HomeMy WebLinkAbout20050236.tiff HEARING CERTIFICATION DOCKET NO. 2005-05 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1494 FOR A USE PERMITTED AS A USE BY RIGHT, AN ACCESSORY USE, OR A USE BY SPECIAL REVIEW IN THE INDUSTRIAL ZONE DISTRICTS(MACHINE AND WELDING SHOP) IN THE A (AGRICULTURAL) ZONE DISTRICT - ANTHONY AND DIANE GODDARD A public hearing was conducted on January 19, 2005, at 10:00 a.m., with the following present: Commissioner Robert D. Masden, Chair Commissioner William H. Jerke, Pro-Tem Commissioner M. J. Geile Commissioner David E. Long Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated December 30,2004,and duly published January 5, 2005, in the Fort Lupton Press,a public hearing was conducted to consider the request of Anthony and Diane Goddard for a Site Specific Development Plan and Use by Special Review Permit#1494 for a Use Permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Industrial Zone Districts (machine and welding shop) in the A (Agricultural) Zone District. Lee Morrison,Assistant County Attorney,made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He gave a brief description of the location of the site, which has an existing single family dwelling and an 1,800 square-foot shop/garage. He stated the applicant is proposing a 900-square-foot addition to the existing shop, and a new 5,000-square-foot building, which will be constructed if the business expands in the future,with a maximum of six employees. Mr.Gathman described the surrounding land uses,and stated 12 referral agencies reviewed this proposal, and nine responded favorably or provided comments that have been addressed in the Conditions of Approval and Development Standards. He indicated the locations of the structures and stated the site is well-screened from Weld County Road 2. Responding to Commissioner Masden and Chair Jerke,Mr. Gathman stated the proposed building will be located east of the existing building,and the existing building is at least 500 feet from Weld County Road 2. In response to Commissioner Geile, Mr.Gathman reiterated the existing shop is 1,800 square feet,with a 900-square-foot proposed addition,and the applicant is also proposing a 5,000-square-foot building for future use if the business expands. Responding to Chair Jerke, Mr. Gathman stated Planning Services staff typically advises applicants to be forward-thinking in an effort to prevent them from having to go through the amendment process. Char Davis, Department of Public Health and Environment, stated the property is serviced by the Mountain View Water User's Association, and the house and shop are connected to a septic system. She stated that system will need to be evaluated to ensure it is adequate for patrons and employees of the facility. In response to Chair Jerke, Ms. Davis stated the septic system is currently only permitted for the house;however,she did find information that indicates the shop is connected to the same system. She further stated the septic system is currently only permitted for two people, and staff will work with the applicant to ensure the current system is adequate for the additional use, or provide direction if a new system is needed. Donald Carroll, Department of Public Works,stated the site is accessed from Weld County Road 2, and this portion of the road is maintained by Adams County. He stated the average daily traffic count is 2,300 vehicles,and it is designated as an arterial road. Mr.Carroll stated there is adequate room to accommodate off-street parking for current and future uses, the drainage is satisfactory, the site is screened from the road, and there is adequate site distance in both directions. Mr. Gathman stated Condition of Approval #1.C requires an approved access or evidence of no concerns from Adams County. He stated the referral response from Adams County indicated no concerns and Mr. Carroll stated the access is adequate. Mr. Gathman suggested deleting Condition#1.C since it has been satisfied, and he clarified the access is along the east property boundary. Lauren Light, LANDPROfessionals, LLC,represented the applicants and stated the applicants live on the site. She stated the house is 600 square feet,and the 900-square-foot addition will be used for personal use. Ms. Light stated the site sits within a vacant lake so it is lower in elevation, and it is screened from Weld County Road 2 by existing trees. She stated the applicants will add a separate septic system if the future shop is built,they do have an access permit,dated 1999,from Adams County, and they have agreed to the terms of the Brighton Fire Protection District. She requested Condition #1.6 be modified since there will be no manure on the site. In response to Commissioner Masden, Ms. Light stated the primary use is the machine shop,and there will be no signage to advertise the business to the public. Anthony Goddard, applicant, stated aluminum and steel chips are created through the process; however, they are collected in barrels and sold to a recycling company. He stated there is some water-soluble coolants in the machines, and those waste materials are disposed of by Mesa Environmental. Mr. Goddard stated at full capacity the facility may generate 200 gallons of waste material in a year. He stated the 900-square-foot addition will be used for their personal garage,and if the business grows, he may consider constructing the 5,000-square-foot shop and install a separate septic system. He stated the current facility can only handle two employees, and under this permit they will be allowed a maximum of six employees. Responding to Commissioner Masden, Mr. Goddard stated the machines have a 20 to 25-gallon water tank,with approximately five to ten gallons of evaporative loss per week. He further stated he is aware of the grant from the County to the Mountain View Water User's Association because he is a Board member on that system,and the existing water tap will be adequate for the residential and shop uses,as well as the potential shop expansion. 2005-0236 PL1758 HEARING CERTIFICATION -ANTHONY AND DIANE GODDARD (USR #1494) PAGE 3 No public testimony was offered concerning this matter. In response to Chair Jerke, Mr. Goddard stated he has reviewed and concurs with the Conditions of Approval and Development Standards as proposed and modified. Commissioner Geile moved to approve the request of Anthony and Diane Goddard for a Site Specific Development Plan and Use by Special Review Permit#1494 for a Use Permitted as a Use by Right,an Accessory Use,or a Use by Special Review in the Industrial Zone District(machine and welding shop)in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record. His motion also included modifying Condition of Approval#1.6 to delete the words"and Manure,"and delete Condition#1.C. The motion was seconded by Commissioner Masden,and it carried unanimously. There being no further discussion,the hearing was completed at 11:35 a.m. This Certification was approved on the 24th day of January 2005.
