(Ordinance 2002-11) 12) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. • Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size(twice t e State of Delaware) with more than 3,700 miles of state and County roads utside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be eqi ivalent to municipal services. Rural dwellers must, by necessity, be more self-suf iCient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigatiorh ditches, electrical power for pumps and center pivot operations, high speed traffic, Sand burs, puncture vines, territorial farm dogs, and livestock present real threats td children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 5. The subject property is located within the Town's Growth Management Area(GMA) and is depicted as High Density Estate Single Family Residential on the Town's Land Use Plan map. The Windsor Comprehensive Plan states that the High Density Estate Single Family Residential land use depiction and the corresponding Estate Residential (E-2) zoning district is intended to provide for "highly concentrated single-family residential subdivision development which utilizes public water and sewer services". Although the applications propose to create four parcels in addition to the subdivision exemption lot, at a total acreage of 165 acres, the proposal is still a fairly low density. However, Section 16-205 of the Town of Windsor Municipal Code requires that all lots within any subdivision proposing individual sewage disposal (septic) systems shall contain a minimum lot size of two and one-half(2%Z) acres. Therefore, in order to be consistent with Section 16-205, the size of Lots A, B and the subdivision exemption lot should be increased to be two and one- half(2%2) acres or greater. As previously stated, the subject property is located within the Town's GMA, and the Town of Windsor Comprehensive Plan states "The GMA is intended to define those specific areas within the planning area where it is most logical to extend urban services in the near term,that is, within the next five to ten years." Although the subject property is located within the GMA, due to the fact that only four new lots are proposed and the proposal is low density in nature, it is not recommended that annexation be required at this time. However, an agreement requiring future annexation is recommended as the subject property is located within the Town's GMA boundary and is adjacent to the Town's corporate limits along the Larimer and Weld Canal. It is probable that the site will become part of the Town in the future. The Town and County should make every attempt to avoid future enclaves of unincorporated county within the corporate limits of the Town as such enclaves lead to confusion with regard to emergency response,jurisdictional authority, potential maintenance problems and other general inefficiencies. The subject site is located adjacent to Weld County Road 78, which is classified as a Rural Collector on the Town's Comprehensive Plan Roadway Classifications map, therefore, 0 0 adequate right-of-way needs to be dedicated. Additionally, the Town of Windsor strives to minimize access from individual lots to collector roads due to potential traffic movement conflicts and safety concerns regarding driveway cuts on high-speed roads. Therefore, those lots that may feasibly utilize a shared access point to Weld County Road 78 should be required to do so in order to minimize the number of access points to this collector roadway. Finally,the Town of Windsor has adopted a Parks,Recreation,Trails and Open Lands Master Plan which contains a proposed trail network including a trail connection along the Larimer and Weld Canal. In order to maintain connectivity between the Town's trail system and surrounding jurisdictions, it is requested that a trail easement along the Larimer and Weld Canal across the subject property be dedicated in conjunction with any approval of the proposed development. Therefore, based upon the aforementioned information, the Town of Windsor Planning Commission recommends approval of this recorded exemption, subject to the following conditions: 1. The applicant shall dedicate additional right-of-way along the entire length of the north property boundary to bring the south half of WCR 78 up to the Town's Rural Collector standard of sixty feet (60') from centerline (one hundred twenty feet (120') total). 2. The applicant shall dedicate additional right-of-way along the entire length of the east property boundary to bring the west half of SH 257 up to the Colorado Department of Transportation's minimum right-of-way requirements. 3. The applicant shall reconfigure and increase the size of Lots A, B and the subdivision exemption lot to be two and one-half(2%z) acres or greater. 4. Lots A and B shall utilize a single shared access in order to minimize the number of access points to Weld County Road 78. 5. Lot C and the subdivision exemption lot shall utilize a single shared access in order to minimize the number of access points to Weld County Road 78. 6. The Town of Windsor Recreation Department requests that a thirty foot (30') wide trail easement be dedicated along the Larimer and Weld Canal through the subject property in conjunction with any approval of the proposed development. 7. Since the subject property is located primarily within the Town's Growth Management Area, it is probable that the site will become part of the Town in the future. Building permits shall be obtained prior to the construction of any building. Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and Section 29-3-20 B.13 do not need building permits, however a Certificate of Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 2. A plan review is required for each building except for buildings that meet the definition of Ag Exempt buildings. Plans may require the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2003 International Residential Code; 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements.
