HomeMy WebLinkAbout20051840.tiff RESOLUTION RE: AUTHORIZE FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-105, C.R.S., AGAINST DUANE C. KIRKMEYER AND BARBARA JEAN KIRKMEYER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Weld County is in need of acquiring additional right-of-way for improvements to a portion of Weld County Road 13, in Section 31, Township 1 North, Range 67 West of the 6th P.M., Weld County, Colorado, including a temporary construction easement and permanent gas easements for relocation of a gas line owned and operated by Kerr-McGee Gathering, LLC, and WHEREAS, said right-of-way is described in the attached Exhibit "A" and shown in the attached Exhibit Map "A," and consists of 2.3776 acres, more or less, and WHEREAS,said temporary construction easement is described in the attached Exhibit"B" and shown in the attached Exhibit Map "B," and consists of 0.1377 acres, more or less, and WHEREAS,said permanent gas easements are described in the attached Exhibits"C"and "D" and shown in the attached Exhibit Maps "C" and "D," and consist respectively of 0.5944 and 0.0230 acres, more or less, and WHEREAS,in an appraisal with a date of valuation being December 4, 2004, prepared by W. West Foster and Sue Anne Foster, Certified Appraiser, Foster Valuation Company LLC, the value of the right-of-way to be acquired is established at$18,545.00, the value of the temporary construction easement is$107.00,and the value of the permanent gas easements is$2,318.00 and $180.00, respectively, and WHEREAS, said property for the right-of-way, temporary construction easement, and permanent gas easements are owned by Duane C. Kirkmeyer and Barbara Jean Kirkmeyer, and WHEREAS, negotiations with Duane C. Kirkmeyer and Barbara Jean Kirkmeyer have included several oral communications between Leon Seivers of the Weld County Public Works Department and Mr. Kirkmeyer, and between Mr. Seivers and Ms. Kirkmeyer, and several written communications,including the following:"Notice of Intent to Acquire Property and Authority to Obtain Appraisal,"delivered to Ms. Kirkmeyer,dated September 15,2004;"Offer Letter,"delivered to Mr. Kirkmeyer and Ms. Kirkmeyer, dated January 24, 2005; "Final Offer Letter," delivered to Mr. Kirkmeyer and Ms. Kirkmeyer,dated February 18,2005; a letter from Mr. Kirkmeyer to Mr.Seivers expressing various concerns and requests, dated February 27, 2005; and a response letter from Mr. Seivers to Ms. Kirkmeyer, dated March 24, 2005,with a copy delivered to Mr. Kirkmeyer, and WHEREAS,to date,the parties have been unable to reach an agreement for the purchase of said right-of-way, temporary construction easement, and permanent gas easements, and 2005-1840 e c e & (Cea-•z', coa w+, � Qv) EG0052 AUTHORIZE FILING OF PROCEEDINGS IN EMINENT DOMAIN AGAINST DUANE C. KIRKMEYER AND BARBARA JEAN KIRKMEYER PAGE 2 WHEREAS, the acquisition of said right-of-way, temporary construction easement, and permanent gas easement is necessary because of the pending improvements to be made to said stretch of Weld County Road 13 as to make the roadway safe for continued travel by motor vehicles and increasing traffic volume. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that the Weld CountyAttorney be,and hereby is,authorized to file a proceeding in eminent domain,pursuant to Section 38-1-105,C.R.S.,against Duane C. Kirkmeyer and Barbara Jean Kirkmeyer, in the Weld District Court to acquire the right-of-way described in the attached Exhibit"A" and shown in the attached Exhibit Map "A," the temporary construction easement is described in the attached Exhibit"B"and shown in the attached Exhibit Map"B,"and the permanent gas easements are described in the attached Exhibits"C"and"D"and shown in the attached Exhibit Maps "C" and "D." BE IT FURTHER RESOLVED by the Board that the acquisition of such right-of-way, temporary construction easement, and permanent gas easements is deemed necessary for the health, safety and welfare of the citizens of Weld County, Colorado.
