RESOLUTION
RE: APPROVAL OF SPECIAL USE PERMIT FOR A DAIRY OPERATION FOR
GERALD MARTIN, ROUTE 1, BOX 23, GROVER, COLORADO 80729
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 13th day of August, 1980
at the hour of 2 : 00 o 'clock p.m. in the Chambers of the Board
of County Commissioners for the purpose of hearing the applica-
tion of Gerald Martin, Route 1, Box 23, Grover, Colorado 80729
for a Special Use Permit for a dairy operation on the following
described real estate, to-wit:
Part of the East Half of the Southeast Quar-
ter of Section 35, Township 12 North, Range
63 West of the 6th Principal Meridian, Weld
County, Colorado, being wore particularly
described as follows :
Beginning at the Southeast Corner of said
Section 35, Thence North 900 feet; thence
West 30 feet to the True Point of Beginning;
Thence continuing North 1160 feet;
Thence West 450 feet;
Thence South 1160 feet;
Thence East 450 feet to the True Point of
Beginning;
Said tract of land contains 12. 0 acres, more
or less.
WHEREAS, evidence was presented in support of the granting
of the Special Use Permit for a dairy operation on the above
described real estate, and
WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu-
tion authorizes such a use in an Agricultural Zone District upon
approval by the Board of County Commissioners, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those pre-
sent, has studied the request of the petitioner and the recom-
mendations of the Weld County Planning Commission and all of the
exhibits and evidence presented in this matter, and having been
fully informed, is satisfied that the request for a Special Use

Permit for a dairy operation on the hereinabove described real
estate, conforms to the purposes of Section 3. 3 (E) (2) of the
Weld County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application of
Gerald Martin for a Special Use Permit for a dairy operation on
the hereinabove described tract of land be, and hereby is , granted
subject to the Development Standards contained in the Special
Use Permit and subject to no building or electrical permits being
issued on the Special Use Permit area until the Development
Standards for the Special Use Permit have been placed on the
Special Use Permit plat and said plat has been delivered to the
office of the Department of Planning Services.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated July 15, 1980 be, and hereby are, adopted as the findings
of fact of the Board of County Commissioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 13th day of
August, A.D. , 1980.

The following business was transacted:
I hereby certify that pursuant to a notice dated July 7, 1980 and
duly published July 10 and 31 in the Johnstown Breeze a public hearing
was held- on the request of GERALD MARTIN for a SPECIAL USE PERMIT for
a DAIRY OPERATION.
Mr. Anson read the notice and reminded the Board of the criteria they
must use, in accordance with the Zoning Resolution, in determining their
decission on this request.
The Planning Department representative was not present.
Mr. Anson read the Planning Commission' s favorable recommendation,
conditions and the recommended development standards.
COMMISSIONER CARLSON AND VICKI TRAXLER are now present.
Mr. Martin was present and answered questions regarding his request.
John Hall was .present on behalf of the Health Department and stated that
Mr. Martin' s operation is in compliance with all local and state health
regulations. '
There was no opposition present.
Commissioner Roe made a motion to approve the special use permit for
a dairy operation, with the recommended development standard, for Gerald
Martin. Commissioner Dunbar seconded the motion and it carried
unanimously.

area until the attached Development Standards for the Special Use Permit
have been placed on the Special Use Permit plat and said plat has been
delivered to the office of the Department of Planning Services.
DEVELOPMENT STANDARDS
1 . The dairy operation on the hereon described parcel shall be limited
to the facilities shown which are designed to handle a total of
600 milking cows and all other uses permitted by right under Section
3 . 3 . B . of the Weld County Zoning Resolution .
2. The Special Use Permit area shall be maintained in such a manner so
as to prevent soil erosion, fugitive dust, and the growth of noxious
weeds.
3. All phases of the operation shall comply with all County and State
Health Standards and Regulations pertaining to air quality, water
quality, noise emission, and sanitary disposal systems.
4 . Lagoons for wastewater retention shall be installed as per Rules
and Guidelines for Water Pollution Control at Livestock Confinement
Areas issued by the Colorado Department of Health, May, 1968. The
applicant shall be responsible for any additional applicable
directives or guidelines issued by the Colorado Department of Health,
Water Pollution Control Division.
5. All accesses shall have the approval of the Weld County Engineering
Department. All accesses shall be constructed in accordance with the
recommendations and/or requirements of the Weld County Engineering
Department.
6. All plans, specifications and data pertaining to the dairy operation
shall be submitted to the Weld County Health Department for approval
prior to obtaining a Building Permit for the dairy operation.
7. There shall be no discharge of wastes into any streams, other bodies
of water, or adjacent drainage systems without obtaining a National
Pollution Discharge Elimination System Permit from the Colorado
Department of Health.
8. The Special Use Permit shall be limited to the plans shown hereon
and governed by the Development Standards stated above and all
applicable Weld County Regulations. Any material deviations from
the' plans and/or Development Standards as shown or stated above shall
require the approval of an amendment to the Special Use Permit by
the Planning Commission and the Board of County Commissioners before
such changes from the plans and/or Development Standards shall -be -
permitted. Any other changes from the plans and/or Development
Standards shall be filed in the office of the Department of Planning
Services. .
9 . The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Development
Standards. Non-compliance with any of the above stated Development
Standards may be reason for revocation of the Special Use Permit
by the Board of County Commissioners . •

I have received Special Use Permit for Mr. & Mrs. Gerald Martin
Faith Star Dairy to be located 4 miles west and 1 mile south of
Hereford, Colorado.
We have worked and assisted Mr. Martin in facility planning for
his dairy. Since Mr. Martin owns the adjacent land to the Special
permit area on to which corral drainage will occur, we recommend
that he would need a detention pond but could handle effluent by
means of a graded diversion to carry waste materials onto grass-
lands. Mr. Martin is located far enough away from any major stream
that contamination is not a problem. The special use permit does
show a detention pond as part of the plans. I do not know whether
this was an oversight or a change in plans on his part. A detention
pond or graded diversion would be acceptable.
I can see no further concerns for review of this request.

in this area appear to have a low swell potential . We recommend that
the foundation excavation be examined by qualified personnel to confirm

SITUATION: Mr. Martin intends to construct a new dairy facility. He intends to milk
about 80 cows. The area for pens and the barn will cover about two to two and one-half
acres. No foreign drainage can enter the pen area. The soils in the area are Ascalon
fine sandy loam and Paoli fine sandy loam. Ascalon soils have moderate permeability
and Paoli soils have moderately rapid permeability. The land slope is generally
southwest about three percent. The site is in a sparsely populated area of Weld
County. The nearest neighbor is more than one-half mile away.
SUGGESTED SOLUTION(S) Because Mr. Martin owns the land downslope from the proposed
dairy site for almost two miles, the Soil Conservation Service feels there is no
need for a holding pond to collect storm runoff from the dairj pens. The Colorado
Health Dept. has previously approved some similar sites for operation with no holding
ponds. The SCS recommends that a small settling channel or basin be constructed to
collect wash water that has been used in the dairy parlor itself. The pond could be
cleaned out frequently by the operator with normal farm equipment, and any solids
collected could be disposed on adjoining rangeland. If the operator wished to store
the wash water during winter months, a basin of about 0.22 acre feet capacity would
be needed.
