INTRODUCTION
The following report has been prepared pursuant to Section 31-12-108.5 of the Colorado
Revised Statutes (C.R.S.) and concerns the proposed annexation by Public Service
Company of Colorado (Owner) of certain real property known as the Xcel power line
right-of-way (Property) to the Town of Lochbuie (Town). The property proposed for
annexation comprises a total of 32.73 acres. That total includes portions of the North one-
half and the East one-half of Section 35, Township 1 North, Range 66 West of the Sixth
Principal Meridian, County of Weld, State of Colorado.
The southern and western boundary of the Property includes the Silver Peaks subdivision.
To the east, the Property is bounded by land owned by the Colorado State Board of Land
Commissioners. The northern boundary of the Property is the center line of Weld County
Road (WCR) 4.
CURRENT ZONING AND USES/PROPOSED USES/PROCESS
The Property is currently zoned A (Agriculture) in unincorporated Weld County and
current uses include a power line right-of-way. In connection with the annexation, Public
Service Company of Colorado and the Town of Lochbuie is processing a zoning request
for OS - Open Space zoning on the Property.
An Annexation Petition for the Property was submitted to the Town of Lochbuie on
September 6, 2005 and the Town of Lochbuie Board of Trustees approved a Resolution
of Substantial Compliance on September 7, 2005, acknowledging receipt of the petition
for annexation for the Property and finding that the petition was in substantial compliance
with relevant annexation statutes and setting a Public Hearing related to the application.
The date,time, and place for a Planning Commission meeting and for the Public Hearing
for the proposed Annexation are as follows:
• Wednesday, October 19, 2005, Town Board: Public Hearing on annexation, held
at 7:00 p.m. at the Lochbuie Town Hall, 703 WCR 37, Building B, Lochbuie,
Colorado.
• Tuesday, October 25, 2005, Planning Commission: Public Hearing on zoning, held
at 7:00 p.m. at the Lochbuie Town Hall, 703 WCR 37, Building B, Lochbuie,
Colorado.
• Wednesday,November 2, 2005, Town Board: Regular agenda item zoning the
Property OS-Open Space, held at 7:00 p.m. at the Lochbuie Town Hall, 703 WCR
37, Building B, Lochbuie, Colorado.
Advertising and notice,pursuant to the C.R.S., are being overseen by the Town of
Lochbuie. Copies of the annexation petition, the referenced resolution, and the published

notice of the hearing, were mailed to the Weld County Board of County Commissioners
and the County Attorney, among others, in accordance with C.R.S. §31-12-108.
ANNEXATION IMPACT REPORT REQUIREMENTS
This section is divided into the six elements that correspond to Section 31-12-108.5(1(a)
through(f), C.R.S. as follows:
A. REQUIRED MAPS - C.R.S. §31-12-108.5(1) (a)
Two maps are included as an exhibit to this report as required by Subparagraph (a) of
C.R.S. 31-12-108.5. The first map is a reduction from a series of maps and identifies the
Public Service Parcels as "Map No. 15". The second map is a reduction of"Map No. 15".
Exhibit A: Legal Description
Exhibit B: Annexation Map
This map shows the property boundaries in relation to current Town boundaries. The total
perimeter of the annexation is 16,252.63 feet and the perimeter of the annexation
contiguous to the Town is 8,126.02 feet. This annexation is contiguous to current
Lochbuie boundaries at a ratio of 1:2 and meets all provisions of Colorado law.
Exhibit C: Conceptual Utility Service Map (not provided)
Utilities:
No utility service is anticipated for the Property and no Conceptual Utility Service Map
has been provided. After the annexation is complete, the extension and provision of
municipal services across the Property would be implemented in accordance with the
terms of the annexation agreement and negotiated between the Annexor, Town and other
appropriate agencies.
Streets:
No streets are proposed in the area of this annexation. The Property does include the
southern 1/2 of Weld County Road 4 between WCR 35 and WCR 33 (Himalaya). Future
road easements may be granted by the Owner after negotiation with the Town and other
parties.
Water,Sewer, Electric Transmission and Ditches:
A major electric transmission line is located on the Property.No Town services (water&
sewer) are anticipated on the Property.
Exhibit D: Conceptual Plan Map (not provided)
No development is proposed within this annexation and no conceptual plan map has been
developed.

B. ANNEXATION AGREEMENT-C.R.S. §31-12-108.5 (1) (b)
A preannexation agreement is not required and has not been prepared. An annexation
agreement is anticipated to be part of the annexation of this Property. An annexation
agreement will be forwarded to the Weld County Attorney and other parties upon its
completion.
C. EXTENSION OF MUNICIPAL SERVICES-C.R.S. §31-12-108.5 (1) (c)
No extension of municipal services is anticipated within the area of this annexation.
D. FINANCING SERVICE EXTENSIONS-C.R.S. § 31-12-108.5 (1) (d)
No extension of municipal services into the Property is anticipated.Should service
extensions be contemplated in the future; extension of municipal services into the
Property will occur through one or more of the following mechanisms:
1. Development Fees,
2. Improvement Districts,
3. Developer Funds,
4. Metropolitan Districts,
5. Impact Fees, or
6. As otherwise agreed to between the Town and the owners of the Property.
E. EXISTING DISTRICTS IN THE AREA TO BE ANNEXED-
C.R.S. § 31-12-108.5 (1) (e)
The Weld County Treasurer's office records reflect that the Property is currently within
the boundaries of the following taxing authorities:

anticipated.
