RE: CHANGE OF ZONE, MZ #1056, FROM THE A(AGRICULTURAL) ZONE DISTRICT TO
THE E (ESTATE) ZONE DISTRICT FOR A FOUR (4) LOT MINOR SUBDIVISION -
FRANCISCO GRANADOS
A public hearing was conducted on January 12, 2005, at 10:00 a.m., with the following present:
Commissioner William H. Jerke, Chair

The following business was transacted:
I hereby certify that pursuant to a notice dated December 21, 2004, and duly published
December 29, 2004, in the Fort Lupton Press, a public hearing was conducted to consider the
request of Francisco Granados, for a Change of Zone, MZ#1056, from the A(Agricultural)Zone
District to the E (Estate)Zone District for a four(4)lot Minor Subdivision. Lee Morrison,Assistant
County Attorney,made this a matter of record. Michelle Martin, Department of Planning Services,
presented a brief summary of the proposal and entered the favorable recommendation of the
Planning Commission into the record as written. Ms. Martin gave a brief description of the location
of the site and surrounding land uses. She stated 16 referral agencies reviewed this proposal, 12
responded favorably or provided comments that have been addressed in the Conditions of Approval,
and staff received no comments from the Division of Wildlife, Oil and Gas Conservation
Commission, Platte Valley Fire Protection District,the Briscoe Irrigation Company,or surrounding
property owners. Responding to ChairJerke, Peter Schei, Department of Public Works,stated the
subject site is within 1.5 miles of Use by Special Review Permit#1491,which was considered by
the Board prior to this matter.
Pam Smith, Department of Public Health and Environment, stated the lots will be large, with the
smallest being almost 12 acres. She stated they will be serviced by the North Weld County Water
District,and she noted the percolation tests showed high ground water across the southern part of
the site. Ms. Smith stated the southern lot may require an engineered system since it is near a
wetlands area,and she added she did not require septic envelopes due to the large size of the lots.
In response to Chair Jerke, Ms. Smith stated the gross acreage is almost 61 acres, or a density of
one septic system per every 15 acres.
Mr. Schei noted Weld County Road 60.5 is currently stabilized by the Department of Public Works
in the 2004 Dust Management Program. He stated the applicant will be required to participate

proportionately for the cost of paving Weld County Road 60.5. In response to Chair Jerke,Mr.Schei
stated the interior road will access Weld County Road 60.5 and staff is satisfied that the design
meets current standards. He further stated the access will extend along the eastern property
boundary rather than through the center of the site, it is not along a section line,and paving will not
be required.
Clayton Harrison,Pickett Engineering, Inc.,represented the applicant and stated he is available to
answer questions. In response to Commissioner Geile, Mr. Harrison stated the oil and gas issues
with Kerr-McGee Rocky Mountain Corporation have been resolved with an agreement,and there are
no other companies that will be affected. Responding to Chair Jerke, Mr. Harrison stated the lots
will be large and each will have a site-specific engineered septic system to address any concerns
regarding shallow groundwater. He further stated the internal access will be built to County
standards, and they will extend a North Weld County Water District line down the internal drive to
service each of the lots. Responding to Commissioner Masden, Mr. Harrison stated although there
are some wetlands in the area, they will not be altered or removed.
No public testimony was offered concerning this matter. Responding to Chair Jerke, Mr. Harrison
stated he and the applicant have reviewed and concur with the Conditions of Approval as proposed.
Commissioner Masden moved to approve the request of Francisco Granados, for a Change of
Zone, MZ#1056,from the A(Agricultural)Zone District to the E (Estate)Zone District for a four(4)
lot Minor Subdivision, based on the recommendations of the Planning staff and the Planning
Commission,with the Conditions of Approval as entered into the record. The motion was seconded
by Commissioner Long,and it carried unanimously. There being no further discussion,the hearing
was completed at 3:15 p.m.
This Certification was approved on the 17th day of January 2005.
