Subject: Suggested Charter Amendments
The following is a list of Charter amendments which have been suggested to
the Council . This list was presented by the council President to the Board
in the October 10, 1983, Elected Officials Meeting. It is being forwarded
to you for your information.
1 . The Charter be amended to allow for an appointed sheriff rather than an
elected sheriff.
2. Amend the Charter to eliminate the 5% limitation.
3. Amend the Charter to delete the requirement of county employees to be
county residents.
4. Amend the Charter to allow for a county manager and either three or five
commissioners.
5. Decentralize commissioner duties. Allow the commissioners the choice of
exchanging or retaining assignments rather than automatically shifting
each year.
6. Terms of Office. Section 3-4-(3) : "No person shall serve more than two
full consecutive terms as County Commissioner." Amend the Charter to
clarify this statement.
7. Municipal conference. Section 3-8-4-(r) : "Establish a municipal conference
to be called by the Board of County Commissioners not less than three times
each year to which all municipal officials shall be invited and appropriate
agendas developed in order that mutual problems be considered. "
8. Write in candidates for County Council '. The council decided that this would
not be an issue requiring Charter amendment. As per Mary Ann Feuerstein, a
special write-in affidavit form will be designed to rectify this problem.
9. Salaries of commissioners.
10. Performance auditor. This issue being handled by the council .
11 . County newspaper. Complaint received that the county newspaper is determined
by bid, regardless of how widely read the publication is by county citizens.
12. Clarify Section 16-9--Conflict of Interest. Council decided clarification
is not needed.

13. Section 16-8-1 : "The members of all appointed boards and commissions shall
be appointed for three (3) year terms." Section 16-8-2: "No person shall
serve more than two consecutive terms on any one appointive board or commis-
sion." The Extension Service recommended that the two term limitation on
advisory boards be extended to three terms. The Director feels extension
board members are just beginning to function productively when their terms
expire.
14. Exact authority of county council . This is being handled by the council in
conjunction with Performance Auditor, #10.
15. Special tax districts.
16. Clarification of Section 4-2-(B)--The Division of Personnel . Problem
concerning sheriff's department.
17. Clarification of Section 3-14--Ordinances. This section of the Charter
pertains to introduction of ordinances, including emergency ordinances,
and their adoption.
18. Section 14-9-(5) : "All purchases of $2,000.00 or more shall be by written,
sealed bid and bids over $2,000.00 or more shall be followed by a ten day
period for consideration and investigation of the bids submitted to determine
comparisons of quality and price. The Commissioners shall accept the bid they
find to be most beneficial to the County. " It was suggested by Don Warden that
due to inflation, this $2,000.00 figure should be increased to $5,000.00 to
$10,000.00.
19. Secession from the county.
20. Section 13-7-(2) : "A vacancy shall exist when a Councilman dies, resigns, is
removed from office, moves from the district from which elected, is incapacitated,
recalled, or becomes a candidate for a county elected office or an employee of
the county. " Amend the Charter to eliminate the requirement of councilmen to
resign when becoming candidates for a county elected office.
21 . Supervision of the Environmental Health Services-Section 4-3-(A) (2) (b) :
"Department of Health Services - The Director of Public Health shall : Direct
supervision of the Environmental Health Services. " This was suggested to be
redundant and probably put into the Charter to limit the power of the then
Director of Environmental Health who had acted previously as Director of Public
Health when vacancies existed.
22. Term of commissioner coordinator extended.
23. Growth automatically granted. To be handled in conjunction with item #2,
elimination of the 5% limitation.
