Subject: Use by Special Review# 1251

Zoning: Agricultural
Parcel#: 0807 18 000064
Dear Pat and Amanda Weakland:
It has been brought to the attention of the Department of Planning Services that your commercial
greenhouse and garden center may not be in compliance with the approved Use by Special Review#
1251. Staff has noted numerous stacks of landscape material wrapped in plastic on pallets on site. The
material is located in the sales parking area immediately adjacent to State Highway 392.
Per the Development Standard# 17, "The trash receptacle, loading area and any outside storage(except
display items for sale) must be screened from all adjacent properties and public rights-of-way."
Development Standard#20 states"The property owner or operator shall be responsible for complying
with the operation standards of Section 24.6 of the Weld County Zoning Ordinance" (Section 23-2-250,
Weld County Code). It appears that this facility is not in compliance with both Development Standards 17
and 20 of USR 1251.
Further, visual inspection of the property has identified a fifth wheel mobile home located on site. This
vehicle appears to be utilized in some fashion as the"pop out"portion of one wall has expanded and the
vehicles steps have been extended. This vehicle does not appear on the approved Use by Special
Review# 1251, Site Map.
Given the existing situation, it is recommended that a representative of your office contact the planner on
call at the Department of Planning Services to discuss this violation of Use by Special Review# 1251. If
the commercial greenhouse and garden center's representative visits this office in person, please bring
this letter with you to facilitate servicing your case file. Should contact with this office not occur within five
business days, the matter will be turned over to the Code Compliance Officer.
Should you have any questions or need further information, I may be reached at the above address,
telephone number or e-mail address.
Sincerely,
Kim

Dear Mr. Ogle,
This letter is in response to your correspondence of February 22, 2005 and our phone
conversion on February 28 regarding the letter. The camper parked on our property is a
family unit and is for sale. No one is living in it. The parking lot has been cleared of the
soil amendments not for sale. As per our conversation, in the future we will place
unopened pallets of soil amendments behind the ones opened for sale and will unwrap the
next pallet when the front one has been emptied. Thank you for your time.
