This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: WCR 2 is designated on the Weld County Road Classification Plan (FHU) as an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Adams County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. Our most recent traffic count (ADT) reflects approximately 2,300 vehicles on WCR 2 between WCRs 17 and 19 ljacent to this location. REQUIREMENTS: Access: The applicant indicated on the plat drawing one access to the facility. Utilize this access point. Off-Street Parking: The off-street parking including the access drive is covered with recycled asphalt. The applicant is proposing up to six parking spaces. There is adequate circulation and area to accommodate the additional parking spaces. Storm Water Drainage: In the questionnaire, Item No. 8, it asks the applicant to explain how the storm water drainage will be handled on site. The applicant's answer was, "See attached drainage information." This document was not included in my packet. Please resubmit for review and approval. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1 . The septic system serving the house and shop shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. (existing use and estimated 6 full time employees) The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 2. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to issuance of building permits: 1. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- contiguous land disturbance is grater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 7. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 8. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 9. The facility shall utilize the existing public water supply. A building permit shall be obtained prior to the construction of any new building and change of use of the existing building and cargo container. 2. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. Provide a Code Analysis Data sheet provided by the Weld County -lanilding Department with each Building permit application. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. The building will probably be classified as F-1 (Manufacturing). The Cargo container will be classified as S-1 (Storage) The maximum amount of indoor and outdoor storage of nonflammable solids and nonflammable and non combustible liquids shall not exceed the amounts in Table 414.2.4 of the International Building Code. The building including the bathroom shall be accessible to persons with disabilities. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. General Comments: I. No water supplies for fire protection are currently available to this site. Therefore, approved onsite storage of adequate water supplies for firefighting operations shall be provided. In lieu of the requirement for the storage of two hours of water supply (approximately 240,000 gallons),the Fire District will accept an approved cistern—with a minimum capacity of 10,000 gallons, and equipped with an approved means for the refilling of and drafting there from—so as to provide adequate flows during the time needed to establish a tanker shuttle operation.The cistern shall be provided with the means to monitor the water level therein and shall initiate a local (onsite)alarm to indicate when the water level has fallen below a predetermined minimum level—as determined by the Fire District. It shall be the responsibility of the property owner to maintain the water level in the cistern at capacity. 2. The access/driveway,from Weld County Road 2 to the proposed parking lot, shall have a minimum width of 20 feet, unobstructed by parked vehicles,and a minimum unobstructed vertical clearance of 13 feet 6 inches. This access shall be constructed of an all weather surface capable of supporting Fire District apparatus—maximum weight of 72,000 pounds—and crowned or sloped to provide runoff.
