The applicants are Chad and Angela Lease, and Michael Lafferty. The location of the property is south of and adjacent to Bruce Road, and east of and adjacent to Peak View in Weld County. The applicants are proposing to build a second home(2736 square feet)on the south half of their property, and to increase the number of livestock allowed on the north half of the lot to approximately 150 calves. The property has maintained residential and agricultural activities for the past 34 years, and these uses will continue under the proposed plan. The total acreage impacted by this proposal is 7.42. Pasture and grassland habitats often contain ground nesting birds, which can be disrupted by construction and earth-moving activities. The Colorado Division of Wildlife recommends that earth-moving activities be suspended between the months of April-August, unless no ground nests are found at the site after a thorough search. The introduction and spread of weeds is a concern at construction sites. We recommend that equipment and machinery used in this project be cleaned and inspected for weeds and seeds before entering the project area. The equipment should also be cleaned and re-inspected before leaving the site. Re-vegetation of disturbed areas with native plants will help control soil erosion and benefit wildlife. If black-tailed prairie dogs are found at the proposed residence site, they should be live relocated or humanely euthanized before earth-moving occurs. DATE: February 14, 2005 RE: Commercial Tap Requirements Commercial Taps We have received your request to change your current residential water tap (account #2997.01) to a commercial water tap. According to the District's Backflow and Cross-Connection Policy, all commercial and industrial users must have an approved backflow prevention device in place, and each device must be tested annually by a state certified backflow inspector. The results of the annual tests must be provided to the District. New commercial taps are normally installed inside the building with backflow assembly attached. Your •sidential tap is installed in a meter pit, which would not accommodate a testable backflow device. We generally find that such a set up requires the installation of an over-sized meter vault, in order to re-install the meter with a backflow device that can be accessed and tested. Another alternative may be to install the device in a barn or other building, provided that the device protects the District's water supply system from contaminants related to all of the livestock operations. Enclosed is a copy of the policies regarding backflow and cross-connections, and a list of certified backflow inspectors. You may want to contact these firms for further advice on compliance with requirements. The plans for your commercial meter set up must be submitted to the District for approval. This project falls primarily under the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: Scott's Acres is a rural subdivision located in the southwest corner of Weld County. Access to the property is adjacent to Bruce Road and Peak View. Both roads are identified on the Weld County Road Classification Plan (FHU) as local gravel subdivision roads, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of ETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured om the future right-of-way line. REQUIREMENTS: The applicant shall utilize the existing residential/agricultural access to the parcel. The parcel is being access from Peak View and from Bruce Road. The access drive shall be surfaced with gravel, asphalt, concrete, or the equivalent and shall be graded to prevent drainage problems. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. I am referring the storm water run-off to the Department of Environmental Health as it deals with livestock confinement operation (150). USR-1503 1. A separate building permit shall be obtained prior to the construction of any building. 2. A plan review is required for each building for which a building permit is required. Two complete sets of plans are required when applying for each permit. Building plans are required to bear the wet stamp of a Colorado registered architect or engineer. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2003 International Residential Code; 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. New structures will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. The applicant shall submit a manure management plan to the Weld County Department of Public Health and Environment for review and approval. The plan should describe how manure generated on site will be stored, managed, removed, land applied, etc. The plan should also describe the fate of any stormwater that may come into contact with manure. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to issuance of building permits: A The applicant shall submit evidence of a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, to satisfy requirements as delineated in 5 CCR-1002-61. Alternately, the applicant can provide evidence from CDPH&E that they are not subject to the CDPS requirements. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: /1':' An individual sewage disposal system is required for the proposed residence and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 2 The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to operation: 1`. The septic system serving the existing residence and restroom facilities for future employees shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 2. The facility shall maintain Best Management Practices as outlined in the Confined Animal Feeding Operation Regulations (5 CCR 1002-19). 2 3. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least weekly from the facility. 4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 6. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 7. The applicant shall operate in accordance with the approved "waste handling plan". 8. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 9. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 10.Adequate toilet and handwashing facilities shall be provided for employees. The employees shall be allowed to use the toilet facilities located in the residence. 11:Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 12.The facility shall utilize the existing public water supply. (Left Hand Water District) 13.All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 14.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. 3 (it 6 Weld County Referral ' February 7, 2005 C. The Building Permit is for a 2160 sq ft new single family dwelling, an attached garage, a porch and a patio. My records indicate that the Building Permit has not been issued. Furthermore, this violation was presented to the Board of County Commissioners, through the violation process on January 11, 2005. At that time the Board referred the case to the County Attorney's Office, but delayed legal action for 30 days to allow Mr. Lafferty adequate time to complete and submit this Use by Special Review application. This Use by Special Review application, if approved, will bring the property into compliance. If denied, the number of animal units shall be reduced to no more than 4 (four) per acre; otherwise, the Violation case will proceed accordingly in District Court. In addition, a site inspection was made to visit with the applicants and to view the property and surrounding area. r The applicants raise up to 150 dairy calves at a time,with ages ranging from one day old to 3-4 months old at which time they are sold at market. Pens are cleaned each time they bring in a new calf, with manure and waste being used on the owner's property and if additional acreage is needed, by some surrounding property owners. Mortalities are picked up by Weld County Bi- Products. During fly season the owner sprays pens and surrounding vegetation to control flies. This operation has been in existence for over 35 years with very little change. The owners live on the property and provide primary care. While there has been an increase in the number of houses that surround the property, most appear to be small acreages with many having horses or other livestock.
