This is a follow-up of your previous memo dated January 6, 2005, to the changes that have occurred since the
last planning commission meeting.
Item 1. The applicant is increasing the number of employees on the site from the original 10 employees to 20
employees.
Response: The applicant is identifying 41 parking places being proposed for the site. This should
accommodate the additional employees.
Item 2. The applicant is indicating adding additional storage for vehicles and equipment. A greater part of the
larger equipment will have to be brought in by Low Boy (semi tractor trailer rigs).
Response: The Weld County Public Works recommends coming in from the south (Brighton area) on WCR 27
id not utilize WCR 6 to the north. The corner at WCR 6 and WCR 27 will not accommodate turning radiuses
tor large vehicles in a safe condition.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 27 is designated on the Weld County Road Classification Plan (FHU) as a major arterial road, which
requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
""EQUIREMENTS:
Access: The applicant has identified on the plat drawing the utilization of the two existing gated accesses
from WCR 27. The existing north access by the office building will be abandoned where the proposed parking
area will be .
Off-Street Parking: The applicant proposed to pave three± acres adjacent to the existing office and
warehouse area. Match existing grades and adequate turning radiuses to WCR 27. The remaining gravel
storage lot for vehicles shall be surfaced with gravel for a minimum of six inches as identified on the plat
drawing.
Each parking place shall be appropriately striped and equipped with wheel guards where needed to prevent
vehicles from extending beyond the boundaries of their space and coming into contact with other vehicles,
walls, fences, sidewalks, or plantings.
Storm Water Drainage: The applicant shall provide a storm water drainage report. The drainage
report/erosion control plan and the Storm Water Management Plan (SWMP) is a part of the site development.
The proposed detention/water quality pond shall be located outside the future right-of-way identified for WCR
27.
The storm water drainage report and erosion control plan (SWMP) shall be submitted to the Weld County
Public Works Department for review and approval.

Environmental Health Services has reviewed this proposal for a commercial junkyard or
salvage yard. We have no objections to the proposal, however, we do recommend that
the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1 . In the event, the applicant intends to wash vehicles or equipment on site the
following shall apply:
The applicant shall provide evidence that any vehicle washing area will be
designed and constructed to capture all effluent and prevent any discharges
from the washing of vehicles or equipment in accordance with the Rules and
Regulations of the Water Quality Control Commission and the Environmental
Protection Agency.
2. The applicant shall submit evidence to the Department of Planning Services,
from the Colorado Division of Water Resources, demonstrating that the well is
appropriately permitted for the commercial use.
3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to operation:
1. The Environmental Health Services Division was unable to locate a septic permit
for the existing office/warehouse building(s). An individual sewage disposal
system is required for the existing office/warehouse and shall be installed
according to the Weld County Individual Sewage Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.

9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
11.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
12.If applicable, the applicant shall comply with all provisions of the Underground
and Above Ground Storage Tank Regulations (7 CCR 1101-14).
13. If applicable, any vehicle washing area(s) shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
14.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Site Specific Development Plan and Special Review Permit for a Use by Special Review in the Industrial Zone
District ( Commercial Junkyard or Salvage Yard) in the 1-3 (Industrial)Zone District.
1. A building permit shall be obtained prior to the construction of any new building, addition or remodel of existing
buildings. A building permit is required for change of use of any existing buildings.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans
--re required when applying for each permit. Provide a Code Analysis Data sheet provided by the Weld County
.gilding Department with each Building permit application.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. The buildings will probably be classified as follows: mixed use B (Office) and S-1 (Warehouse) occupancies.
Mixed use S-1 (Warehouse) and S-2 (Vehicle Storage).Fire resistance of walls and openings, construction
requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and
offset distances shall be determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.

Just a note to let you know that we have received and reviewed your memo dated 1/6/05
regarding the applicant' s changes to USR-1493 . I had a phone conversation with Chris
Strong of Otis, Coan & Stewart, LLC on 2/1/05 in which he assured me that the plans for
the internal roads/access requested in our response letter dated 11/5/04 would be
forthcoming to the Fire District for review and approval. We have not received those plans
as of this date. Further, I advised Mr. Strong that the Fire District would request of
Weld County that we be included in the review of any plans submitted for application of a
Building Permit to construct or modify any structures associated with this case. Also, Mr.
Strong assured me that no vehicles of any type would be stored inside of any structures
and that no welding or cutting (hot work) would be conducted/performed at the site. The
changes made by the applicant do not modify our previous requirements, nor do they promote
any additional issues or requirements.

Dear Jacqueline,
The following comments are made in response to the above noted site plan review. The Uniform
Fire Code, 1997 Edition,and other codes or standards referenced within the Fire Code,governs
these comments and resulting requirements.
General Comments:
I. No water supplies for fire protection are currently available to this site. Therefore,
approved onsite storage of adequate water supplies for firefighting operations shall be
provided: if vehicles are parked or stored inside any structures; or, if the applicant(s)
conduct welding or hot-work operations on the subject premises.
2. The applicant shall provide the Fire District with a detailed plan of the proposed internal
access routes within and upon the property. Please direct/encourage the applicant to
contact the Fire District to discuss this issue.
3. The applicant has indicated that the existing structures—9,600 square foot
office/warehouse and 7,200 square foot warehouse—will not be utilized for the parking
or storage of insurance damaged vehicles. What is the intended use of these structures?
Based on the applicant's response to this question, additional fire protection systems or
features may be required.
Should there be any questions concerning these requirements,please do no hesitate to contact this
office.
