HomeMy WebLinkAbout20050537.tiff RESOLUTION RE: GRANT REQUEST FOR EXTENSION OF TIME TO SUBMIT A USE BY SPECIAL REVIEW PERMIT APPLICATION FOR WIND MONITORING TOWERS - GREENLIGHT ENERGY, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on July 21, 2004, the Board approved a request for early release of building permits for two towers which will be used temporarily to determine whether the site is feasible for the placement of a wind energy facility, conditional upon a written agreement being executed between Greenlight Energy, Inc., and the Board of County Commissioners, specifying the form of collateral and other terms, and WHEREAS, on August 4, 2004, the Board was presented with collateral, in the amount of $5,760.00,and an agreement concerning said wind monitoring towers between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Greenlight Energy, Inc., commencing July 12, 2004, with further terms and conditions being as stated in said agreement, and WHEREAS, the applicant has submitted a letter dated January 18, 2005, requesting the Board considera six-month extension of time for Building Permits BCN040327 and BCN04032,with the option to request an additional six month extension, to allow additional monitoring to further assess the potential for wind energy development, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of staff from the County Attorney's Office and the Weld County Department of Planning Services, and all of the exhibits and evidence presented in this matter and,having been fully informed,finds that this request shall be approved for the period of six months. Mas oun Attorney Glenn Vaad 2005-0537 PL0073 At' MEMORANDUM Wi`Pe TO: Weld County Board of County Commissioners COLORADO DATE: February 9, 2005 FROM: Sheriff-Lockman, Planner II SUBJECT: Six month extension for Greenlight Energy On July 21, 2004 the Weld County Commissioners approved a request from Greenlight Energy to allow an early release of building permits for two towers for the purpose of measuring prevailing winds on sites located in the SW4 of Section 31, Township 11 North, Range 59 West and the NW4 Section 3, Township 10 North, Range 58 West both in the 6th P.M., Weld County Colorado. The approval from Weld County was contingent upon Greenlight entering into a collateral agreement. The agreement required Greenlight to submit a USR application no later than January 12, 2005. Greenlight also submitted a Guarantee Deposit for $5,750. The agreement also gave Greenlight six (6) months to dismantle the towers. Mr. Kevin Davis, Director of Project Development with Greenlight Energy has submitted a letter requesting a six (6) month extension with an optional additional six (6) month extension. Planning Staff does not have concerns with the requested extension and if approved would recommend that the Board of County Commissioners require the collateral agreement to be updated. OOS� 0S 3 7 GREENLIGHT ENERGY January 18, 2005 Weld County Board of County Commissioners CIO Kim Ogle Weld County Planning Department 918 10th Street Greeley, CO 80631 RE: Building Permits BCN040327 and BCN040329 To the Board of County Commissioners: On behalf of Greenlight Energy, Inc. and at the suggestion of Kim Ogle, Weld County Planner, I am writing to request a six (6) month extension of Building Permits BCN040327 and BCN04032, with the option to request an additional six (6) month extension, if necessary. Greenlight Energy has erected meteorological towers to assess the potential for wind energy development in NE Weld County pursuant to these permits, and the data collection to date at both towers has indicated the existence of a strong wind resource. As a result, we feel it is imperative that an additional 6-12 months of monitoring take place in Weld County and therefore have requested these extensions. We continue to be excited about the potential of wind energy development in Weld County and thank you for your assistance and consideration.
