ZONE DISTRICT - JASON AND AMY KRILL
A public hearing was conducted on August 3, 2005, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated July 15,2005,and duly published July20,2005,in the
Fort Lupton Press,a public hearing was conducted to consider the request of Jason and Amy Krill
for a Site Specific Development Plan and Use by Special Review Permit #1509 for a Home
Business(fishing supplies, gear and giftware)and for one Single Family Dwelling Unit(other than
those permitted under Section 23-2-20.A of the Weld County Code), in the A(Agricultural)Zone
District. Lee Morrison,Assistant County Attorney, made this a matter of record. Chris Gathman,
Department of Planning Services, presented a brief summary of the proposal and entered the
favorable recommendation of the Planning Commission into the record as written. He gave a brief
description of the location of the site,and stated there is an existing residence and a garage which
the applicant wants to convert and use either for the fishing supplies business or possiblya second
residence on this parcel. Mr. Gathman explained the applicant recently completed a Recorded
Exemption on the property and created a separate lot on the east end where he intends to construct
a new home. He stated staff did receive a letter from Noble Energy requesting a surface use
agreement; however,once it was clarified that the size of the parcel is 2.5 acres and that there are
no oil and gas facilities on the site, Noble Energy indicated it no longer has concerns with the
proposal. Mr. Gathman stated the applicant will be using an existing well permit for the proposed
business or second residence,and the eastern Recorded Exemption lot will be serviced by the Left
Hand Water District.

Char Davis,Department of Public Health and Environment,stated there is an existing septic system
for the residence, and a domestic well will be used for the proposed business or second home to
be located in the converted garage. In response to ChairJerke, Mr.Gathman stated the existing well
was registered in 1981, and Ms. Davis clarified there will be two separate septic systems for the
structures.
Donald Carroll, Department of Public Works, stated the property is accessed from Weld County
Road 1,which is designated as an arterial roadway in this area. He stated this portion is maintained
by Boulder County, and there will be a joint access for Lots A and B of the Recorded Exemption,
which provides adequate site distance.
Jason Krill,applicant,stated he started the fishing supplies business approximately three years ago
and he was unaware that it required a separate permit; however,the business use was discovered
during the Recorded Exemption process and he was directed to apply for this permit. He stated he
will need to move his business in six to twelve months; however,he is also building a new home on
the other Recorded Exemption lot and does not want to deal with both projects at the same time.
Mr.Krill explained he does the distribution of the fishing supplies out of his house,and sells directly
to retailers. In response to Commissioner Vaad,Mr. Krill indicated the location of the existing home
and proposed home. He stated the existing access is on the south; however, it immediately turns
north and then follows northern property line to access the eastern lot. He stated there is a recorded
access easement which was required as part of the Recorded Exemption process.
No public testimonywas offered concerning this matter. In response to Chair Jerke,Mr. Krill stated
he has reviewed and concurs with the Conditions of Approval and Development Standards as
proposed.
Commissioner Vaad moved to approve the request of Jason and Amy Krill for a Site Specific
Development Plan and Use by Special Review Permit#1509 fora Home Business(fishing supplies,
gear and giftware) and for one Single Family Dwelling Unit (other than those permitted under
Section 23-2-20.A of the Weld County Code, in the A (Agricultural)Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Masden,and it carried unanimously. There being no further discussion,the hearing
was completed at 1:45 p.m.
