The Board of Trustees has adopted a Resolution initiating annexation proceeding for the Godfrey Bottom Annexation, said Annexation being more particularly described in said resolution. At said fact- finding hearing, the LaSalle Town Board will make a determination of whether the properties proposed to be annexed meet the applicable requirements of Colorado law and is considered eligible for annexation. (Pursuant to 31-12-108 and 31-12-109 C.R.S. as amended.) The applicants have requested zoning be considered for the property at said hearing. Proposed zoning is A-Agricultural. The applicants anticipate no changes or development plans for the property. In addition to annexation materials,we have included a referral sheet for you to identify any concerns you may have regarding this annexation. In order for the town to prepare for the hearing,we ask that you return the referral sheet prior to the hearing or no later than July 11, 2005. The Board of Trustees of the Town of LaSalle, Colorado, hereby finds that the Annexation Petition submitted for the annexation of the property denominated as the Godfrey Bottom 1, 2, 3, 4, and 5 Annexation, as described on Exhibit A attached hereto and incorporated herein, is in substantial compliance with the requirements of C.R.S. 31-12-107 (1) as amended. In support of said Petition, your Petitioners allege: 1. It is desirable and necessary that the above-described unincorporated territory be annexed to the Town of LaSalle, Colorado. 2. The requirements of Section 31-12-104, C.R.S., as amended, exist or have been met, to-wit: a. Less than one-sixth of the perimeter of the area proposed to be annexed is contiguous with the Town of LaSalle. Subject to the requirements imposed by Section 31-12-105(1)(e), said contiguity may be established by the annexation of one or more parcels in a series, which annexations may be completed simultaneously and considered together, as with this petition; b. A community of interest exists between the area proposed to be annexed and the Town of LaSalle. c. Said area is urban or will be urbanized in the near future; and d. Said area is integrated with or is capable of being integrated with the Town of LaSalle. 3. The requirements of Section 31-12-105, C.R.S., as amended, exist or have been met, to-wit: a. In establishing the boundaries of the territory to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, has been divided into separate parts or parcels without the written consent of the landowners; and b. In establishing the boundaries of the area proposed to be annexed, no land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate comprising 20 acres or more (which, together with the buildings and improvements situated thereon has a valuation for assessment in excess of two hundred thousand dollars for ad valorem tax purposes for the year next preceding the annexation) has been included without the written consent of the landowners; and c. That no annexation proceedings have been commenced for the annexation of part or all of the subject property to another municipality; and d The proposed annexation would not have the effect of extending a municipal boundary more than three miles in any direction from any point of such municipal boundary in any one year, and e. The proposed annexation will not result in the detachment of area from any school district and the attachment to another school district. 4. Attached as Exhibit Bl-B5 are a series of annexation maps containing the following: a. A written legal description of the boundaries of the area to be annexed; and b. The boundary lines and the location of each ownership tract, contiguous boundary of the annexing municipality, and location of right-of-ways and utility easements within the area. 5. The boundaries of all special districts having jurisdiction over the area to be annexed as well as rights-of way, utility easements, water and ditch rights are identified on Exhibit C. c. A Certificate of Ownership and Encumbrances showing that the property to be annexed is owned in fee simple, clear of all liens and encumbrances except for the current year's property taxes is attached hereto and known as Exhibit D. d.
