Thank you for your participation in the referral process with Weld County and our request to Amend USR-1231. In your letter dated March 21, 2005, you are requiring the following restrictions of the surface. Here is our response attempting to satisfy your concerns: 1. KPK will require 150' around each wellhead without any improvements, including but not limited to fences, roads, moveable structures and non-moveable structures. This facility meets the requirements of 150'around any wellhead. 2. Sufficient distance on each side of an existing flowline and consolidation line. We will ensure that appropriate distances are maintained on each side of existing flowlines and consolidation lines. 3 If tank batteries are onsite, KPK will need at least 200' around each tank from any building or structure. The 200'parameter is or will be met 3. Restrict 75' on each side of pipelines from an ignition source. The 75' parameter will be met.
