RESOLUTION RE: APPROVE APPLICATION FOR HIGHWAY TRAFFIC SAFETY PROJECT FOR PURCHASE OF BLOOD/BREATH ALCOHOL TESTING VEHICLE AND AUTHORIZE CHAIR TO SIGN - COLORADO DEPARTMENT OF TRANSPORTATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with an Application for the Highway Traffic Safety Project for the purchase of a Blood/Breath Alcohol Testing Vehicle,from the County of Weld,State of Colorado, by and through the Board of County Commissioners of Weld County,on behalf of the Weld County Sheriff's Office, to the Colorado Department of Transportation, commencing October 1,2005,and ending September 30,2006,with further terms and conditions being as stated in said application, and WHEREAS,after review,the Board deems it advisable to approve said application,a copy of which is attached hereto and incorporated herein by reference. PART A - PROBLEM STATEMENT (1) Describe the situation, Include any data and any other information to establish the existing conditions. (2) State why the situation is undesirable. (3) What are the causes? (4) Identify changes needed to resolve the identified problem(s). National statistics show that drunk drivers are involved in approximately 30% of all fatal crashes. This statistic is mirrored in Weld County. In 2004, Weld County lost 92 individuals to traffic crashes which was a record year for the number of traffic fatalities in Weld County. Weld County has a population of approximately 217,000 which makes the ratio of fatal crashes to population one of the highest in the nation. In January of this year, a meeting was held to discuss issues concerning the number of fatal crashes. This meeting was attended the Weld County Chiefs of Police Association, the Weld County District Attorney's Office, the Colorado State Patrol, the Weld County Sheriff's Office, the Greeley Police Department and numerous individuals and groups concerned with traffic safety. From the discussion within this group it was determined that enforcement of alcohol related laws was haphazard and varied greatly from one jurisdiction to the next. Lack of personnel to safely and effectively conduct alcohol enforcement operations was also a concern. Additionally, a concerted effort to inform the public was missing due to there not being a unified law enforcement "voice" regarding this topic. One of the proposed solutions to address the traffic problem was to establish an alcohol task force. This group would be tasked with finding methods and strategies to more effectively and efficiently manage alcohol enforcement of both with drivers and servers. In February of this year, an alcohol task force was established consisting of the following jurisdictions; the Weld County District Attorney's Office, the Colorado State patrol, the Greeley Police Department, the Weld County Chiefs of Police Association, and the Weld County Sheriffs Office. One of the functions of this group will be to plan and execute multi-jurisdictional DUI Sobriety Check Points and Saturation Patrols throughout the county. Weld County is a large county covering approximately 4000 square miles. Enforcement of alcohol related traffic laws is difficult due to the time required to transport offenders to locations with intoxilizers. Not only are there legal issues concerning time constraints for prosecution of these offense, officers are out of service for extended periods of time to transport offenders to locations where intoxilizers are used. The average time arresting, transporting and providing a blood or breath test to offenders is two hours. A vehicle which houses an intoxilizer and an area to draw blood would enhance the quality and quantity of DUI arrests. This vehicle would be transported to areas throughout the county where DUI saturations and DUI checkpoints were occurring. Offenders could then be "processed" on scene and officers time used more effectively and efficiently. This vehicle would also be available to all jurisdictions throughout Northern Colorado to help enhance their DUI prosecutions. Both the Morgan County and Larimer County Sheriff's Offices have expressed interest in sharing in this project and will be utilizing this vehicle. page 4 CDOT Fonn#1 116 9/96 PART B - PROPOSED ACTIVITIES GOAL I: Purchase a Blood/ Breath Alcohol Testing Vehicle TASKS: State what is to be accomplished and when. By January 31, 2006 the Weld County Sheriff's Office will have purchased and outfitted a Blood / Breath Testing vehicle for use by law enforcement agencies throughout Northern Colorado. Goal II: Select and train two officers from each county to operate and take responsibility for the vehicle while deployed. TASKS: State what is to be accomplished and when. By March 31, 2006 two officers will be selected from each county utilizing the Blood / Breath Testing vehicle and trained on its operation and uses. Each of these officers will have operational authority for the vehicle while in their jurisdiction. Goal III: Conduct DUI operations in each participating county. TASKS: State what is to be accomplished and when. By September 30, 2006 conduct eight DUI enforcement operations in each participating county. PART C- CAPITAL EQUIPMENT What equipment, if any, will be purchased to meet the needs of this project? (See Project Evaluation in Contract Management Manual.). Goal I: Blood / Breath Testing vehicle purchased, equipped and operational by January 31, 2006. Goal II: Two officers selected and trained in the operation and use of the Blood / Breath Testing Vehicle by March 31, 2006. Goal III: Eight DUI enforcement operations conducted in each participating county by September 30, 2006. Performance measures will be reported to the Weld County Alcohol Task Force while Blood / Breath Testing vehicle is being used by individual counties. These performance measures will include of number of alcohol related arrests made during DUI operations and number hours the vehicle was in use. * Personnel budget was determined using the following formula: Vehicle in use three days per week for the six months of permissible weather - 624 hours One officer trained in its operation and as an intoxilizer operator— training for six officers — 96 hours Average officer salary - $33.93 per hour (2)State how the Contract Director will monitor project activity and progress during the contract period. Let this letter serve as our agreement to partnership with Weld County Sheriff's Office in an effort to further combat intoxicated drivers on our roadways in Northern Colorado. I understand that Weld County Sheriff's Office will be submitting the grant application to the Colorado Department of Revenue and will acquire the vehicle and design an operation protocol for same. Its further understood that an agreement will be worked out between Weld, Larimer and Morgan Counties as to the use and care for the vehicle once acquired.
