RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A SALVAGE YARD EXPANSION - DAN BLAKE WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 5th day of September, 1984 , at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Dan Blake, 2559 Weld County Road 5 , Erie, Colorado 80516 , for a Use by Special Review for a salvage yard expansion on the following described real estate, to-wit: Part of the Nz, Section 20 , Township 1 North, Range 68 West of the 6th P .M. , Weld County, Colorado WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence pre- sented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance . 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Weld County Comprehensive Plan and with the intent of the Agricultural Zone District in that the use does not constitute an interference with agricultural activities and expansion of the salvage yard will occur on non irrigated land. b. The use is compatible with existing surrounding land uses and the Operation Standards as pre- sented by staff will ensure compatibility with the future development of the surrounding area. Historically, the salvage yard exists as a five acre legal nonconforming use. Section 70 of the Weld County Zoning Ordinance does regulate LHR 1024 840819 pLii'1q Page 2 RE: USR - BLAKE the existence of non-conforming uses. At pre- sent, there are no specific Operation Standards associated with the use requiring compatibility to future uses . Approval of this request would increase the acreage to eight acres . However, Operation Standards have been developed with this proposal mitigating the adverse impacts of the use and thereby making it compatible with future uses as projected by the Erie Comprehensive Plan. Surrounding land uses include a stock pile of tailings from an abandoned mine and a yard with scattered debris to the north , a drag strip to the east, the applicants own salvage yard to the east and north and dryland wheat farming. c. The subject site is located in a Geologic Hazard Overlay District. Staff Condition number three addresses this concern. d. Use by Special Review Operation and Design Stan- dards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a Use by Special Review for a salvage yard expansion on the here- inabove described parcel of land be, and hereby is, granted subject to the following conditions : 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The prescribed Use by Special Review activity shall not occur nor shall any building or electrical per- mits be issued on the subject property until the Use by Special Review plat has been delivered to the De- partment of Planning Services Office and the plat has been recorded in the office of the Weld County Clerk and Recorder. 3 . The applicant shall obtain approval of a Geologic Hazard Overlay District Development Permit from the Department of Planning Services. Martin OPERATION STANDARDS Dan Blake U.S.R. - 638:84:34 1. The uses permitted shall be an auto salvage yard as described in the application materials on file with the Department of Planning Services. 2. A wooden or woven chain-link fence shall be constructed around the salvage yard. The fence shall be constructed so the salvage yard is not visible from County Roads 5, 6 and 8. The fence shall be constructed within one hundred and twenty (120) days from the date of approval by the Board of County Commissioners. The fence shall be properly maintained and kept free of debris. In lieu of a wooden or woven chain link fence, the applicant shall be allowed to plant and adequately maintain Russian olive trees, a maximum of five (5) feet apart, along Weld County Road 5 and along the east 100 yards of the south boundary of the applicant's property. The trees shall be a minimum of three (3) feet in height when planted, and shall be planted within 120 days from the date of approval by the Board of County Commissioners. A barrier constructed of vans and/or buses shall be installed as a security measure behind the Russian olives. In the event a final plat subdivision application is submitted to the Weld County Department of Planning Services or the Erie Planning Commission within a quarter mile of the Use by Special Review subject site, the applicant shall plant Russian olive trees around the entire site at the same spacing previously required. Said planting shall be completed within 120 days from submittal of the final plat. 3. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 4. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 5. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 6. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 7. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. Morrison Planning Department Representative, James Mayerl The following business was transacted: I hereby certify that pursuant to a notice dated August 22, 1984, and duly published in the La Salle Leader on August 23, 1984, a public hearing was con- ducted to consider the application of Dan Blake for a Use by Special Review for a salvage yard expansion. Lee Morrison, Assistant County Attorney, read the application into the record, along with the request for Subdivision Exemp- tion #222 being considered at this time also. Jim Mayerl, Planning Department representative, read the favorable recommendation of the Planning Commission into the record and stated that condition #3 has been met. Dan Blake, the applicant, came forward to explain his request. Discussion was held about the proposed Operation Standards. Mr. Mayerl stated that Operation Standard #2 should refer to County Roads 5, 6 and 8, rather than County Roads 6, 7 and 8. Mr. Blake then spoke about the cost of wooden or chain-link fencing required by Operation Standard #2. He stated that he and his partner, Phil Bauer, cur- rently have this area fenced with a row of buses and vans. Mr. Blake requested that they be allowed to continue to use the existing 'van fence' and add a row of Russian olive trees for screening along the road. Mr. Blake submitted photos of his salvage yard and other salvage yards in this general area, along with a petition, said to contain 639 signatures, asking that the current fenc- ing be retained. Mr. Mayerl suggested that, if this is allowed, the Operation Standards could require Russian olive trees be added along the sides if sub- divisions are approved in this area. After considerable discussion, Commissioner Johnson moved to approve this Use by Special Review requested by Dan Blake, with Operation Standard #2 amended to allow the existing bus/van fencing to remain with Russian olive trees to be planted across the front and along the east 100 yards of the south boundary of the property and provide for the planting of additional Russian olives if a subdivision is proposed within a quarter mile of the subject site. Commissioner Brantner seconded the notion and it carried by a unanimous vote. Jim Mayerl, Planning Department representative, then read the application of Dan Blake for Subdivision Exemption #222 into the record. Mr. Blake questioned the recommended condition that a corrected legal description be submitted. After discussion,Comnissioner Johnson moved to approve Subdivision Exemption #222 for Dan Blake subject to the recommendations of the Planning staff. This letter report contains my findings of the existing conditions at the property. No subsurface investigation was done for this report. This report is not intended to imply that there is no possibility of subsidence at some time in the future, however, the inspection made at this time showed no signs of surface subsidence at arty location on the property. The legal description for the property that was inspected is as follows: That part of the Northeast Quarter (NE1/4) of Section 20, Township 1 North, Range 68 West of the 6th F. M. , Weld County Colorado more particularly described as follows: Beginning at the Southeast corner of said NE1/4 as the true point of beginning ; thence North 162 feet, thence West 450 feet, thence North 481 feet, thence west 225 feet, thence South 643 feet, thence East 675 feet to the true point of ben inning. This particular piece of property lies within a severe geologic hazard area as shown on a map prepared by the Colorado Geological Survey dated May 10, 1978. An abandoned mine lies directly to the North of this property. Both the air shaft and the main shaft have been partially filled in. This particular mine is named the Boulder Valley #1 on the geologic hazard map. It is also shown in Volume II of the Colorado Inactive Mine Reclamation Plan. This mine is not listed in this plan as having significant safety or environmental problems. Findings in this report for Weld County state that most of the old mine shafts had weak layers of overlaying rock and have already collapsed or have been filled. It does state that the possibility of future surface subsidence exists. 703 THIRD AVENUE • LONGMONT,CO•772-7755/449-4373 9 - A visual inspection of the entire property was made. The property is currently farmland and planted in wheat. There were no visible signs of any surface subsidence on any part of the subject property. The surrounding property to the West and North by the abandoned mine site also showed no signs of surface subsidence. This completes my inspection and report. If permanent structures are to be placed upon this property, additional review of the specific site will be necessary by a registered engineer. The reason for this position is that the expansion of existing industrial uses or the development of new industrial uses east of Erie' s corporate limits would not be compatible with the projected growth and land use patterns contained in the preliminary update of the land use element of the Erie Comprehensive Plan (copy attached) . At this preliminary stage of updating the comprehensive plan the Town officials are adamently opposed to industrial and commercial uses on the land surrounding the town boundaries except as noted on the attached map. I would like to stress , however, that refinements to the projected land use map will probably occur as the planning process continues. Until this updating project is completed the preliminary map should be. able to assist your department in making decisions that will assist the Town of Erie in its planning efforts . One half of the expansion area to the west is wasteland the other one half is dryland crop farming. The City of Erie is not visible from the site. The south, west and east boundary is formed by vans. Fixed improvements on the site consist of an office applicants travel trailer/home, and a second residence and a garage. Junked cars, vans and spare parts are neatly stored throughout the site. In addition to the vans serving as a wall/boundary on 3 sides of the site, cars are arranged in rows according to the country that they were made in. Explanation of proposed use. We have an auto salvage business (Blake' s Small Car Salvage) specializing in selling used parts for small cars. Scrap metal salvage is a minor part of our business. b. Explain need for use. We now have five acres, and it is used to maximum capacity (see picture 1). Also, we have the only salvage business north of metro Denver specializing in small cars. c. Explain types of existing uses on surrounding properties. Our northern boundary borders a junk yard owned by Paul Roads. To the west is approximately 160-feet of wasteland full of debris. In general, we sell scrap bodies once a year; however, with additional space we would be able to sell when the price is favorable rather than out of the necessity of space. On an average of once a year other kinds of recyclable materials such as batteries, radiators, aluminum, and copper are sold when we need the space and/or money; or when the prices are best. All trash is kept in trailers with high sideboards which is hauled to the landfill when full. p. Explain proposed landscaping plans and erosion control measures associated wth the proposed use. It is my plan to form a wall of vans and buses next to the road. I feel this fence is unique and appealing to the eye. It conceals the business from travelers on the road along with providing needed storage space. Also, it forms an effective break against wind erosion. Our efforts will comply with any standards set by Weld County regulations. q. Reclamation procedures to be employed upon cessation of the Use by Special Review activity. Not applicable. r. A time table showing the periods of time required for construction and start-up of the ropcsed use. The utilization of the annex will be in .our phases. Phase 1: All the untillable land will be picked free of debris and handraked. Phase 2 : The second phase will be the utilization of the southeast 162-feet by 450-feet (see plot plan map). First, we will construct a van combination-fence-windbreak-storage system along the roadside. The southern 162-feet will - 2 - be developed by placing pallets in rows thus making racks for used parts (see pictures). I estimate phase two will take more than one year for completion. Phase 3: Expansion to the west utilizing the former wasteland. This area will take an additional year to complete. Phase 4: Gradual expansion to the west as space is needed. Five years will be needed for completion. It is my intention to have the farmer continue tilling the land as close to the business as possible during all four phases. The advantages of this aperoach are twofold; one, he will have additional crops; two, we will have effective weed control. All crops planted will be harvested before we will expand on that land during all phases. 3. The following written materials and supporting documents shall be submitted as part of the application. a. A statement explaining how the proposal is consistent with the Weld County Comprehensive Plan. The first pricrity of the Weld County Comprehensive Plan is the protection of prime farm land. The land under consideration for special review is dryland (479) l.'icheli-Keota soil which is class IV or low priority. Furthermore, forty-three percent of the proposed special review land is not tillable at the prese-_t time (see photo). It is my desire to have the land cultivated as much as possible until full utilization is realized which will probably take five ye.:rs or more. Blake' s Small Car Salvage is located 1-1/2 miles east of Erie. Thus we are near a municipality. We are located two miles west of Interstate twenty-five. We are near a major traffic artery which is consistent with the comprehensive plan but not adjacent which the comprehensive plan discourages. I think the los.: of less than three acres of dryland wheat farmland yeilding an average of thirty-th_ree. bushels a year would be offset by the additional sales tax revenue, and the service that Blake's Small Car Salvage performs for the people of Weld County and the surrounding area. Furthermore, the expansion of Blake' s wouldn't increase the demand for c unty services or maintenance. I, the grandson of a former eastern '.'Teld County fanner, have great respect for the Weld County Comprehensive Plan, and I do whole- heartedly agree with its recommendations. b. A statement explaining how the proposal is consistent with the intent of the district in which the use is located. Erie is the nearest municipality and is located 1-1/2 miles from Blake' s Small Car Salvage. At the present time the city is adopting a new comprehensive plan and the only material available at this time is the mac on the next page. The city didn't take into account that we exist on WCR-5. However, it did reserve the intersection of WCR-5 and WCR-8 as a prospective commercial zone, including part of the now existing Blake' s Small Car Salvage. I believe the manner in which we operate our business is more commercially oriented than industrial, but that is open for debate. I hope the city of Erie Is sympathetic to cur needs. c. Also, the southern leg of the proposed annex is 162-feet wide which can't be efficiently farmed. d. A statement explaining there is adequate provision for the protection of the health, safety and welfare of the inhabitants of the nei b_rhood and the county. The proposed annex will be fenced on the roadside boundary. e. A statement explaining the uses permitted will be compatible with the existing surrounding land uses (including a description of existing land uses of all properties adjacent to the yroperty). Agriculture in the form of dryland wheat of the proposed annex with two exceptions. First, Blake' s Small Car Salvage is bordered on two sides by the proposed annex. Secondly, the northeast corner of the proposed annex touches a salvage yard owned by Paul Roads. The only other use besides agriculture in the immediate area is the landfill located a half mile to the south. f. A statement explaining the proposed use will be compatible with the future development of the surrounding area as permitted by the existing zone and future development as projected by the comprehensive plan of the county or the adopted master plans of affected municipalities. The future development of the surrounding area, I hope, will remain agriculture. However, the expansion of the landfill is an ever present possibility, and the city of Erie has plans to annex the entire area to I-25. After the annexation, Erie has zoned the intersection of :;C -5 and WCR-S con ercial. This proposed commercial area does overlap the present boundaries of Blake's Small Car Salvage. g. A statement explaining the use by special review area is not located in a flood plain, geologic hazard, and Weld County Airport overlay district area; or that the application complies with section fifty (50), overlai district regulations as outlined in the Weld County Boning Ordinance. The majority of the existing business and the proposed annex is located on the site of the State mine. According to a geologic hazard nap prepared by the Weld County Department of Planning Services the entire existing salvage business as well as the proposed annex is heavily undermined as is much of southwest ";held County. The site is located in a geologic hazard permit area. A permit for the proposed area is being submitted. A certified engineer's report is attached to this application on page nine. h. Proof that a water supply will be available which is adequate in terms of quantity, quality and dependability (e.g., a well permit or letter from a water district). Not applicable. i. A cony of the deed or legal instrument identifying the applicant(s) interest in the property under consideration. If an authorized agent signs the application for the fee owner(s), a letter granting power of attorney to the agent from the property owners shall be provided. A soil report of the site prepared by the Soil Conservation Service or by a soils engineer or scientist. In those instances when the soil report indicates the existence of moderate or severe soil limitations for the uses proposed, the applicant shall detail the methods to be employed to mitigate the limitations. Soil survey of Weld County, Colorado ( Southern Part ) by the United States Department of Agriculture Soil Conservation Service; page 50, call number 79--Weld loam, 1 to 3 percent slopes. This is a deep, well drained soil on smooth plains at elevations of 4,850 to 5,000 feet. It formed in eolian deposits. Included in mapping are small areas of soils that have a subsoil of loam and light clay loam. Also included are some leveled areas. Typically the surface layer of this meld soil is brown loam about 8 inches thick. The subsoil is broom and pale brown heavy clay loam and light clay about 20 inches thick. The substratum to a depth of 60 inches is silt loam. Permeability is slow. Available water capacity is high. The effective rooting depth is 60 inches or more. Se race runoff is slow, and the erosion hazard is low. In irrigated areas this soil is suited to all crops commonly grown in the area, including corn, sugarbeets, beans, alfalfa, small grain, and onions. An example of a suitable cropping system is 3 to 4 years of alfalfa followed by corn, corn for silage, sugarbeets, small grain, or beans. Land leveling, ditch lining, and installing pipelines are needed for proper water applications. All methods of irrigation are suitable, but furrow irrigation is the most common. Barnyard manure and commercial fertilizer are needed for top yields. This soil is well suited to winter wheat, barley, and sorghum if it is summer fallowed in alternate years. Minter wheat is the principal crop. The predicted average yield is 33 bushels per acre. If the crop is winterkilled, spring wheat can be seeded. Generally precipitation is too low for beneficial use of fertilizer. Stubble mulch farming, striperopping, and minimum tillage are needed to control soil blowing and water erosion. Terracing also may be needed te control water erosion. The potential native vegetation is dominated by blue grama. Several mid grasses, such as western wheatgrass and needleandthread, are also present. Potential production ranges from 1,600 pounds per acre in favorable years to 1,000 pounds in unfavorable years. As range condition deteriorates, the mid grasses decrease; blue grama, buffalograss, snakeweed, yucca, and fringed sage increase; and forage production drops. Undesirable weeds and annuals invade the site as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is desirable if the range is in poor condition. Sideoats grama, little bluestem, western wheatgrass, blue grama, pubescent wheatgrass, and crested wheatgrass are suitable for seeding. The grass selected should meet the seasonal requirements of livestock. It can be seeded into a clean, firm sorghum stubble, or it can be drilled into a firm prepared seedbed. Seeding early in spring has proven most successful. Windbreaks and environmental plantings are generally well. suited to this soil. Summer fallow a year before planting and continued cultivation for weed control are needed to insure establishment and survival of plantings. Trees that are best suited and have good survival are Rocky elountain juniper, eastern redcedar, ponderosa pine, Siberian elm, Russian-olive, and hackberry. The shrubs best suited are skunkbush sumac, lilac, Siberian peashrub, and American plum. - 6 - Openland wildlife, such as pheasant, mourning dove, and cottontail, are best suited to this soil. Wildlife habitat development, including tree and shrub plantings and grass plantings to serve as nesting areas, should be successful without irrigation during most years, under irrigation, good wildlife habitat can be established, benefit- ing many kinds of openiand wildlife. This soil has good potential for urban and recreational development. The chief limiting soil features for urban development are the shrink-swell potential of the subsoil as it wets and dries and the limited capacity of the soil to support a load.
