The following items should be added as conditions to be met prior to allowing the plat to
be recorded:
1. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.

The following requirements should be added into the permit as development standards:
1. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).

My name is Carole Gerkin
My address is 23035 WCR 22, Hudson Colorado
I have reviewed the packet of Preliminary Land Use Application for USR 1519 and find
the issues of concern I have as a resident within 500 feet of the property located at 22970
CR 22, Hudson, Colorado were addressed as requirements before the platting of the USR
1519.
The issues of concern being:
Water well being for residential use
Noise/pollution
Late hours of truck arrival
Heavy road traffic
Disposal of oils, anti freezes and fuel
I would request the hours of operation damply with the Colorado Noise Statute 25-12-
103, the hours being 7 am to 7 pm.
My final concern after reading this packet is, how, will the enforcement of the
requirements of the packet be done if the requested USR 1519 is approved?
Industrial zoning is placed in specific areas of communities for a number of reasons. One
of those reasons is for proper monitoring of activities. Industrial, commercial facilities
deal with toxic materials and different hazardous items. There is an industrial zone
within a 5 mile radius of their facility. Why would they not put there business within the
industrial zone? From a business stand point would they not want the market exposure to
expand and promote the business?
Mr. and Mrs. Van Oeveren have set precedence at this time of doing business without
proper zoning and permits,building buildings, moving in sheds and office space.
Starting with 1-4 truck and now having a required 1.1 parking spaces required. Stating
the hours of operation is from 6 am to 6 pm, when the engines are started at 5 am and the
final truck arrives at 11:20 pm., without concern for the safety and wellness of the
surrounding neighbors.

It is my concern that if this USR is approved that they will continue in the future with the
:2(n° practice of doing business in whatever manner they choose without regard for proper
procedures, meant for the betterment of all.
It is my request that the USR 1519 be denied and the Mr. and Mrs. Van Oeveren move
the trucking facility to an industrial zoned piece of land.
