RE: GRANT MOBILE HOME PERMIT, ZPMH #2457 - J. ROBERT MAY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County,Colorado,on the 8th day
of August, 2005, considered the request of J. Robert May, P.O. Box 585, Keenesburg, Colorado
80643, for a mobile home to be used as a Principal Dwelling, and
WHEREAS, said mobile home is to be occupied in the A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
N1/2 SW1/4 of Section 8, Township 1 North, Range
63 West of the 6th P.M., Weld County, Colorado
WHEREAS, a hearing before the Board was held on the 8th day of August, 2005, at which
time the Board deemed it advisable to continue said matter to the 15th day of August, 2005, at 9:00
a.m., and
WHEREAS, at said hearing on the 15th day of August, 2005, the Board of County
Commissioners, having heard all of the testimony,finds that said request should be granted subject
to the following conditions:
1. The applicant must obtain a building permit for a mobile home and must comply with
all installation standards of Chapter 29 of the Weld County Code applicable to mobile
homes prior to locating the mobile home on the property.
2. Prior to receiving a Certificate of Occupancy, the mobile home shall be connected
to an approved sewage system and a legal water supply.
3. The mobile home shall not be occupied until such time that the applicant has
complied with Conditions #1 and #2 stated above.
4. All proposed or existing structures will meet the minimum setback and offset
requirements for the Zone District in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured
from the future right-of-way line. No building or structure as defined and limited to
those occupancies listed as Groups A, B, E, F, H, I, M,and R in Section 302.1 of the
2003 International Building Code,shall be constructed within a 200-foot radius of any
tank battery or within a 150-foot radius of any wellhead. Any construction within a
200-foot radius of any tank battery,or 150-foot radius of any wellhead,shall require
a variance from the terms of the Section 23-3-10 of the Weld County Code.
5. Any future structures or uses on the site must obtain the appropriate zoning and
building permits.

6. Effective January 1, 2003, building permits issued on the proposed lots will be
required to adhere to the fee structure of the County-Wide Road Impact Program.
7. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(I.S.D.S.) Regulations.
8. Weld County Road 63 is designated on the Weld County Road Classification Plan
as a local gravel road, which requires 60 feet of right-of-way at full build out. This
road is maintained by Weld County.
9. Should noxious weeds exist on the property, or become established as a result of
the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds, pursuant to Section 15-1-10 of the Weld County
Code.
10. The applicant shall maintain compliance with Section 23-4-200 of the Weld County
Code at all times.
11. The applicant shall apply for a building permit for Principle Dwelling on, or prior to,
December 31, 2008. Upon receipt of such building permit application, the mobile
home will convert into a Temporary Use During Construction Mobile Home Permit
for use during the construction of the new home. If, however,the applicant does not
apply for such building permit on or prior to December 31, 2008, this Mobile Home
Permit ZMPH #2457 shall terminate as of that date.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of J. Robert May for permission to place a mobile home to be
used as a Principal Dwelling on the above described parcel of land, which was found to be in
compliance with Chapter 23, Article IV, Division 3, of the Weld County Code, be, and hereby is,
granted subject to the hereinabove listed conditions.

The Department of Planning Services' staff has reviewed this request and recommends that this
request be approved for the following reasons:
1. It is the opinion of the Department of Planning Services'staff that the applicant has shown compliance
with Section 23-4-200 of the Weld County Code, as follows:
a. Section 23-4-200.1-The proposed mobile home is compatible with the surrounding area, is
in harmony with the character of the neighborhood and its effects upon the immediate area.
The surrounding area is agricultural with some residential.
b. Section 23-4-200.2-The proposed mobile home is compatible with the Weld County
Comprehensive Plan.
The mobile home will be placed on 80 acres of Agricultural land and used as a principle
residence and will not interfere with agricultural uses.
c. Section 23-4-200.3-There is available water and sewage disposal facilities for the mobile
home.
The applicant has obtained both a well permit (262595) for water and septic permit (SP-
0500188)for sewage.
d. Section 23-4-200.4-The general health, safety and welfare of the inhabitants of the area and
the county will not be jeopardized or compromised by the location of the mobile home on this
site.

The Department of Planning Services' staff recommendation for approval is conditional upon the
following:
1. The applicant must obtain a building permit for a mobile home and must comply with all installation

Dear Applicant:
Your zoning permit for a mobile home application is being processed by our office. If it is determined that the
application meets the approval criteria of Chapter 23,Article IV, Division 3,of the Weld County Code,you will
be notified that the zoning permit is approved. If the staff determines that the application does not meet the
approval criteria, you will be notified and asked to appear before the Board of County Commissioners at a
public hearing. You will be informed of the hearing date at least a week prior to the hearing. The Board of
County Commissioners will then consider your application and make a final decision on the zoning permit for
the mobile home.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three
miles of the property in question or if the property under consideration is located within the comprehensive
planning area of a town or municipality. Therefore,our office has forwarded a copy of the submitted materials
to the Keenesburg Planning Commission for their review and comments. It is recommended that you and/or
a representative be in attendance at the Keenesburg Planning Commission meeting to answer any questions
the Commission members may have with respect to your application. Please call Keenesburg at 303-732-
4281, for further details regarding the date, time, and place of this meeting.

COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 63 is a local gravel road and requires a 60-foot right-of-way at full build out. The applicant shall verify the
existing right-of-way and the documents creating the right-of-way. If the right-of-way cannot be verified, it shall
be dedicated.
REQUIREMENTS:
The Weld County Public Works Department recommends approval/denial of this application.
The applicant shall utilize the existing residential access to this parcel.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water light from
seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2,unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-105.
4) Water from this well may be used for domestic purposes inside 1 single family dwelling(s),and the watering of the
owner's own large non-commercial domestic animals.
5) The pumping rate of this well shall not exceed 15 GPM.
6) The annual withdrawal of ground water from this well shall not exceed 3 acre-feet
7) The irrigated area shall not exceed 1 acre of lawn and garden.
8) Water from this well may be used for the watering of livestock on range and pasture.
9) Production is limited to the Laramie-Fox Hills aquifer which is located 580 feet below land surface and extends to a depth
of 835 feet. Plain casing must be installed and grouted to prevent the withdrawal of ground water from other aquifers and
the movement of ground water between aquifers.
10) The depth to the top of the Laramie-Fox Hills aquifer is approximate. To ensure the exclusion of poor quality water from
zones immediately above the aquifer,plain casing and grout shall extend through the lowermost coal and/or carbonaceous
shale that overlies the Laramie sand portion of the aquifer.
11) This well must be constructed within 300 feet of the location specified on this permit.
NOTE:The ability of this well to withdraw its authorized amount of water from this non-renewable aquifer may be less than
the 100 years upon which the amount of water In the aquifer is allocated,due to anticipated water level declines.
