HomeMy WebLinkAbout20052779 9c RESOLUTION RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR USE BY SPECIAL REVIEW PERMIT#1459 - TONY DOWDY AND MIKE WHISTANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,by Resolution dated April 7,2004,the Board approved the application of Tony Dowdy and Mike Whistance, 13030 Weld County Road 20, Fort Lupton,Colorado 80621,for a Site Specific Development Plan and Use by Special Review Permit#1459 for a Business Permitted as a Use by Right in the Commercial Zone District(vehicle sales and detailing establishment) in the A (Agricultural) Zone District on the following described real estate, to wit: Lot 1 of Recorded Exemption#1039;being part of the NW1/4 of Section 20, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, on October 6, 2004, the Board of County Commissioner of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements(Private Road Maintenance), between the County of Weld,State of Colorado,by and through the Board of County Commissioners of Weld County,and Tony Dowdy and Mike Whistance with terms and conditions being as stated in said agreement, and accepted Cashiers Check #058743, drawn on the Union Colony Bank, in the amount of$5,000.00, and WHEREAS, staff from the Weld County Department of Planning Services has conducted a visual inspection and recommends release of said collateral. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Cashiers Check #058743, drawn on the Union Colony Bank, in the amount of$5,000.00 be, and hereby is, canceled and released. TO: Board of County Commissioners August 31, 2005 COLORADO FROM: Jacqueline Hatch cc SUBJECT: USR-1459, Mike Whistance and Tony Dowdy The applicants for USR-1459, Mike Whistance and Tony Dowdy have submitted the attached letter dated August 8, 2005. The applicant is requesting a full release of collateral for landscaping and screening (cash deposit). The Department of Planning Services conducted a site visit for compliance and finds that the landscaping and screening is in compliance with the recorded plat. The Use by Special Review USR-1459 was accepted by the Board of County Commissioners on April 7, 2004. Staff is recommending that the request for release of collateral for five thousand dollars ($5,000.00) be approved at this time since the landscaping and screening installed meets the Weld County Code and the recorded USR-1459 plat.
