To Whom It May Concern:
I have been notified of a Public Hearing scheduled for February 1, 2005, before the Weld
County Planning Commission regarding the captioned development project. As the
mineral owner of the property, I am aware that I am entitled to receive 30-days notice of
the meeting prior to the date.
Nonetheless, as I have been aware of this meeting for some time, please accept this letter
as my waiver for the 30-days notice, and allow the Planning Commission meeting to
occur as scheduled on February I, 2005.

Merit Energy Company has been notified of a Public Hearing scheduled for February 1,
2005, before the Weld County Planning Commission regarding the captioned
development project. As a lessee of mineral rights on the land being considered for the
Change of Zone,Merit Energy Company hereby waives its right to be notified at least 30
days prior to the Planning Commission's Public Hearing, scheduled for February 1, 2005.
Merit Energy Company does not waive its right to receive future notices regarding public
hearings for this development in accordance with applicable law.
Merit Energy Company has reached a mutually acceptable agreement with the applicant
and has no objection to the proposed application. If you have any questions, please
