YESTERDAY I HAD A CONVERSATION WITH BETHANY SALZMAN WITH THE PLANNING DEPARTMENT &WITHOUT A RESOLUTION. IMMEDIATELY FOLLOWING WAS ANOTHER LENGTHY CONVERSATION WITH MONICA MIKA CONCERNING THE SAME ISSUE. MONICA SAID THAT SHE WOULD REVIEW SAME AND SUGGESTED THAT I TAKE UP THE ISSUE WITH THE BOARD OF COMMISSIONERS AT THIS VERY TIME.MONICA DISCLOSED TO ME YESTERDAY THAT THEY DO PICK&CHOOSE THEIR CASES AS FUNDS WILL ALLOW. MY PROPERTIES ARE THE VERY CLEANEST IN THIS AREA WITH THE EXCEPTION OF MY IMMEDIATE CLEAN NEIGHBOR TO THE SOUTH. I WANT MY PROPERTIES IN COMPLIANCE,BUT THIS ERROR IS NOT MY FAULT AND A MAJOR PART OF THE FAULT IS WITH THE PLANNING DEPARTMENT. I have scheduled a meeting with the Board of County Commissioners on April 12, 2005, at 10:00 a.m., to consider the violations occurring on the property. The above mentioned property remains in violation of the following Section(s) of the Weld County Code: Chapter 23, Article Ill, Div 1 "A(Agricultural) Zone District" Section 23-3-20 "Uses allowed by right." Section 23-3-30 "Accessory uses." Section 23-3-30.F "MOBILE HOME subject to the additional requirements of Article IV, Division 3 of this Chapter." Chapter23, Article IV, Div 3 "Mobile Homes" Section 23-4-130 "No MOBILE HOME may be located or relocated in the County after August 25, 1981, except in accordance with this Division, including the issuance of any zoning permit which may be required by this Section. Each MOBILE HOME located or relocated in the County after said date must have a BUILDING permit for a MOBILE HOME issued pursuant to Chapter 29 of this Code. An application for any zoning or building permit for a MOBILE HOME required by this Division shall include the following:" To bring the property into compliance: The yellow single wide mobile home remains on the property. My records indicate that this mobile home (MP02721) was initially permitted as a "Principle Dwelling Unit" and was to be removed upon completion of the modular home(PR-9830011 /white—double wide), which is now permitted as the"Principle Dwelling Unit" for this lot. Mr.Stewart Page 2,VI-0400154 It is my understanding (based upon our meeting on March 22, 2005), you would like to use a portion of the mobile home as a storage unit. As we discussed, upon complete demolition of the mobile home, portions of the mobile home could be re-used as building materials, but the mobile home would be required to be completely demolished prior to re-utilizing the building materials. MOBILE HOME:A transportable STRUCTURE which as originally built exceeds either eight(8)feet in width or thirty-two (32)feet in length was originally built on a chassis and was originally designed to be used as a year-round DWELLING UNIT with or without a permanent foundation.A SINGLE-FAMILY DWELLING which is certified pursuant to the "National Manufactured Housing Construction and Safety Standards Act of 1974," 42 U.S.C. 5401 et seq., as amended, but does not meet all of the other provisions of the definition of MANUFACTURED HOME, is considered to be a MOBILE HOME. A MOBILE HOME or MANUFACTURED HOME shall not be converted to any USE other than a SINGLE-FAMILY DWELLING and shall not be allowed to deteriorate to the condition of a DERELICT MOBILE HOME. A MOBILE HOME or manufactured home, converted or in its original condition, shall not be used as an AGRICULTURALLY EXEMPT BUILDING or as a TEMPORARY STRUCTURE for storage. This hearing will take place in our Hearing Room, located at 918 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance to answer any questions the Board of County Commissioners might have about the violations. Please also be advised that I will be taking video and/or pictures from the road or adjacent properties the business day before or as soon as possible to the above mentioned Violation Hearing date. The Department of Planning Services' staff will be recommending that the Board of County Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that you were made aware of the nature of the violation including the action necessary to correct the violation, and that you were given sufficient time to remedy this violation. The overall bad condition and trashed out appearance of the property has attracted attention and made known the fact that the property is vacant.Trespassing has now become an issue. I try to maintain a vigilance and constantly close the wire fence type of gate and have also posted a NO Trespassing sign in English&Spanish. I have cleaned up and paid for most of the mess that your crew left on the right of way. I own &have fully furnished the properties on both sides of this subject property and feel as though this negligence is about to make me a further victim. I am aware that you may not wish to discuss issues with me,so I am requesting that you just pay attention to my comments and then act accordingly. The property is in a dilemma and having been ignored physically by both the previous owners and the foreclosure process.YES,I am interested in owning the property as I presently own the surrounding properties. According to your clean up crew the Haz-Mat crew was to arrive on 8-6-04 and that never happened. The garbage, trash, feces, urine, junk with blow flies have created quite a health problem.Their family pet died there with Parvo and the occupant had pneumonia about five times this year and went from a big person to a little over 100 lbs. (suspect of a well known contagious disease?) The roof on both the house and out buildings is in bad need of repair, the gutter system is in shambles, Storm doors damaged, house exterior damage, about 100 old tires to be removed and approximately two 30 yard roll off dumpsters and one of which should be double or triple bagged possibly contaminated trash. The interior is close to calling the house a scrape-off as a multitude of filth and maintenance problems exist. The interior domestic water line leak has caused the main bathroom, laundry space, back entrance way,and portion of the kitchen floor to deteriorate and needs to be replaced/repaired.It would take another page to mention all of the problems that exist and need attention at this property or 6 months to a year for a full time Person to fix properly and to code. Presently in this VERY immediate area there are eleven properties in foreclosure/resale process. This property should require special attention and in so doing some of the ordinary processes of resale may require special attention. I have been trained in hazardous material handling and disposal and I m prepared to give a release of liability and assume all responsibility of liability for this property. Selling this property to me at this time would not deprive any other person the possibility of owning a home as there is a glut of repo's surrounding the home.I am ready, willing&able to buy and NOW. The yellow mobile home in question has been on the property for over twenty years. I am familiar with the property as I use to live at 7169 Henry St.Lot 1,of block 57,this Lot in concern is lot 4. The white modular was placed on lot 4 in 1998 and at that time your inspector would not issue an occupancy certificate until the yellow mobile home was blocked and tied down as it was to be used for extra items storage.Picture enclosed as the structure in question is blocked&tied. The yellow mobile home use to be the primary residence at this location. March&April of 2003 i inquired of the Weld County Public Trustee,Clerk Recorder,Treasurer, Assessor and twice to the Department of Planning Services. This inquiry was to determine the facts so that I would not get any unnecessary surprises. i also hired an attorney and purchased a title insurance policy in an attempt to cover all the bases. Now according to you the information that I received from your Department was wrong. The problem may be that Monica as your Director allows some information to pigeon holed in a certain office and the rest of your department and the public is placed at risk. This in my opinion is reckless business. I would like to have a copy of the original complaint on this subject. Last summer my two college boys spent the entire summer cleaning the property of debris, fixing, painting, repairing and monitoring. We had two 30 yard roll-off dumpsters as well as many truck loads to the disposal dumps. The property has not had this much clean up since the 80's when 1 first became familiar with same. There was literally decades of accumulation that had been ignored. During 1998 I installed a home on Lot 2 and Lot 7 of this Same Block 57,at that time I applied and had in my possession &posted two complete permits and the permits from the Health Department.Contractors were in place and performing their duties respectfully when your then Inspector,David Sprague came on the scene and told the contractors that no permits existed(which was not so)then the contractors left and went to another job site.it was several months before the contractors returned and began working and during that time your department was on my case for not having the project completed. The night the Princess Diane died I was under the home digging cassions with spot lights and this was after my full day of work. Resultantly I later had a heart attack and I blame the Department of Planning at that time and now. The record keeping system in Weld county has been notorious and this problem that you think exists is in my opinion included. Unrelated to your department but the Health Department at another time lost all the information and details of a septic system on another property of mine near Greeley. The then director Jeff Stoll personally did the inspection and made amends. Now within a few hundred feet of old yellow there are five illegal mobile homes and believe me I do know what an illegal mobile home is. Four of these are not tied down and the fifth is occupied as a rental residence as the second home on the acre and both your department and Aristocrat Ranchette Water Project (ARWP) is aware but chicken. My boys are in college this summer and cannot do extra work for me as well as my office is in Englewood, and my livestock are at the Greeley location and I spend a full day every day,but none the less I look forward to having a conversation with you. Your description of the"tan derelict van"my boys cleaned and tuned it last summer and I since moved it to the property where it is titled, registered and licensed and it is Not a derelict vehicle, There are 98 derelict vehicles in this immediate area that are not behind ugly fences, these have flat tires, doors&hoods open,no license plates, missing windows, some cannibalized and settling down in the dirt they are really easy to spot. Before & after the purchase of the property at 15426 Coleman Avenue, Fort Lupton, Colorado I visited the Planning Department with the exact questions that you have raised & received much different answers than a violation of an illegal mobile home. Before I submit copies of my letters and other information I would like to know your interpretation of the problem. Did someone complain and if so who? Immediately after opening your letter yesterday afternoon I checked the neighborhood from Richard Street to Hart Street and Good Ave. to Mary Street and this approximately 1/8 mile radius I found (98) NINETY EIGHT absolute derelict vehicles , flat tires, unlicensed, canabalized, etc., & unscreened. Then I spoke with several of these folks and asked if [hey had received a similar complaint and the answer was "No". • Please, I would like to receive specific questions to the above mentioned questions and then I will present my information. The potential noncompliance with the Weld County Code is the presence of an illegal mobile home and a derelict vehicle. Please be advised that this case had formerly been presented to the Board of County Commissioners through the previous owners. Upon further research, it was found that your Warranty Deed was recorded 3 (three) days after the Violation Hearing. To allow you adequate time to remedy the violation, I closed out the old case so we could start over. Chapter 23, Article IV, Div 3 "Mobile Homes" Section 23-4-130 "No MOBILE HOME may be located or relocated in the County after August 25, 1981, except in accordance with this Division, including the issuance of any zoning permit which may be required by this Section. Each MOBILE HOME located or relocated in the County after said date must have a BUILDING permit for a MOBILE HOME issued pursuant to Chapter 29 of this Code. An application for any zoning or building permit for a MOBILE HOME required by this Division shall include the following:" To bring the property into compliance: The yellow single wide mobile home has since been "converted" to your proposed storage shed. For your convenience, I have included the definition of a Mobile Home (see below). My records indicate that this mobile home(MP02721)was initially permitted as a "Principle Dwelling Unit" and was to be removed upon completion of the modular home (PR-9830011 / white — double wide), which is now permitted as the "Principle Dwelling Unit"for this lot. i EXHIBIT Mr.Stewart Page 2,VI-0400154 During a visual inspection of the property conducted on April 11,2005, it was noted that mobile home has already been converted into the proposed storage unit. The application which was submitted on April 8, 2005 was for the demolition of the mobile home. Since the conversion of a mobile home is not an allowed use, there is not an appropriate building permit application for such activity;therefore, construction has occurred without a valid permit. As we discussed, upon complete demolition of the mobile home, portions of the mobile home could be re-used as building materials, but the mobile home would be required to be completely demolished prior to re-utilizing the building materials. MOBILE HOME:A transportable STRUCTURE which as originally built exceeds either eight(8)feet in width or thirty-two(32)feet in length was originally built on a chassis and was originally designed to be used as a year-round DWELLING UNIT with or without a permanent foundation.A SINGLE-FAMILY DWELLING which is certified pursuant to the "National Manufactured Housing Construction and Safety Standards Act of 1974,"42 U.S.C.
