Size of Parcel: 2.84 +/-acres Parcel Number 0807 15 000053 THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 23-2-260 of the Weld County Code. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-2-220 of the Weld County Code as follows: A. Section 23-2-220.A.1 -- The proposed use is consistent with Chapter 22 and any other applicable code provisions or ordinance in effect. Section 22-2-60 (A.Goal 4) states, "Conversion of agricultural land to nonurban residential, commercial and industrial uses will be accommodated when the subject site is in an area that can support such development. Such development shall attempt to be compatible with the region." Application materials indicate that the site can support the proposed use. Conditions of Approval and Development standards ensure that a reasonable attempt will be made to be compatible with the region. B. Section 23-2-220.A.2 -- The proposed use is consistent with the intent of the A (Agricultural) Zone District. Section 23-3-40.R of the Weld County Code provides for a business permitted as a use by right or accessory use in the Commercial Zone District as a Use by Special Review in the A(Agricultural)Zone District. C. Section 23-2-220.A.3 -- The uses which will be permitted will be compatible with the existing surrounding land uses. Single family homes surround the site on the north and west of the site. The Town of Windsor has a Planned Unit Development planned for the USR-1497 McNaney Page 2 east side of the site (Eastbrook). Agricultural uses are located to the south of the site. Conditions of Approval and Development Standards ensure that the storage and parking areas will be adequately screened from the adjacent properties. D. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of the Weld County Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The site lies within the three mile referral area for the Town of Windsor, the Town of Severance and the City of Greeley. The Town of Windsor indicated in their referrals received January 14, 2005 and May 20, 2005 that since the property has approximately fifty percent (50%)contiguity with the Town of Windsor municipal boundary the site should be annexed into the town prior to development and the County should recommend denial. The Town of Windsor also states that the applicant has provided the Town with a letter of intent stating that he will work the developer of the Eastbrook Subdivision to the east to provide a single access point of access for both properties. The Town of Windsor has also conducted a study of the Law Ditch floodway and has determined that the site in almost entirely within the floodway and the Town of Windsor's Engineering Department recommends that no new improvements be placed within the floodway area. The property is not located within the floodplain or floodway as delineated on Federal Emergency Management Agency FIRM Community Panel Map 080266 0605 D dated September 27, 1991 which the Board of County Commissioners has accepted. The Town of Windsor has submitted a Conditional Letter of Map Revision to the Federal Emergency Management Agency for acceptance. The referral also states that the property is not being site-planned in the spirit of the Windsor-Severance IGA Cooperative Planning Area and Development Plan which would result in the respective 'gateways' into both Windsor and Severance being severely compromised because of the design criteria and development standards not being incorporated into the design of the site. The City of Greeley in their referral dated December 30, 2004 has recommended conditions that they wish to see implemented should the proposal be approved. The City of Greeley in their referral dated April 26, 2005 state that they have reviewed the request and find no conflicts with their interests. Some of the City of Greeley's recommendations from the April 26, 2005 referral have been incorporated into the Development Standards and Conditions of Approval. No comments were received from the Town of Severance. E. Section 23-2-220.A.5 --The site does not lie within any Overlay Districts. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11) F. Section 23-2-220.A.6 -- The applicant has demonstrated a diligent effort to conserve prime agricultural land in the locational decision for the proposed use. The small size of the lot limit its agricultural value. G. Section 23-2-220.A.7 -- The Design Standards (Section 23-2-240, Weld County Code), Operation Standards (Section 23-2-250, Weld County Code), Conditions of Approval and Development Standards ensure that there are adequate provisions for the protection of health, safety, and welfare of the inhabitants of the neighborhood and County. r USR-1497 McNaney Page 3 This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. Prior to scheduling a Board of County Commissioners hearing: A. The applicant shall submit a detailed signage plan to the Weld County Department of Planning Services. (Department of Planning Services) B. The applicant shall obtain an access permit from the Colorado Department of Transportation. Additional requirements may be necessary to obtain or upgrade the permit. Evidence of approval shall be submitted to the Department of Planning Services. (Departments of Planning Services and Public Works) C. The applicant shall submit to the Department of Planning Services a Screening/Landscaping Plan for review and approval. The plan shall include the method of screening the outdoor storage of equipment or materials from adjacent properties and future rights-of-way as outlined in the Department of Planning Services landscaping referral dated December 21, 2004. (Department of Planning Services) D. The applicant shall provide written evidence of a sign off on the Screening/Landscaping Plan from the Colorado Department of Transportation. (Department of Planning Services) 2. Prior to recording the plat: A. The applicant shall provide the Department of Planning Services with Statement of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original parcel. (Department of Planning Services) B. The applicant shall provide the Department of Planning Services with a copy of a recorded deed for the property. (Department of Planning Services) C. West Greeley Soil Conservation District has provided information regarding the soils on the site. The applicant shall review the information and use it to positively manage on site soils. (Department of Planning Services) D. The applicant shall provide the Department of Planning Services with evidence of a commercial water tap on the property. (Department of Planning Services) E. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. The applicant shall submit written evidence to the Department of Planning Services that they have met the Department of Public Health and Environment requirements. (Department of Public Health and Environment) F. The septic system serving the existing residence shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into USR-1497 McNaney Page 4 compliance with current Regulations. The applicant shall submit written evidence to the Department of Planning Services that they have met the Department of Public Health and Environment requirements. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The applicant shall submit written evidence to the Department of Planning Services that they have met the Department of Public Health and Environment requirements. The plan shall include at a minimum, the following: 1. A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2. A list of the type and volume of chemicals expected to be stored on site. 3. The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). The applicant shall address the conditions (concerns) of the Weld County Department of Building Inspection as indicated in a referral response dated December 17, 2004. Written evidence of such shall be submitted to the Department of Planning Services. Evidence of such shall be submitted in writing to the Weld County Department of Planning Services. (Department of Planning Services) J. The applicant shall attempt to address the requirements (concerns) of the Windsor- Severance Fire Protection District, as stated in the referral response dated January 5, 2005 and April 26, 2005. The applicant shall attempt to address the requirements (concerns) of the Town of Windsor, as stated in the referral response dated January 20, 2005 and May 20, 2005. The applicant shall complete all proposed improvement including those regarding landscaping, screening, access improvements and parking lot requirements or enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all required materials. The parking area shall be delineated on the plat with at a minimum eighteen (18) parking spaces, one of which should meet the intent of the American's with Disabilities Act. (Department of Planning Services) 4. State Highway 392 requires 200 feet right-of-way at full build out. A total of 100 feet from the centerline of State Highway 392 shall be delineated right-of-way reservation for future expansion of State Highway 392. (Colorado Department of Transportation) 5. A future connection to the Eastbrook site shall be delineated on the plat. The direct access to State Highway 392 may someday be removed or restricted. (Colorado Department of Transportation) 6. The access road should be at least 24 feet in width to accommodate two-way traffic with adequate turning radiuses onto State Highway 392. (Department of Public Works) 7. The off-street parking /loading areas including the access drive shall be surfaced with gravel, asphalt, concrete or the equivalent and it shall be graded to prevent drainage problems. Each parking space should be equipped with wheel guards where needed to prevent vehicles from extending beyond the boundaries of this space and from coming into contact with other vehicles, walls, fences, sidewalks, or plantings. If exterior lighting is to be a part of this facility, all light standards shall be delineated in accordance with Section 23-3-250.6.6 of the Weld County Code. (Department of Planning Services) 11. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. (Department of Planning Services) 3. Upon completion of 1. and 2. above the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat and additional requirements shall be submitted within thirty (30) days from the date of the Board of County Commissioners resolution. Prior to the issuance of building permits: A. A stormwater discharge permit may be required for a development / redevelopment / construction site where a contiguous or non-contiguous land disturbance is grater than or equal to one acre in area. The applicant shall submit written evidence to the Department of Planning Services that they have met the Department of Public Health and Environment requirements. An individual sewage disposal system is required for the proposed modular office and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. The applicant shall submit written evidence to the Department of Building Inspection that they have met the Department of Public Health and Environment requirements. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. (Department of Planning Services) USR-1497 McNaney Page 7 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Clement McNaney III USR-1497 1. The Site Specific Development Plan and Special Use Permit is for a business permitted as a use by right or accessory use in the Commercial Zone District (Landscaping Materials Yard) in the A (Agricultural) Zone District, as indicated in the application materials on file and subject to the Development Standards stated hereon. (Department of Planning Services) 2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County Code. (Department of Planning Services) 3. Material piles shall not exceed the height of the opaque screening. (Department of Planning Services) 4. The hours of operation are 8:00 am to 5:00 pm Labor Day to Memorial Day and 7:00 am to 7:00 pm from Memorial Day to Labor Day. (Department of Planning Services) 5. There shall be no more than six (6) employees on site as indicated in the application materials. (Department of Planning Services) 6. The direct access to State Highway 392 may someday be removed or restricted. (Colorado Department of Transportation) 7. In the event any governmental authority exercises its right to expand State Highway 392 into the rights-of-way noted on this plat and such expansion requires the demolition, destruction, alteration, or taking of any improvements existing on the subject property as of the date this plat is recorded, the owner of the subject property shall be entitled to just compensation as determined in an eminent domain proceeding for such property and its improvements. This requirement shall be binding upon the parties regardless of the legal effect of whether the subject rights-of-way are "reserved" or"dedicated". 8. The applicant shall provide dust suppressant chemical (magnesium chloride or calcium chloride) on the haul road between the entrance and State Highway 392 no less than twice a year or as needed determined by the Public Works Department. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increase, diversions, concentration and/or unplanned ponding of storm run-off. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended)shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. (Department of Public Health and Environment) 15. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. (Department of Public Health and Environment) 16. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the site. (Department of Public Health and Environment) 17. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. (Department of Public Health and Environment) 18. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. (Department of Public Health and Environment) 20. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. (Department of Public Health and Environment) 22. The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. (Department of Public Health and Environment) 23. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan. Two complete sets of plans are required when applying for each permit. (Department of Building Inspection) 24. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National Electrical Code and Chapter 29 of the Weld County Code. (Department of Building Inspection) 25. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback requirements are measured to the farthest projection from the building. (Department of Building Inspection) 27. Effective January 1, 2003, Building Permits issued on the lot will be required to adhere to the fee structure of the Weld County Road Impact Program. The property owner or operator shall be responsible for complying with the Operation Standards of Section 23-2-250, Weld County Code. 33. Personnel from the Weld County Government shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County regulations. 34. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 35. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. Dear Applicant : Your application and related materials for the request described above are being processed. I have scheduled a meeting with the Weld County Planning Commission for June 7, 2005, at 1:30 p.m. This meeting will take place in the Hearing Room, Weld County Planning Department, 918 10`h Street, Greeley, Colorado. It is recommended that you and/or a representative be in attendance to answer any questions the Planning Commission members may have. It is the applicant's responsibility to comply with state statutes regarding notice to mineral estate owners. Colorado Revised Statute, C.R.S.24-65.5-103 (adopted as part of H.B.01-1088) requires notification of all mineral estate owners 30 days prior to any public hearing. The applicant shall provide the Weld County Planning Department with written certification indicating the above requirements have been met. It is the policy of Weld County to refer an application to any town or municipality lying within three miles of the property or if the property is located within the comprehensive planning area of a town or municipality. Therefore,our office has forwarded a copy of the submitted materials to the Greeley,Severance and Windsor Planning Commission for their review and comments. The current owner of the property is Clement McNaney. The current service provides a 3/4" meter, which should provide the proposed landscape business adequate service. If additional service is requested, approval from the Town of Windsor must be obtained and enhancements will be required of the existing mainline. The current Water Allocation Class is 1 (228,000 gallons)and the Current Plant Investment Class is 1 (228,000 gallons). Water tap/service is placed on the physical property, defined by a legal description. In case of a Recorded Exemption, the water tap shall only serve the parcel that the water tap is located on. The District guarantees treatment and delivery of water purchased. All water that is delivered with surcharge is subject to water availability. Water purchased through the District shall be 70% delivery of an Acre-Foot of water (228,000 gallons), if the allotment for Colorado-Big Thompson (CBT) project water, which is determined by the Northern Colorado Water Conservancy District, is 50% or greater. North Weld County Water District will restrict the delivery as necessary when the CBT allotment is less than 50%. A portion of the Raw Water Fee is utilized by the District to construct storage reservoirs. The Plant Investment Fee pays for the infrastructure required to deliver 1 AFU (228,000 gallons). This letter is to define the comments and concerns listed by referral agencies and how they have been addressed. Prior to the Plat being recorded, it was required the following items be provided: A. The owner of the property shall provide a Statement of Taxes showing no delinquent taxes. B. The property owner shall provide a copy of the Deed. C. Information provided by the West Greeley Soils Conservation District has been incorporated in the management of on-site soils. D. A water tap currently exists on the property provided by North Weld Water and the tap is adequate to provide water service for the house and the limited staff that will occupy the building. A domestic well on-site will provide the necessary water for dust suppression. The well has been adjudicated through the water court and has been used historically for consumption, livestock, and irrigation. There is no change in use of the water and the water is not being taken off-site, thus the decree shall be administered by the State as defined in the court case(XXX). E. Dust abatement on the site shall be performed through the use of water. The materials that are stored outside are not going to be easily blown around by the wind. It would be poor business practice to allow inventory to blow away. The roadway surfaces are to be crushed base course and with proper compaction,this shall be a fairly impervious surface with minimal dust control required. Hoses and/or water tanks shall be used to apply water as needed for dust control. F. JCB Engineering has been performing a septic monitoring program since the site has been occupied by several yard employees. The system has operated as intended. It is estimated that the daily water use by the employees is significantly less than when the house was occupied by residents. The restrooms are not going to be public restrooms, therefore, it is not anticipated that there will be any additional improvements required to the tank or the leach area. It is the intent of the operator to build a building in the future which at that time the building will connect to a nearby sanitary sewer line and abandon the existing septic system. At this time the restrooms shall be made public. G. The waste handling for the site shall be performed by Waste Management. The waste that will be generated by this business is paper products, office waste, and occasionally palettes. The site has a 6 yard dumpster that is screened and has weekly service. No chemicals shall be stored on site and no hazardous waste shall be created by products held in inventory. The concerns of the Weld County Building Department have been considered and the owners plan to operate, Annex to the Town of Windsor, and build a future retail building shall requires site plans and building permit approval. However should the owner wish to complete any building improvements or expansions, all appropriate permits shall be filed with the County. I. All comments and concerns from the City of Greeley that were defined in the referral letter dated December 30, 2004 have been addressed and/or acknowledged. All operations shall be in accordance with their requests. J. All comments and/or concerns from the Fire District have been addressed. All materials on the site are inert and non-flammable. As there is no increased fire danger and a plan to bring a future 12" waterline adjacent to the site, it is the request of the operator that any additional fire protection be added to the system when the site plan for the new building is reviewed and commented on by the Town of Windsor. K. The applicant has performed in their best effort to address the concems of the Town of Windsor, however, the majority of their concerns cannot be addressed until the property is annexed and goes through a site plan process. The USR meets all the requirements of the County and when the property annexes to the Town,the site will need to abide by the Town of Windsor Standards. It is at this time the additional concerns of the Town shall be addressed. L. The applicant and the operator are in the process of installing the required improvements. The applicant is holding on the final approval of the landscape plan and Plat. Any additional improvements agreement needs to be completed under the direction of the Weld County Planning Staff.
