RESOLUTION RE: APPROVE RESUBDIVISION, RS #1083, FOR LOT LINE ADJUSTMENT IN KNAUS SUBDIVISION - DANNY AND MARY LYNN / LESLIE AND CAROLYN TERRY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of March, 2005, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Danny and Mary Lynn7104 11 th Street Place, Greeley, Colorado 80634, and Leslie and Carolyn Terry,711011th Street Place,Greeley,Colorado 80634,for Resubdivision, RS#1083, for a Lot Line Adjustment in Knaus Subdivision, on the following described real estate, to-wit: Lots 18 and 19 of Knaus Subdivision, Second Filing; being part of the N1/2 N E1/4 of Section 8, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, co-applicant, Danny Lynn was present at said hearing, and WHEREAS,Section 24-5-30 of the Weld County Code provides standards for review of said Resubdivision, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24-5-30.B of the Weld County Code. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24-5-30.C.3 of the Weld County Code, including specifically: a. Section 24-5-30.C.3.a -- The lot line revision complies with the approved recorded final plat. The Resubdivision will move a lot line so that an existing outbuilding will no longer lie on the lot line and will meet the required setbacks. The Conditions of Approval ensure that the lots and existing building will meet all Weld County regulations. The applicants are required to submit a building permit and verify setbacks for the outbuilding prior to recording the plat. Easements are not affected by this application. b. Section 24-5-30.C.3.b --The application complies with the adopted rules, regulations,and ordinances currently in force and affecting the subdivision. Prior to Recording the Resubdivision Plat: A. The plat shall be labeled RS-1083, Resubdivision of Knaus Subdivision. B. The minimum offset requirements in the R-1 (Residential) Zone District is five (5) feet, or one (1) foot for each three (3) feet of building height, whichever is greater. The surveyor shall verify on the plat that all structures meet the minimum offset requirement prior to recording the plat. C. A building permit shall be submitted to the Weld County Department of Building Inspection for the post frame building constructed in 1998. The permit shall adhere to the following criteria: 1) A plan review is required for the building. Two complete sets of plans are required when applying for the permit. If original plans are not available, an on-site inspection can determine code compliance. 2) Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2003 International Residential Code, 2003 International Building Code, 2003 International Mechanical Code, 2003 International Plumbing Code,2003 International Fuel Gas Code, 2002 National Electrical Code, and Chapter 29 of the Weld County Code. 3) Fire resistance of walls and openings, construction requirements, maximum building height,and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by Chapter 23 of the Weld County Code. The lot line adjustment must allow the building to meet both building and zoning distance to the new lot line. 4) Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction, and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. Fences were put up and vegetation planted with those assumed lot lines in place.Lot nineteen was sold twice since the original Owner designated the lot line. We were told by Erbes Construction that no building Permit was required because the structure would not be attached to the house. Everything went fine until We received a map for a Gas Well re-location from the city of Greeley in September of 2004. While looking at the map we became concerned when it showed our building over the lot line. We then went to The County Offices who verified that the lot line did indeed cross a corner of our building. We immediately notified Les and Carolyn Terry(owners of lot nineteen)who immediately agreed that we Should apply to change stated lot line between our two properties to accommodate the structure. The lot line revision request as submitted should have no effect or change on existing adopted rules, regulations and ordinances currently in force affecting this subdivision.
