Jerke, Chair Commissioner M. J. Geile, Pro-Tem Commissioner David E. Long Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated February 4, 2005, and duly published February 9, 2005, in the Fort Lupton Press,a public hearing was conducted to consider the request of Greeley Assembly of God Church for a Site Specific Development Plan and Use by Special Review Permit#1492 for a Church in the A (Agricultural)Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He gave a brief description of the location of the site,which is the former ConAgra Headquarters,and stated the applicant intends to use the three existing buildings on the site,in addition to constructing a new worship hall building. Mr.Gathman stated ten referral agencies reviewed this proposal and they have responded favorably or provided comments which have been addressed in the Conditions of Approval and Development Standards. He stated the site is within the Urban Growth Boundary for the City of Greeley, which has recommended design improvements to the site and building. Mr.Gathman stated originally a portion of the new building was to be built over an existing sewer easement; however, the applicant has modified the design of the building so that it does not encroach on the easement. He stated the City of Greeley has provided a letter indicating it has adequate capacity to provide sewer service to the proposed facility, and the applicant has an agreement with the North Weld County Water District, which will provide water by April 2005. He stated originally the use was described as a church and private school facility, and the Colorado Department of Transportation (CDOT) indicated that a Traffic Impact Study would be required if used as a school facility. Additionally,the Eaton School District indicated a private school would have significant impacts on its financial situation. Mr. Gathman clarified after discussions with the applicant,it was determined that only Sunday School classes will be provided in addition to the church activities, therefore, the concerns of CDOT and the Eaton School District have been addressed. Mr. Gathman displayed photos of the site, and stated there is an existing parking lot, buildings, and landscaping, therefore, an Improvements 2005-0409 PL1763 (n : P4 Pa,) n3 :ozzi-os— HEARING CERTIFICATION - GREELEY ASSEMBLY OF GOD CHURCH (USR #1492) PAGE 2 Agreement will not be required and Condition of Approval #1.C can be deleted. In response to Commissioner Geile, Mr. Gathman stated throughout the progression from a residential use to becoming the Monfort Headquarters,the property has remained zoned Agricultural. He stated the uses were allowed under Use by Special Review Permit#764, which has been amended three times, and Condition#1.G requires that permit be vacated. Responding further to Commissioner Geile, Mr. Gathman stated the applicant does own more land; however, it is not all included in the Use by Special Review boundary. He stated the site is currently serviced by City of Greeley sewer, the City of Greeley has indicated it can provide the needed capacity for the proposed use,and it is willing to serve the site without requiring a condition for annexation because there is not direct contiguity. He also corrected a prior comment by clarifying that a four-lot Recorded Exemption was approved on this property and the proposed Use by Special Review boundary encompasses the entire parcel owned by the applicant. Char Davis,Department of Public Health and Environment,stated she received a letter from the City of Greeley, dated December 16,2004, indicating the existing sanitary sewer system should have adequate capacity for existing users, in addition to the proposed worship center. Ms. Davis requested Development Standard#8 be deleted because the matter is addressed by Development Standard #10. Don Carroll,Department of Public Works,explained a Four-Lot Recorded Exemption was approved, and some of the existing homes were also split off through the Subdivision Exemption process,with the large parcel still being owned by Monfort. Mr.Carroll stated the existing parking lot is paved and well lit, and he has worked with the applicant to address circulation and stormwater drainage. In response to Commissioner Geile, Mr. Carroll indicated the location of the property which is still owned by Monfort. Responding to ChairJerke, Mr.Carroll stated in an effort to address high traffic loads, the main entrance has a right-turn lane, left/right turn slots,and a one-way entrance on the west side. Reverend Rigoberto Magana,and his associate,Angel Flores,represented the applicant. Reverend Magana stated they are in need of a larger facility, this site was compatible with their financial situation, and they intend to provide a service to the community. He stated they are working to complete all of the County requirements,and the water line should be completed by April 1,2005. In response to Chair Jerke, Reverend Magana stated the site will be serviced by the North Weld County Water District. Responding to Commissioner Geile, Mr. Flores stated the former home of the Monfort family will be renovated into a caretakers home and youth center,the east building will be renovated into classrooms for Sunday School, Royal Rangers and Missionettes,and the main building will be a temporary sanctuary until the new sanctuary facility is built,at which time the old one will be used as a fellowship hall and office space. He further stated their church is a sovereign church and the property is owned by the local group. In response to ChairJerke,Reverend Magana stated the application materials indicated a bible school,which was intended to be interpreted as Sunday School; they have no intentions of starting a private school. No public testimony was offered concerning this matter. In response to Chair Jerke, Reverend Magana stated they concur with the Conditions of Approval and Development Standards as proposed and modified. 2005-0409 PL1763 HEARING CERTIFICATION - GREELEY ASSEMBLY OF GOD CHURCH (USR #1492) PAGE 3 Commissioner Geile moved to approve the request of Greeley Assembly of God Church for a Site Specific Development Plan and Use by Special Review Permit #1492 for a Church in the A(Agricultural)Zone District,based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record,with the deletion of Condition of Approval#1.C and Development Standard#8. The motion was seconded by Commissioner Long, and it carried unanimously. There being no further discussion, the hearing was completed at 11:20 a.m. This Certification was approved on the 28th day of February 2005.
