. Location: North of and adjacent to State Highway 14, % mile east of County Road 31. USR-1191: USR-1191 was approved by the BOCC on September 30, 1998, for manufacturing and storage of agricultural equipment. The site was conditionally approved for a concrete batch plat under Use by Special Review Permit 1453 on February 25, 2004. The Department of Planning Services required the vacation of USR-1191 as a condition of approval. This request for vacation of USR-1191 is to satisfy the Department of Planning Services' condition. 2005-2930 -PL I7-4.09 A condition of approval for our Use By Special Review Permit (USR-1453) was the vacation of Use By Special Review Permit 1191 which is currently on the property.
