This violation was initiated due to the presence of too many"Household Pets"as defined in the Weld County Code. This case was presented at a Violation Hearing before the Board of County Commissioners on June 14, 2005. At that hearing the Board referred this case to the County Attorney's Office, but delayed legal action for 30 days. This Use by Special Review application, if approved,will bring the property into compliance. If denied,within 30 days of denial by the Board of County Commissioners, the number of household pets shall be reduced to no more than 4 (four) per legal lot; otherwise, the Violation case will proceed accordingly. The Fire District does not object to this request if the requirements of the District can be met. Based on my review, I have the following comments and stipulations: • The kennel building has existed for several years, has an existing fire sprinkler system and the Fire District has conducted annual fire inspections in the building. The Fire District has no objection to the use of this building for the purposes stated. • Water supply for fire protection may be required for a new dwelling. Water supply for fire protection is limited in this area. Water supply for fire protection is not required for a single- family residence that is not larger than 3,600 gross square feet and is placed on at least a 2.5 acre site. If a residence exceeds 3,600 gross square feet, or is placed on less than 2.5 acres, water supply for fire protection may apply. All other additional structures may require water supply for fire protection depending on the use of the new structure. Water supply is not required for private garages, barns, storage buildings and accessory buildings provided the building is not being used as living space and hazardous activity will not be occurring within the structure (i.e. woodworking, vehicle repair garage, spray painting with flammable or combustible liquids, etc.). This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: Weld County Road Classification Plan (FHU): (June 2002) WCR 34.75 and WCR 3 are local gravel roads, which require 60-foot right-of-way at full build out. The applicant shall verify the existing right-of-way and the documents creating the right-of-way. Weld County maintains both roads. If the right-of-way cannot be verified, it shall be dedicated. . do not have an ADT count for WCR 34.75, but I do have three additional counts in the area. WCR 3 between WCR 36 and WCR 38 is 132 to 149, WCR 3 between WCR 34 and WCR 36 is 128 to 148, and WCR 36 between WCR 5 and WCR 7 reflects 65 to 86 vehicles per day. All counts were taken in 2002 to 2005. I am familiar with the area and the site as I have done two previous uses for this site, a woodworking facility and a nursery prior to the proposed USR dog kennel facility. Clarification: If the applicant is proposed to build a new residential structure (modular) for the proposed USR and a future residence structure (stick build) on Lot A (split in 2000 through RE-2740), does the USR use allow two residential structures or does the applicant need to do a recorded exemption to split the new residence (stick build) from the proposed USR use? REQUIREMENTS: Access: The applicant is identifying the existing access approximately 1,200 feet ± east of WCR 3 from WCR 34.75. Utilize this access point for your proposed use. Off-Site Parking: The off-site parking lot including the access drive shall be surfaced with gravel, recycled asphalt, asphalt, concrete or the equivalent and shall be graded to prevent drainage problems. There is adequate site distance in both directions at the existing access point. EXHIBIT Kim Ogle, Planning Manager USR-1524, Carmen & Bart Beck August 12, 2005 Page 2 Storm Water Drainage: The Weld County Public Works Department's major concern on the storm water drainage is the existing and future dog runs fences and storm water retention area adjacent and next to neighboring property lines, The applicant is indicating that the storm water drainage will be directed by a swale to a retention pond in the kennel yard, which could be drained if full with a sump pump to a channel on the acreage. The swale and retention pond were graded in to keep water moving away from the structures. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. USR-1524 1. A building permit shall be obtained for a change of use of the existing building to a(Kennel)B occupancy and of the interior remodel. 2. A plan review is required for each building for which a building permit is required. Two complete sets of plans are required when applying for each permit. Include a floor plan of the proposed change. The existing building was built and approved on permit BC-970084. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2003 International Residential Code; 2003 International Building Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. The existing foam insulation will be required to be covered with an approved thermal barrier such as 0.5 gypsum board or an equivalent. An approved mono coat may also be sprayed on. 5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements, buildings are measured to the farthest projection from the building. Property lines shall be clearly identified and all property pins shall be staked prior to the first site inspection. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. The applicant shall provide written evidence to the Weld County Department of Public Health and Environment that the applicant has contacted the Colorado Department of Agriculture (CDA), Division of Animal Industry. A copy of a current license issued by CDA is acceptable. 3. The septic system SP-9800037 currently described as a wood working shop (proposed grooming area/office, etc) shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. EXHIBIT !P 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least weekly from the facility and disposed by a commercial hauler. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 5. The applicant shall operate in accordance with the approved "waste handling plan". 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 2 8. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 9. An individual sewage disposal system is required for the proposed custom home and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 10.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 11.The facility shall utilize the existing public water supply. The parcel has been utilized as agricultural land in the past and generally cannot be considered as critical habitat for any wildlife species. According to the Colorado Division of Wildlife Natural Diversity Information Source Map for Weld County,the area provides winter range for bald eagles, foraging areas for ducks and geese, winter range for geese, and is within the overall range for pheasant and mule deer and white-tailed deer. Coyote, fox,raccoon,skunk, songbirds, other raptors and herptofauna may also occur in this area. Upon disturbance of any areas, noxious weeds should be monitored and controlled. Homeowners should also be aware that planting trees, shrubs and other herbaceous plants may attract wildlife. Subsequently, ornamental landscaping may be damaged by wildlife. Homeowners will need to be responsible for damages incurred and will not be eligible for any reimbursement by the Colorado Division of Wildlife. Homeowners should be made aware of the presence of native predators. Pets should not be allowed to roam free. All domesticated livestock and farm animals should be secured with wildlife proof fencing appropriate for the species being raised. Pets as well may negatively interact with wildlife even on the home-sites and homeowners will be responsible for handling these problems. Homeowners should secure pet and animal feeds,trash containers, and charcoal/gas grills. Pets should have current shots. All control of nuisance wildlife will be the homeowner's responsibility with the possible exception of bears and mountain lions. Homeowners and potential homeowners will find additional recommendations and information in the following Colorado Division of Wildlife Brochures: "Living with Wildlife in Coyote Country","Living With Wildlife Canada Geese",and"Too Close for Comfort". Homeowners should also be aware that hunting may be an ongoing fall and winter activity on lands surrounding the development. Shooting will occur normally in the early mornings until dark on these areas. The sounds of gunfire may be somewhat distracting,yet should be noted to the potential owners and developer.
