HomeMy WebLinkAbout20052214.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0500185 AGAINST JOSE FRANCO FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Jose Franco, VI #0500185, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of August, 2005, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Jose Franco was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. July 22, 2005 A lady came in and spoke with Building Official, Roger Vigil, regarding violation because of a language barrier. She said I could come out after 4 to speak with someone who spoke English. July 25, 2005 Property inspected, property remains in violation. Spoke with young boy. Explained violation to him and asked he pass it on to parents when they got home. SCREENED: Construction and maintenance of fences, earth berms or the use of landscaping materials or other materials used with the approval of the Department of Planning Services to lessen the noise, light, heat or visual impacts of the use on surrounding uses. I am a little disappointed that you don't remember these individuals. They are re-occurring violators and at the time of the building issues, the rest of the issues were not present. They have recently re-appeared (as they often do on this property) AND Comm Jerke was the one who called it in recently and asked that it be added to our case. If we have to start all the way over with a brand new violation we will. Let us know for sure so we can advise Comm Jerke.
