REYNOLDS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of October, 1981 at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of George S. Reynolds, P. O. Box 675, Longmont, Colorado 80501, for an aerial spraying/ strip, hanger and office, on the following described real estate, to-wit: Part of the North Half of Section 24, Township 3 North, Range 68 West, of the Sixth Principal Meridian, County of Weld, State of Colorado. WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the applicant and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. This request is in agreement with the Weld County Comprehensive Plan in that the proposed use would not appear to have any adverse impacts on the agricultural interests of the County or the environment. 2. With the design and controls proposed in the operation, and the development standards, there is little chance for adverse impacts on the surrounding uses or environment. 3. This proposed operation is in compliance with the provisions of Section 24 . 4.2 et. seq. of the Weld County Zoning Ordinance. This determination is based in part upon a review of the information submitted by the applicant, other relevant information regarding the request and the responses of the referral entities which have reviewed this request. The uses permitted on the hereon described parcel shall be a landing strip and facilities shown hereon to be used for an aerial crop spraying operations base and no more than two (2) private aircraft owned by the aerial crop spray operator and all other uses permitted by right in the Agricultural Zone District. 2. The permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. The appearance of the permit area shall be maintained in a neat and orderly condition. 3. All phases of the operation shall comply with all County, State and Federal Health Standards and Regulations pertaining to air quality, water quality, noise emission, sanitary disposal systems and chemical handling. 4. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 5. Construction and use of the landing strip shall conform to Federal Aviation Administration standards and/or regulations regarding air safety and any other applicable rules and regulations of governmental bodies having jurisdic- tion on the premises. 6. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards, as shown or stated above shall require approval of an amendment ,to the Board of County Commissioners before such changes from the plans , and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standars shall be filed in the office of the Department of Planning Services. 7. The property owner and/or operator of this operation shall be responsiblefor complying with all of the above stated Development Standards. Noncompliance with any of the above stated Development Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. TEH:do COMMENTS George S. Reynolds SUP - 471 1. The Longmont Soil Conservation Service comments regarding an erosion control plan are not addressed by the staff because the development is on an existing farm lot or in the middle of a cultivated field owned by the applicant. Erosion of the airstrip operations and the adjacent farming operation would only be detrimental to the flying operation and the land owner. 2. Numbers of based aircraft and numbers of trips are not addressed in the development standards. It is felt the location is far enough removed from conflicting uses as to not pose a problem. The physical site available for the use also limits the size of the operation. TEH:do REYNOLDS AIRSTRIP SUP Description of proposed Uses The Special Use Permit that is being sought for land described as the North half of Section 24, Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado is for uses that fit Weld County's definition of Agri- business uses. The proposed airstrip will be used to accomodate the relo- cation of a reputable aerial spraying business to an area more centrally located for its flying operations. The relocation will enable the business to provide better service to the farmers in that part of Weld County by reducing flight times and distances. The business that proposes to locate on land included in the SUP application is Aerial Sprayers Inc. Aerial Sprayers has been operating from a base at the Longmont Airport since 1960. During that time they have established a fine record in terms of customer satisfaction, flight saftey, and safe chemical handling. This can be readily verified by the Longmont Airport, the Colorado Department of Agriculture, and the company's customers, many of whom are Weld County farmers. The property included in the SUP application will be used to service, fuel , and load aircraft for aerial crop spraying purposes as well as to provide a strip for those aircraft to take off and land. Aerial Sprayers operates two planes, one is used in the application of herbicides during part of the growing season, the other is used to apply insecticides during other parts of the growing season. In addition, the owner of Aerial Sprayers intends to purchase a plane for his own personal use. The personal aircraft will also utilize the airstrip on occasions where the needs of the business will allow the owner to take time off. The maximum daily number of take offs and land- ings for Aerial Sprayers has been twelve. This occurs on days when the weather conditions have been right well into the day. Normally, the average number of spraying trips has been limited to between four and eight. The chemicals utilized by Aerial Sprayers will be delivered to the site by the chemical companies or common carriers in small quantities. The deliv- eries will occur three to four times weekly. The impact of such delivery traffic on the neighborhood and on the traffic flow in the area will be minimal . The chemicals are delivered primarily in the form of wettable powders, about 10% of the chemicals are liquid concentrates. Chemical mixing occurs in tanks mounted on trucks owned by Aerial Sprayers. Suf- - ficient water for this activity is available through an existing tap from the Little Thompson Valley Water District. Water requirements for the chemical mixing operation have averaged between 15,000 gallons and 20,000 gallons per month during the growing season. There are many individual households in Weld County that use more water during the summer months. v There is a very small amount of chemicals that are stored in liquid form by Aerial Sprayers. The trucks will load the aircraft in a small "staging area" located at the west end of the proposed airstrip. Again, the chemical handling record of Aerial Sprayers is excellent. Moreover, the ability to continue to handle such chemicals is strictly enforced by the Colorado Department of Agriculture. Should its permit be revoked by the Department, Aerial Sprayers would not be able to continue in business. Therefore, Aerial Sprayers is determined to maintain its saftey record and its lively hood. Aerial Sprayers employs two people in addition to Mr. And Mrs. Edmiston. One of the employees is the pilot for the spraying planes , the other is responsible for the chemical mixing and loading operations. The airstrip will be located along the south edge of an irrigation lateral that provides water for crops on the Reynolds property. The airstrip gen- erally runs east/west, starting at the west edge of the property and running approximately 3600 feet east into the center of the North East Quarter of Section 24. A minimum of 1500 feet will separate the airstrip from any County road. A greater distance will separate the strip from all homes located adjacent to the North half of Section 24. All aircraft maneuvering that occurs before achieving cruising altitude will take place in the air above the North half of Section 24. The airstrip will be 80 feet wide and will be accessable via a 50 foot wide taxiway that will run south from the hangar facility. Land for the airstrip and taxiway will be leased from Mr. Reynolds by Aerial Sprayers. The aircraft that will use the airstrip, two spraying planes and one per- sonal plane, will be stored in a building measuring 60 feet by 60 feet. This building will also provide office space for employees of Aerial Spray- ers. The hangar/office facility will be located on land that is subject to a separate Recorded Exemption application. However, that land is still owned by Mr. Reynolds and is therefore included under this SUP application. The use of the land as proposed in this application falls within the intent of the Weld County Comprehensive Plan in that it will further the interests of agriculture in Weld County. The land that is lost to crop production will be more than compensated for by virtue of the improved service capability of Aerial Sprayers Inc. Weld County farmers in 'the area will find that the spraying needs of their crop land can be met easier and faster with a local base for spraying operations. This can serve to increase crop yields when weeds and insects are controlled in time to prevent severe crop damage. Weld County zoning regulations provide for businesses that serve agriculture to locate in areas that are zoned A. This Special Use Permit application is fully within the intent of those provisions. Approval of the SUP request will promote and protect agrucultural interests in Weld County. Based on this study, the Federal Aviation Administration (FAA) has no objection provided all operations are conducted to the east of the east/west runway (i.e., all arrivals are from the east and all departures are to the west). We have your letter of intent to do this on file. This airspace determination should not be construed to mean FAA approval of the physical development involved in the proposal . It is only a determina- tion with respect to the safe and efficient use of airspace by such air- craft. In making this determination, the FAA has considered matters such as the effect the proposal would have on the existing or contemplated traffic patterns-of neighboring airports, the effects it would have on the existing airspace structure and projected programs of the FAA, and the effects that existing or proposed manmade objects (on file with the FAA) and natural objects within the affected area would have on the proposal . This deter- mination in no way preempts or waives any ordinances, laws, or regulations of any governmental body or agency. You should also be aware that the FAA cannot prevent the construction of a structure near the airport. The airport environs can only be protected through such means as local zoning ordinances or acquisition of property. It is up to you, as the owner, to provide for this protection. No evaluation of the environmental aspects of the proposal was made in reaching this determination. Therefore, this determination is not to be construed as approval of the proposal from an environmental standpoint under Public Law 91-190 (National Environmental Policy Act of 1969). When the airport becomes operational , please complete and return the enclosed FAA Form 5010-5, Facilities Information Request. If the airport does not become operational by December 31, 1982, this airspace determination will expire unless you request a time extension. .` 2 If in the future you wish to open the airport to public use, a new airspace determination will be required. Several months ago, for example, Ray permitted me to bring my entire eastern slope inspection staff, which included several new employees, to his facility so that we could examine his aircraft and his total operation. This type of "hands on" experience is invaluable in properly educating our staff and such cooperation is certainly not required by the State statute. The Front Range represents an exceptionally difficult environment in which to operate an aerial application business due to the rapid development of residential neighborhoods near, and sometimes adjacent to, agricultural fields in need of treatment. The profitable operation of these farms is dependent to a high degree on effective and affordable pest control. Ia. Colorado LhaL often means the aerial use of pesticides. At the same time, the special character of these areas is derived from the agricultural nature. Many people want the ambience pro- vided by an agricultural community but do not want to see planes applying pesticides, no matter how safe the products or applica- tion may be. Because of these factors, we have, of course, received complaints against Aerial Sprayers, Inc. I am happy to say that I can recall that none of these complaints were proven to be valid after inves- tigation. Ray operates his business with an understanding of the Mr. Tom Honn April 23, 1981 Page 2 needs and concerns of the entire community, not just his customers. This past December, a Jefferson County wheat grower complained that Aerial Sprayers had refused to treat one of his fields due to its close proximity to a newly developed condominium. That, I believe, is evidence of the caution and good judgement of Ray. I am happy to support Ray's efforts to obtain his own airstrip. I believe this move will benefit the company and the community.
