RE: APPROVAL OF USE BY SPECIAL REVIEW PERMIT TO AMEND CERTAIN
PORTIONS OF DEVELOPMENT STANDARDS OF SPECIAL USE PERMIT

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 9th day of February, 1983, at the hour of 2: 00
o 'clock p.m. in the Chambers of the Board for the purpose of
hearing the application of James McDonald, P.O. Box 22 , Fire-
stone, Colorado 80620, for Use by Special Review Permit to amend
certain portions of Development Standards of Special Use Permit
433 : 80 : 33, on the following described real estate, to-wit:
Part of the E1/2 Wi SW4, Section 25, T2N,
R68W of the 6th P.M. , Weld County, Colorado
WHEREAS, the request is to amend Development Standards No.
5, 6, 8 and 10 of Special Use Permit 433 : 80 : 33 , and
WHEREAS, Section 24 . 4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the re-
quest of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, finds that:
1 . The submitted materials are in compliance with applica-
tion requirements of Section 24 . 7 of the Weld County
Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a) The proposal is consistent with Comprehensive Plan
policies in that the use does not appear to infringe
on the continued agricultural use in the vicinity
or County.
b) The proposal is consistent with the intent of the
agricultural zone district and is provided for as
a Use by Special Review.
c) The activities and improvements proposed will be com-
patible with existing and future agricultural uses
in the neighborhood.

and welfare to the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application for a
Use by Special Review Permit to amend Development Standards No.
5, 6, 8 and 10 of Special Use Permit 433 : 80 : 33 on the hereinabove
described parcel of land be, and hereby is, granted subject to
the following conditions:
1 . The attached Standards for Use by Special Review, with
the exception of Standard No. 6 , pertaining to hours
of operation be adopted. Standard No. 6 shall now be
amended to read as follows:
"Hours of operation for the airport operation shall be
from dawn until 8 : 00 P.M. or sunset, whichever occurs
first. "
2. The plat for the use permit be placed of record by the
Department of Planning Services staff prior to any build-
ing permits being issued on the site.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 9th day of
February, A.D. , 1983 .

1. The permitted uses on the hereon described
pparcel shall be an
airport and parachuting operation and shall be limited to the z
facilities shown hereon which are designed to handle a total of
twelve (12) planes and a maximum of twenty-five (25) takeoffs and ma:
twenty-five (25) landings per day and all other uses permitted by

right in the Agricultural Zone District of the Weld County Zoning
Ordinance.

2. The Use by Special Review Permit area shall be maintained in such a
manner so as to prevent soil erosion, fugitive dust, and the growth
of noxious weeds.
3. Separate toilets shall be installed for each sex at the rate of two ^ -'
(2) for the first one-hundred (100) persons and one (1) for each
additional one-hundred (100) persons, or fraction thereof.
4. Two (2) public accesses for the airport shall be permitted. Said p
accesses shall be clearly labeled on the property. All accesses
shall have the approval of the Weld County Engineering Department. —

All accesses shall be constructed in accordance with the recommenda-
zv
tions and/or requirements of the Weld County Engineering Department.
5. The hangar shall be used strictly for the storage, maintenance, and
repair of aircraft. Maintenance and repair of aircraft shall be
permitted only between the hours of 8:00 a.m. and 8:00 p.m. for
uses which create noise and/or vibration noticable at, or beyond no
the property line. Commercial repair of aircraft on the property
is prohibited.

7. Trash and refuse shall be removed from the property regularly. All
trash not removed shall be stored inside a building or an enclosed
container to prevent blowing of refuse onto surrounding properties.
8. A four (4) strand barbed wire fence shall be constructed along the
entire west side of the property with one (1) private access point
located at 5059 Weld County Road 16. This access shall only be for
vehicular traffic. The property owner(s) and/or operators(s) of
the airstrip shall be responsible for maintaining the fence in good
repair and free from debris. The fence shall be constructed within
sixty (60) days of the date of approval by the Weld County Board of
County Commissioners.
9. A sign shall be posted on the property containing the limitations
as to use, including hours of operation, and number of takeoffs and
landings permitted.
10. A parking area of sufficient size to park one-hundred (100) vehicles
shall be located on the property. Other parking areas may be
allocated for the use of the operators of the planes in storage in
the hangars. The parking areas shall conform to the requirements of
Section 41.1.3 of the Weld County Zoning Ordinance. No parking
shall be allowed on Weld County Road 16. All traffic shall be
controlled within the confines of the property.
11 The building and fuel storage plans shall be reviewed by the
Longmont Fire Protection District for conformance with fire protec-
tion requirement.
12. A storage tank of sufficient size to hold three-thousand-five-
hundred (3,500) gallons of water shall be placed on the property to
aid in fire protection of the property.

13. The owner/operator shall maintain a ditch for traffic control on
the south side of the property. There shall be two (2) public
access points from Weld County Road 16 to the site.
14. The applicant shall be responsible for adhering to the provision of
CRS 25-12-13 regarding noise emissions. All phases of the opera-
tion shall comply with all County and State Health Standards regard-
ing regulations pertaining to air quality, water quality, sanitary
disposal systems and building.
15. The Use by Special Review Permit shall be limited to the plans
shown hereon and governed by the Development Standards stated above
and all applicable Weld County Regulations. Any material deviations
from the plans and/or Development Standards as shown or stated
above shall require the approval of an amendment to the Use by
Special Review Permit by the Planning Commission and the Board of
County Commissioners before such changes from the plans and/or
Development Standards shall be permitted. Any other changes from
the plans and/or Development Standards shall be filed in the office
of the Department of Planning Services.
16. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Development
Standards. Noncompliance with any of the above Development Standards
may be reason for revocation of the Use by Special Review Permit by
the Board of County Commissioners.

the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 24, 1983, duly
published January 27, 1983 in the La Salle Leader, a public hearing was held
on the request of James McDonald for a Use by Special Review permit to amend
Development Standards 5, 6, 8 and 10 of Special Use Permit 433:80:33. The
Planning Commission recommended favorably to the Board that the request be
approved with the exception of development standards #5 and #6. The Planning
Commission recommended that development standards #5 and #6 be approved in
their second recommendation. James McDonald briefly commented on their hours
of operation. Ed Herson stated that he owns the house directly adjacent to
the airstrip. He asked that the hours of operation be extended because the
farmers are using helicopters to crop dust their crops and that is noisier
than a regular plane. He stated that the sky diving license requires two
night dives and he would like to conduct one dive on New Year's Eve. He stated
that the Civil Air Patrol has been hampered because they can not take off

from this airport until after 8:00 A. M. He added that they would like the
number of landings per day increased fran 25 landings per day. Mr. Anson
stated that the application only includes Development Standards #5, #6, #8 and #10
and that is the original application. He questioned if the Planning Commission
ever reviewed any of the other standards. Mr. Allison stated that those were not
reviewed at all and the way the case was advertised was the changes in the
development standards and they were specifically listed. Mr. Anson asked if the hours
of operation could be extended beyond the original hours. Mr. McDonald
stated that discussion regarding the hours came up over the ultra lights,
"cause, like I said, maybe thirty of than out there early in the morning
buzzing around like a bunch of lawnn wersand that's were it came up and in
between meetings we talked it over with all the other fliers and we decided that
we just couldn't have them there. It was just too much noise. They've got
lawn motors on their little kites with no mufflers on'em and they didn't know
how to fly and there is no way to control the gliders Mr. Anson asked Mr.
McDonald if the Planning Commission discussed the hours of operation. Mr.
McDonald said that he raised the question about extending the hours of operation.
Mr. Herson said that he would be a mediator and if a neighbor has a complaint
he would solve it for them. Mr. Allison commented on the notices that were
published and mailed to the adjacent landowners. Mr. Anson stated that he
was concerned about the original request fran Mr. Terry which indicates
specifically that he would like to change from 8:00 A. M. to sunset plus one
hour. Mr. Allison said that is correct. Commissioner Johnson agreed that
the original request did not contain a change to the hours. Mr. McDonald stated
that the original deal contained no morning requirements and they would take off
to the south. He stated that it was the ultra lights that brought up the question
about the 8:00 flying. Mr. McDonald stated that the ultra lights were still
taking off during the month of August and the neighbors said that they did not like
the noise. Mr. McDonald stated that they ran off the ultra lights, posted signs
saying that they were not allowed, and now just planes take off and land on this
airport. Mr. Allison said that the request was to change the hours from 8:00 A. M.
to one hour after sunset. 'Mr. McDonald stated that all they need is some minimum
morning operations so emergency flights can take off. Commissioner Brantner
questioned how long the 8:00 A. M. has been in effect. Mr. Allison said that
the 8:00 A. M. was approved with the original request approximately two years
ago and dusting was not allowed. Mr. McDonald agreed and stated that is when the
farmers started using helicopters to crop dust their crops. Commissioner N.
Carlson commented on the action taken by the Board last fall. Mr. McDonald
stated that if the question regarding the hours has been overlooked he would
like it to be considered and have the hours extended. He asked that the morning
hours be changed to 6:30 or 7:00 A. M. that would be more in range for an airport.

Mr. Anson stated that the only development standards that can be changed are
the ones that were advertised. That eliminated consideration regarding the
number of flights per day. After additional discussion, Commissioner N.
Carlson made a motion to approve the amendments to #5 and #6 with the wording
dawn to dusk be changed fran the 8:00 A. M. to 8: P. M. Commissioner Martin
seconded the motion but added that he has a problem with it because that's what
all the complaints were about. Cammissioner N. Carlson said that he thought
that the complaints were about the ultra lights and they are gone. Commissioner
Martin questioned if the question regarding hours shouldn't be considered by
the Planning Commission first. Commissioner Johnson questioned what was meant
by dusk. Commissioner N. Carlson said that dawn would mean a half hour before
sunrise and dusk would mean a half hour after sunset. The Rnard discussed the
notice published for this hearing. Commissioner N. Carlson stated that this
change would be a substantial change during the stunner months when the airport
is needed for crop dusting. The Chairman reminded the Board that there is a
motion and second to change the hours fiuia 8:00 A. M. to 8:00 P. M. to fran
dawn to dusk, defined as a half hour before sunrise and a half hour after sun-
set. Commissioner N. Carlson added that he included any other changes that are
within this amendment as recommended. Commissioner Martin stated that because
of how the notice was written that he would have to vote against the motion,
he couldn't in good faith vote for it. The Board reviewed the published notice
again. Commissioner N. Carlson stated that it says that we are amending
#5 and #6. Commissioner Brantner stated that he understands the need but
would have to vote with Commissioner Martin. The Chairman suggested to
Commissioner N. Carlson that it be dawn rather than dusk. Commissioner N.
Carlson said he would have no problem with that because basically he didn't
think that they were changing the evening hours, 8:00 P. M. or sunset, which-
ever occurs first, therefore, all that is being added is an hour or hour and
a half in the morning. The Chairman stated that the Planning Commission
approved 8:00 A. M. to one hour after sunset. So if the time, dawn which would be a
half hour before sunrise were included ih your amendment that would take care
of the problem. Commissioner N. Carlson agreed by saying he had no problem
with that. Commissioner Martin agreed that this amendment could be included
in his cocond. Commissioner Brantner stated that is not correct the final
approval by the Planning Camrission.was not the hour after sunset, is that
correct. Mr. Allison said that's right, it was 8:00 A. M. to 8:00 P. M. or
sunset whichever occurs first. Mr. Allison reminded the Board that the Planning
Commission approved both of their motions. Commissioner Johnson said that if
you say dawn to dusk we're extending the early hours. Mr. Allison answered yes,
that's correct. Commissioner Johnson said that fran what she has read that
the applicant wanted more flight hours at night. Mr. Allison said yes, for the
parachute operations. After discussion, the Chairman said that the chair is
open for motion on the use by special review as amended. Commissioner Johnson
said that she still was not clear but that the amendment is to #6. The Rnard
agreed that they were amending #6. The Chairman called for the vote and all
the Commissioner's voted yea. He added that the motion was from dawn until a
half hour after sunset or 8:00 P. M. whichever occurs first. Mr. Berson stated
that he was representing all the property owners on the west side of the airport
and they had met with Mr. Allison earlier on this matter. Commissioner Johnson
said that we are agreeing from dawn until 8:00 P. M. or sunset whichever occurs
first and that's your motion. Commissioner N. Carlson said whichever occurs
first, if that's agreeable to the seconder otherwise we have it dawn to dusk.
The Chairman stated, tmat'tae have an amendment to the motion are you all in
favor:' All the Commissioners voted yea. The amendment to the motion carried
unanimously. The amended motion was never voted upon. Mr. Allison stated that
at the Planning Commission hearing sane people expressed concerns about the night
flights and the Planning Commission took that into consideration and thus the
reason for the two recommendations. The first recommendation was approved
except for development standards #5 and #6. Then the Planning Commission
recommended development standards #5 and #6. There were two separate recommendations
submitted by the Planning Commission. After additional discussion, Commissioner
Johnson made a motion to approve the amendments to development standards #5,
#6, #8, and #10; #5, #8, and #10 as presented by the planning Commission and
#6 as amended by us which would be hours of operation fran dawn until 8:00 P. M.
or sunset whichever occurs first. Commissioner Martin seconded the motion. All

The Weld County Planning Commission will conduct a public hear-
ing on January 18. 1983 at 1: 30 p.m. to
review a request for approval of an anendnent to SUP-433:80.33 for an
airport hangar and parachute school

6th P.M. , Weld County, Colorado
containing 40 acres, more or less.
This public hearing to be held by the Weld County Planning
Commission for the consideration of the above reference request
will be conducted in the Weld County Commissioners ' Hearing

Street, Greeley, Colorado. Comments or objections related to

COMMENT:
Fred Otis His purposes (in denial of extended hours) are several fold.
First of all he is relatively unsympathetic to a jump school where there
is not a great amount of control. From the histories he has heard of
jump schools, people who are jumping land in all sorts of different
places and there is a great amount of inconvenience to surrounding
property owners. There has been some testimony of dangers, especially
in the dark, from an unlighted airport with the coming and going of
planes and parachutists. It is his feeling that area residents who
have lived there for some time deserve respect and they are already
putting up with a lot just by living next to an airport, the noise and
other inconveniences are annoying. He feels there should be some
controls and he can see no reason to extend the hours.

1. The permitted uses on the hereon described parcel shall be an
airport and parachuting operation and shall be limited to the
facilities shown hereon which are designed to handle a total of
twelve (12) planes and a maximum of twenty-five (25) takeoffs and
twenty-five (25) landings per day and all other uses permitted by
right in the Agricultural Zone District of the Weld County Zoning
Ordinance.
2. The Use by Special Review Permit area shall be maintained in such a
manner so as to prevent soil erosion, fugitive dust, and the growth
of noxious weeds.
3. Separate toilets shall be installed for each sex at the rate of two
(2) for the first one-hundred (100) persons and one (1) for each
additional one-hundred (100) persons, or fraction thereof.
4. Two (2) public accesses for the airport shall be permitted. Said
accesses shall be clearly labeled on the property. All accesses
shall have the approval of the Weld County Engineering Department.
All accesses shall be constructed in accordance with the recommendations
and/or requirements of the Weld County Engineering Department.
5. The hangar shall be used strictly for the storage, maintenance, and
repair of aircraft. Maintenance and repair of aircraft shall be
permitted only between the hours of 8:00 a.m. until one (1) hour
after sunset for uses which create noise and/or vibration noticable
at, or beyond the property line. Commercial repair of aircraft on
the property is prohibited.

10. A parking area of sufficient size to park one-hundred (100) vehicles
shall be located on the property. Other parking areas may be
allocated for the use of the operators of the planes in storage in

Mr. Cunliffe,
Development Standard #6 -- change to road: "Hours of operation for the
airport and the taking off and landing of planes shall be from 8 a.m. until
sunset plus 1 hour."
Development Standard 18 - change 1st sentence to read: "A four strand
barbed wire fence shall be constructed along the entire west side of the
property with one access point located approximately 300 feet North of Weld
County Road ;416 for vehicular traffic only into the residence of Doug Noe."
Development Standard ,710 - delete the word "gravel" from the 1st
sentence.
Reasons for changes in Development Standards:
A. Solvency of the parachute operation is impossible with the shortened
operating hours required by Development Standard #6 for the following
reasons:
1. The commercial sport parachute operation being conducted on
the permit area has always been a full service, on demand,
operation in order to survive financially. The functions
include student training, sport parachute demonstrations for
special events at other locations, a base of operations for
testing new equipment and techniques by parachutists, and a
place to improve skills and experience levels, both for
rDcreation and for progression on advanced licenses recognized
by the
2. The cost of equipment and facilities needed to keep ono or
more aircraft available on a regular basis for a parachuting
operation is so high that each single obstacle to continuous
operation threatens the solvency of the business. Common
obstacles to the operation include severe weather, unsuitable
runway conditions due to snow or rain, mechanical delays on
aircraft, good skiing conditions in the local mountains, and
2rofossional football games. Uncommom obstacles include dourly
operation r,utrictions imposed by local gov.Tnment.

on regular employment. The recreation motive that keeps para-
chutists in the sport generally results in very limited activity
in the morning hours. Approximately 15% of the parachute jumps
made at the facility, presently under the permit, over the past.
7 years occur bore noon; 70% occur between noon and sunset;
and 15% ocour .after sunset or at night. The present operation
changed its Writing structure more than a year ago to reduce
all morning rates by 10 and all rates before 9 a.m. by 25%.
Such changes have had no affect on increasing the frequency
of the corning operation, or reducing the afternoon and after
sunset operations which still account for 85% of the business.
4. for demonstration sport parachute jumps into special events,
fund raising events, promotional events, and conjested or
populated areas, the F.A.A. requires that parachutists be
"expert" (D. license with U.S.>Parachute Association) or
equivalent. One of the requirements for the D. License is
the logging of night parachute jumps. Without the facilities
where occasional night parachute jumps can be conducted, no
additional parachutists can qualify for the D. License.
Additionally, night recreational and proficiency jumps can no
longer be carried out by qualified parachutists.
5. In the past 2 years, there have been seven parachute flight
operations at the facilities under SUP — 443:80:33 that involved
a total of 41 parachute jumps in which the aircraft took off at
night. All take-offs were made from the runway on a S.E. heading
away from the residences on the North and West sides of the
airport. All landings except one were made in a N.W. direction
to avoid flying over those residences.
Summary: Lessee requests changes to Development Standard
6 as noted in order to keep operation solvent.
Lessee futher expects to accommodate all para—
chute jumps required with—in the amended hours.
B. In accordance with Development Standard #8 date 10/20/80 available
to Lessee, South side fence of 4 strand barbed wire was completed
on 11/21/82, West side fence of 4 strand barbed wire was completed
on 11/23/82 except for an opening allowing vehicular access to Doug
Noe property. Since existing fence now exceeds requirement approved
by property owner on 9/17/80, and made available to Lessee on 11/22/82,
property owner therefore requests amendment to Development Standard
#8 to allow barbed wire fence because original intent of fence is
now satisfied, and additionally requests amendment to allow vehicular
access to Doug Noe property from gravel access road on permit area
in order that adjacent property owner be spared the expense of building
a surfaced driveway parallel to and immediately adjacent to the
existing access road on the west side.
Note: Corrections needed on permit map to show correct
location of existing access road immediately adjacent
to S.W. property line.

C. In order to maintain traffic control with-in the confines of the
permit property as per Development standard ;i10, and to keep parking
lot surface compatible with the additional user requirement of
packing parachutes as outlined in Lessee letter to Planning Commission
jtaft' dated 9/30/82, Lessee requests amendment to Development Standard
O0 deleting requirement to place gravel on the parking lot.
