All building permits for the fa pR under Amended Use by _ facility as outlined in the Special Review Permit were issued no. later than August of 2004 . 4 ) Development standard #2 on the recorded Amended (AMUSR- 851 ) states : "Approval Use by Special Review Permit of this plan may create a vested property right pursuant to Section 23-8- 10 of the Weld County Code. " Section 23-8- 10 states : purpose of this Article is to provide the procedures necessary to im lement t es. 'The provisions of Article 68cf Title �4 , �. R. R the Section 23 -8-20 further defines a Site Specific Development Ran as follows : "A Use by Special Review (including Mining and Major Facilities of a Public Utility or Public Agency), encng open g y)r Planned Unit 2005 - 36j0 a 11 It Lola o3z crik twt . (0 /21/05 b ROM , Development Final Plan , Subdivision Final Plat , resubdivision or minor subdivision application which has been submitted to the County and receives approval or conditional approval by the Board of County Commissioners creates vested rights pursuant to Article 68 of Title 24 , C R . S, No other type of land use application shall be considered a site specific development plan . " Finally , Section 23-8.30 of the Weld County Code states : "A property right which has been vested as provided for in this Article shall remain vested for a period of three (3) years _ This vesting period shall not be extended by any amendments to a site specific development plan unless expressly authorized by the Board of County Commissioners . " The vested property right for this use by special review (AMUSR-951 ) will expire on April 14 , 2007. 5) Alternative Homes for Youth under AMUSR-851 was in conformance with the relevant sections of the Weld County Code at the time of annexation to the City of Longmont. All conditions of approval for the Amended Use by Special Review Permit had been satisfied , Alternative Homes for Youth was recognized as a legal use and had not been considered terminated , abandoned nor sited for any code violation at the time of annexation . 6 ) Development Standard #22 states : "The Site Specific Development Plan and Amended Use by Special Review Permit #851 is for a Child Care Center (22 youths) in the A(Agricultural) Zone District, as indicated in the application materials on file and subject to the Development Standards stated hereon , " Section 212-280 of the Weld County Code states : "Any approved Special Review Permit shall be limited to the items shown on the Special Review plan map and governed by the Development Standards . Major changes from the approved Special Review Plan Map or Development Standards for the Special Review Permit shall require the review of an amendment to the permit by the Planning Commission and approval by the Board of CountyCommissioners before such changes from the plan map or development standards are permitted_ The Department of Planning Services is responsible for determining a major change exists. Any other changes shall be fled with the Department of Planning Services with the approved Special Review Permit," The Department of Planning Services , after staff review, could determine that a change in the number of residents in the facility could be changed administratively (without requiring review by the Planning Commission and approval by the Board of County Commissioners) if: 1 ) it was determined that the proposed increase was not a major change; 2) that the approved residential facilities could accommodate such an increase without being expanded or enlarged ; and , ( 3) that compliance with all applicable building and fire code requirements and state licensing requirements along with any other applicable local , state and federal requirements was demonstrated . Paragraph 6. third line from the end of the first paragraph I believe should have an "if' in it to read , "The Department of Planning Services is responsible for determining if a major change exists ."
