HomeMy WebLinkAbout20050829.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST MARY ANN PLONKA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Mary Ann Plonka, VI #0500284, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of November, 2005, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Mary Ann Plonka was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 8, 2006, to allow adequate time for the property owner to demolish the mobile home by a practice burn through the Fort Lupton Fire Department, bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. I have been making phone calls and deciding which way to go to get rid of the mobile home. I have decided to have it burned. I have spoken with Larry, the Fort Lupton Fire Marshall. They require that I have the mobile home checked for asbestos. I have made arrangements for someone to come and take the specimens on Tuesday, October 18, 2005. Dear Ms. Salzman, w I received your letter regarding the mobile home on my property a 16230 Highway 52, Fort Lupton, Co., 80621. The mobile home has never been set up or lived in. My daughter, Clarissa Cope, purchased it in 1999 but never lived in it. They now live in the home at 16224 Highway 52 after I gave her five acres. I would love to get rid of the tp^bile home, but have not had any success in doing so. I tried giving it away by putting an ad in the paper. I called about having it burned, but it needs to be inspected for asbestos and the fire department did not seem interested in burning it anyhow, and it was about a $1000 to have it taken to a dump. If you have any other suggestions on how to get rid of it, I would appreciate knowing them. Perhaps I can have it towed down to my daughter's and let my son-in-law start stripping it apart, if there is no objection to that. At one time I did have a permit for a mobile home, which I am enclosing a copy of, but I never followed through with it. When I reapplied for a mobile home permit in 2001, it was rejected and this mobile home was never used except as storage. I would very much like to have it gone, but as I am 70 years of age and retired on a fixed income, I cannot pay a big fee to have it hauled away. If you know of someplace that will take it, please let me know, or I will try and have my son-in-law disassemble it.
