Dear Tom:
The Department of Planning Services is in receipt of your undated letter concerning the Keenesburg Coal
Mine and the post mining use of the land. From the information gleaned from this letter,it is the determination
of this office, in consultation with the County Attorney's office, that the drilling of two gas wells on lands that
are in the process of reclamation per this permit in the Agricultural zone district are a use by right. In the
opinion of this office, this activity does not require an amendment to the existing land use permit, and the
activity is in compliance with the Weld County Code as delineated in Section 23-3-20.1,Oil and Gas Production
Facilities.
