TRUST
A public hearing was conducted on March 9, 2005, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 18,2005,and duly published February 23,
2005, in the Fort Lupton Press, a public hearing was conducted to consider the request of Mary F.
Carlson Revocable Living Trust and George B. Carlson Revocable Living Trust for a Site Specific
Development Plan and Final Plan, MF#1053, for a nine (9) lot Minor Subdivision- Prairie Ridge
Estates. Lee Morrison, Assistant County Attorney, made this a matter of record. Chair Jerke
advised the applicant's representative, Jeff Couch, TEAM Engineering, that he has the option of
continuing this matter to a date when the full Board will be present. However, if he decides to
proceed today, it will require three affirmative votes,or in the case of a tie vote,Commissioner Vaad
will listen to the record and make the determining vote. Mr. Couch indicated he would like to
proceed today.
Jacqueline Hatch,Department of Planning Services,presented a brief summary of the proposal and
entered the favorable recommendation of the Planning Commission into the record as written. She
gave a brief description of the location of the site and surrounding land uses,and stated the site will
be serviced by the North Weld County Water District arid septic systems. Ms. Hatch stated the
Change of Zone was approved on June 16,2004,and was later reviewed by the Coordinated Utilities
Advisory Board on June 20, 2004. She further stated twelve referral agencies reviewed this
proposal, six responded favorably or provided comments that have been addressed in the
Conditions of Approval and Development Standards, and staff received no comments from
surrounding property owners. Ms. Hatch stated should this request be approved,Conditions#1.G
and#1.H need to be corrected to reflect that the property will be serviced by the North Weld County
Water District, not the Central Weld County Water District.

Pam Smith, Department of Public Health and Environment,stated these will be large lots,averaging
ten acres in size. She stated the Cactus Hill Ditch is located to the east, and the preliminary
percolation rates indicate conventional systems will be suitable. Ms. Smith stated there is an
existing house on Lot 1, which has a septic permit from 1995. She stated some of the lots may
have mounded systems due to soil conditions or as a result of seepage on six of the lots along the
ditch. Based on the size of the lots and good soil conditions, Ms. Smith stated she is not requiring
septic envelopes.
Peter Schei, Department of Public Works,stated staff has included a Condition of Approval requiring
the applicant to enter into an Off-site Improvements Agreement,which includes participating in a
roadway stabilization program for five years on Weld County Road 84. He stated if the project is
not completed within that time,the applicant's money will be returned. Responding to Chair Jerke,
Mr. Schei stated the interior road will be gravel and maintained by the Homeowners'Association.
Mr.Couch stated they have not changed the configuration of the large lots,the existing structure has
been included in the Minor Subdivision,and both Lots A and B of a prior Recorded Exemption have
existing septic systems. He stated the lots on the east are long,which will allow them to keep the
homes further from the ditch, although the soils report done on each lot did not indicate any
problems with using conventional systems. In response to Commissioner Geile, Mr.Couch stated
they have had two meetings with the Cactus Hill Ditch Company to ensure setback and seepage
issues have been adequately addressed, and they have a letter of agreement, dated July 2004.
Responding to Chair Jerke, Mr. Couch stated the previous owner used the property for pasture
grass for grazing sheep and the parcel has been vacant for the past five years. He stated they
intend to keep the historical irrigation systems in tact, which includes 7,000 acre feet of irrigation
piping. He stated they have enough water to keep the ditch active,and homeowners can participate
in acquiring water to maintain their lots. He further stated the Homeowners' Association will be
responsible for the interior road; however, it was designed to be upgraded to pavement, at which
time they will request the maintenance be taken over by the County. Mr. Morrison stated normally
that is done through the Improvements Agreement process and it is the general policy to accept a
road if it is paved to County standards; however, the Board can decline to accept since it is being
proposed through the Minor Subdivision process.
No public testimony was offered concerning this matter. In response to Chair Jerke, Mr. Couch
stated he and the applicants have reviewed and concur with the Conditions of Approval and
Development Standards as proposed and modified.
Commissioner Long moved to approve the request of Mary F.Carlson Revocable Living Trust and
George B.Carlson Revocable Living Trust for a Site Specific Development Plan and Final Plan, MF
#1053,for a nine(9)lot Minor Subdivision-Prairie Ridge Estates,based on the recommendations
of the Planning staff and the Planning Commission,with the Conditions of Approval as entered into
the record. His motion also included modifying Condition #1.G to remove the reference to the
Central Weld County Water District,and replacing the word"Central"with"North"in Condition#1.H.
The motion was seconded by Commissioner Geile, and it carried unanimously. There being no
further discussion, the hearing was completed at 12:00 p.m.
