Legal Description: Part of the S2 NE4, W2 SE4, E2 SE4 Section 25, Ti N, R67W, part of the

Location: 1/2 mile North of WCR 2; east/west of and adjacent to WCR 23.5; 1/4 mile

Size of Parcel: 421+/- acres
The applicant, Aggregate Industries, West Coast Region, Inc., has provided addendum
materials to their existing permit. This addendum has modified the as outlined in the attached
letter provided by the applicant's representative.

RE: Addendum to Application for Sand and Gravel Mining Operation, USR-1350
To Whom It May Concern:
Aggregate Industries-WCR, Inc. is submitting the following information and attached material as
an addendum to the pending application for a Mining Use by Special Review Permit application
(USR-1350). The application is for lands located in portions of Sections 25 and 36, Township 1
North, Range 67 West, and a portion of Section 30, Township 1 North, Range 66 West, of the 6th
P.M., all in Weld County Colorado. The operation will be known as Wattenberg Lakes.
In June 2001, a Weld County Use by Special Review permit application was submitted to the
Department of Planning Services for the Aggregate Industries' proposed Wattenberg Lakes
project. The application and related materials were considered complete and a hearing before the
Weld County Planning Commission was held October 16, 2001. In response to Planning
Commission concerns, Aggregate Industries requested that the hearing be continued. The
concerns were largely based upon referral comments the County had received from the U.S. Fish
and Wildlife Service (USFWS) and the U.S. Environmental Protection Agency (EPA) regarding
the Clean Water Act Section 404 permit application through the Army Corps of Engineers
(COE). Upon recommendation of Planning Staff, the Planning Commission voted unanimously
to continue the matter indefinitely to provide ample opportunity for the 404 permit related issues
to be resolved prior to the Planning Commission Hearing.
Aggregate Industries has diligently worked with the COE, USFWS, and the EPA since October
2001 to address their concerns. Through this process, the finally accepted extraction area has
been modified from the plan previously submitted with the pending USR application. However,
the modifications have not resulted in an expansion or enlargement of the originally proposed
extraction area, but rather a reduction of disturbance to jurisdictional wetlands and acreage to be
mined. The permit boundary has not changed from that which is indicated in the pending
USR-1350 application.
The enclosed Cover Sheet, Extraction Plan Map, and Division of Minerals and Geology permit
application, which received approval by the Mined Land Reclamation Board on November 17,

2004, reflect the modifications resulting from the 404 permit process. The following restates the
narrative segment of the application requirements as included in the pending application, with
modifications consistent with the Cover Sheet, Extraction Plan Map, and approved DMG permit
noted in bold type.
1. The completed application form along with the application fee is attached.
A new application form is not attached. Please note the following change of address for

2. A summary of the mining operation is presented below. For a detailed description of mining
and reclamation methods, please see Exhibits C, D, E, and F in the attached DMG
application materials.
a. Equipment used at this site will be consistent with that used at other sand and gravel
extraction operations in the County; however, there will not be any processing
equipment at this site. Operational equipment may include but not be limited to:

4 Loaders 4 Scrapers
1 Compactor 1 Water Truck
2 Generators 2 Portable Toilets
1 Employee/Storage Trailer 1 Fueling/Lubricating Facility
b. The maximum number of employees for the Wattenberg Lakes operation will be
four (4). Two 8-hour shifts will operate Monday through Saturday from approximately
6:00 AM to 10:00 PM.
c. The operation will be a dry pit.
d. All employee vehicles will access the property from Weld County Road (WCR) 23%z
approximately 0.75 miles north of WCR 2. Mining equipment will initially be brought
onto the site from WCR 23'/2, but will not enter and exit on a daily basis. Aggregate
materials will be removed using front-end loaders prior to being placed on a conveyor
system. The conveyor will transport the material over the South Platte River to be
processed at an existing DMG permitted mining site (DMG Permit Number M-89-120
and Weld County USR Permit Number USR-905) located immediately east of
Wattenberg Lakes. All aggregate materials will be processed at the adjoining site and
will be hauled from that site via WCR 6. Haul trucks will proceed east on WCR 6 to
Highway 85. The applicant has been working with the county engineering staff, public
works, and CDOT on improvements/upgrades to the Highway 85 intersection and that
portion of WCR 6 to be utilized by this operation

e. The Wattenberg Lakes special use permit boundary includes approximately 421 acres, of
which 245 acres will be mined. There will be three mining phases consisting of six
mining pits. Mining will begin in Phase I, as shown on Exhibit C of the DMG
application materials, and then move to Phases II and III.
f. The duration of the mining operation will be 8 to 12 years, depending on market
demand. It is expected that the operator will excavate approximately 30 to 40 acres per
year. This mining operation is intended to be a continuous operation with no significant
cessation in mining. Please see Exhibit D of the DMG application materials for a more
detailed discussion on the phasing of the project.
g. The thickness of the sand and gravel deposit varies from 2 to 41 feet. The overburden
and topsoil depth varies in thickness from 1 to 5 feet.
h. The proposed use of the reclaimed land is for water storage and wetland mitigation. A
full explanation of the reclamation process is described in Exhibit E and revisions to
Exhibit E of the DMG application materials.
i. The source of the technical advice for the water storage reservoir reclamation is
Applegate Group, Inc. The U.S. Army Corps of Engineers and Applegate Group, Inc.
-- and their subcontractors supplied information for the wetland mitigation.
3. A list of property owners within 500 feet of the Wattenberg Lakes permit boundary is
provided on the cover sheet. The list includes names, addresses, and the corresponding
parcel identification numbers assigned by the Weld County Assessors Office.
4. A list of the names and addresses of mineral owners and lessees of minerals on or under the
proposed mine site, as assigned by the Weld County Assessors Office, is attached along
with an Affidavit of Interest Owners—Minerals and/or Subsurface.
5. The following documents are enclosed:
a. Reclamation plans, as submitted to the State of Colorado Division of Minerals and
Geology (Exhibits E and F and revisions to Exhibits E and F).
b. Information for obtaining water supplies for the mining operation is included in the
DMG application materials, Exhibit G.
c. Cross sections of drainage structures for access to County roads and the interior
crossing of the Huett Ditch are shown on the attached Special Review Extraction Plan
Map.
d. The profile and typical cross section of interior haul roads is also included on the
Special Review Extraction Plan Map.

6. This Use by Special Review application for a mining operation is consistent with the Weld
County Comprehensive Plan. The Comprehensive plan allows for, and encourages, the
extraction of sand and gravel deposits. CM. Goal 2 states that the County should promote
the reasonable and orderly development of mineral resources. This application and
accompanying materials clearly demonstrates compliance with this goal.
All activities at the mine site will be guided by Mine Safety and Health Act (MSHA) and
Occupational Safety and Health Act (OSHA) regulations. These requirements, along with
the Weld County Comprehensive Plan, specifically Section 22-5-80, CM. Goal 4 which
states "minimize hazardous conditions related to mining activities and the mining site", will
minimize or eliminate the potential adverse impact of the operation on surrounding
properties. The application is proposing setbacks, noise controls, dust controls and general
site conditions that will help to comply with the goals and policies of the Comprehensive
Plan.
Reclamation activities will be concurrent with the mining operation to minimize the area of
disturbance on the site as much as possible. Impacts to wildlife habitat will be minimized
during the mining operation by maintaining setbacks from the South Platte River and
adjacent wetlands. In addition, the water storage reservoirs proposed for the final reclaimed
land use and the wetland mitigation within the South Platte River riparian zone could
promote additional wildlife use of the area.
7. The Wattenberg Lakes site is located in the A (Agricultural) Zone District and mining is
listed as a use allowed by special review under Section 23-3-40 of the Weld County Zoning
Ordinance.
8. The Wattenberg Lakes site has a limited amount of prime agricultural ground. A majority
of the property lies within the 100-year floodplain of the South Platte River, which limits the
agricultural productiveness of the site. The area within the floodplain has historically been
used as pastureland and for commercial tree farming. The extent of wetland areas also
limits agricultural production on the site.
9. The protection of the health, safety and welfare of the neighborhood and Weld County
inhabitants is being considered by the applicant. Possible fugitive dust emissions from the
site will be minimized by watering and re-vegetation activities. Noise levels will comply
with the requirements of the Weld County Health Department.
Employees will access the site from only one direction. There will not be any haul truck
traffic to or from the site. All material will be conveyored to an adjacent site for processing
and shipping.
Through measures taken by the Applicant, along with the Conditions of Approval and
Development Standards as established by the County through the permitting process, the
consideration of health, safety and welfare of Weld County citizens will be protected.

10. Surrounding land uses are primarily agricultural in nature. Existing sand and gravel
operations exist northeast, east, and south of the proposed operation. The unincorporated
town of Wattenberg is located immediately to the north and the City of Brighton lies to the
southeast. The South Platte River is located immediately east of the site. Compatibility
with surrounding land uses will be assured by setbacks, noise limitations, and Conditions of
Approval and Development Standards as established by the County.
11. Future development of the area is described as open space. This area is not within the
boundaries of the Brighton Comprehensive Plan. Sand and gravel mining, and the
reclamation plan that includes water storage and wetlands mitigation, is be consistent with
the Weld County Comprehensive Plan..
12. The subject site is not located in a geologic hazard area or airport overlay district.
However, the subject site does lie within a floodplain area. A flood hazard development
permit will be submitted to adhere to all FEMA rules and regulations as described in
Section 26 of the Weld County Zoning Ordinance.
13. Drinking water for the employees at the site will be bottled water.
14. Please see the Addendum to Exhibit N in the attached DMG application materials for the
legal instruments identifying the applicant's interest in the property under consideration. In
addition,a Right-to-Enter statement is attached for those portions of the property owned by
The City of Westminster.
15. A noise report is not included, but will be provided if deemed necessary by the Weld
County Planning Department
16. Other information determined necessary by the Board of County Commissioners or the
Depait,uent of Planning Services will be provided upon request.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 23.50 is designated on the Weld County Road Classification Plan (FHU) as a local gravel road, which
requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
WCR 2.75 and WCR 4.5 also border the proposed facility. These are designated as local gravel roads.
.raffic Counts: Our most current traffic count for WCR 23.50 is 234 vehicles taken in a 24 hour period dated
May 19, 2004. The Weld County Public Works Department is in the process of recounting the roads at this
location and should be able to provide a newer traffic count prior to the final Commissioner Hearings.
Improvements Agreement: The applicant has an existing Improvements Agreement for the Upgrade and
Maintenance of WCR 6 from the pit entrance east to U.S. Highway 85. The traffic study has identified
additional intersection improvements associated with heavy hauling that are required at the entrance and the
intersection. A new signal was installed with a free right hand turn lane.
In the original questionnaire 2b, it was stated that the maximum number of employees for the Wahenburg
Lakes operation will be 35 working two 8-hour shifts.
The new application form, same question (2b) stated that the maximum number of employees for the site is
now four, but the equipment usage is the same—approximately 18 units. The 2a verification of the employees
and equipment (truck traffic, etc.) is required.
REQUIREMENTS:
Storm Water Drainage: Ground and storm water will flow along trenches by gravity to the collection basins.
Prior to discharging into the South Platte River, the collected ground water and/or storm water will be evaluated
for the presence of contaminants. This portion of the permit would fall under the jurisdiction of the State of
Colorado, as it discharges into waters of the United States.

Clerk and Recorders' Office. Adjust the plat to coordinate with the right-of-way line and setback utilizing
1 the 60 feet of right-of-way that the County is claiming for WCR 23.50. The setback from County right-of-way
line needs to be adjusted prior to recording the plat and placing the slurry wall or mining operation.

area. The duration of the mining operation is estimated to be 8 to 12 years.
Based on the submitted information it appears that the Gravel Mining operation will cause
depletions to the South Platte River due to evaporative losses from exposed ground water and
operational losses. A Temporary Substitute Water Supply Plan (SWSP) and well permit has
been obtained for the Wattenburg Pit, Colorado Division of Minerals and Geology no. M-
01-008, however, any expansion of use beyond what is covered in SWSP will require a
new Substitute Water Supply Plan and well permit.
Gravel pit operators typically must first obtain approval from the Colorado Division of
Minerals and Geology(DMG) prior to mining. As part of that process the applicant will need to
address the potential concerns of State Engineer's Office as they relate to water rights.

District. The applicants have indicated that the reasons for this request is a time sensitive one,
as all County permits require approval prior to a depletion of the existing reserves at the County
Road 6 and State Highway 85 facility, which may occur in early spring, and two, the applicants
desire to have the construction of the new conveyor over the South Platte River and associated
requirements met for their 404 permit with the Army Corps of Engineers.
The Department of Planning Services is working with the applicant, applicant's representative
and referral agencies to process this addendum to the 2001 application in a timely fashion.
Should the Board of County Commissioners approve the Pre-Advertisement the hearing would
be scheduled for February 28, 2005. Availability on the docket has been tentatively confirmed
with the Clerk to the Board.

Ladies and Gentlemen:
The above-referenced matter is scheduled before the Weld County Planning Commission on February
15,2005. By this letter Aggregate Industries (AI) is requesting pre-advertisement for the subsequent
public hearing before the Board to accommodate setting of such hearing for February 23,2005.
Availability on the docket for this date has been confirmed with the Clerk to the Board. By working
closely with County staff,we expect to meet any recommended conditions of approval for USR-1350 by
the requested hearing date.
The subject use by special review is a sand and gravel mining operation. Material extracted under USA-
, 1350 will serve as a replacement source for aggregate currently being mined under USR-905 (Platte
Valley Operation),which is east of and adjacent to the proposed operation. It is anticipated that reserves
under USR-905 will be depleted by April, 2005, at which time material extracted from the USR-1350 site
would then be conveyed to existing processing facilities located on the USR-905 site.
There are major pre-mining activities associated with the proposed application that must occur prior to
April,making it critical to obtain all County approvals at the earliest possible date. Of primary
importance is the construction of a conveyor bridge over the South Platte River from the new site to the
processing facilities. Additionally,certain non-wetland areas must be excavated in order to prepare them
for replacement wetlands under the mitigation plan associated with the pending Army Corps of Engineers
(ACOE) 404 Clean Water Act permit.
AI submitted its application for USR-1350 nearly four(4)years ago in an effort to assure that all
permitting would be in place prior to depletion of reserves under USR-905. The matter was heard by the
Planning Commission on October 16,2001,at which time the case was continued indefinitely. The
continuance was proposed by AT to provide Federal agencies an opportunity to determine the status of
AI's application for the 404 permit, as issues related thereto were of particular concern to the Planning
Commission. Al has diligently worked with the ACOE,USFWS and the EPA since October,2001 to
address their concerns. The Corps is now in the process of writing the 404 permit, and we have been
assured that issuance is forthcoming.
Non-wetland disturbances related to preparatory activities have already been approved through other
permit processes, including a County approved Flood Hazard Development permit and the State

plan have been approved by the State Engineers Office. Applications for air emissions and water
discharges have been filed and permits will be approved before commencing activities associated with
those permits.
Having delayed further action on USR-1350 in an effort to provide the County with the greatest measure
of comfort in recommending approval of this permit has unfortunately placed the supply of aggregate
material to the existing processing plant at risk. It is critical that Al be able to proceed with preparations
for extraction activity under USR-1350 to assure an uninterrupted supply of material to fulfill customer
demand. As approval of USR-1350 by Weld County is the only matter remaining to enable AI to
commence activity, we respectfully request your favorable consideration for expediting this process. A

The following comments are made in response to the above noted site plan review.The Uniform
Fire Code, 1997 Edition, and other codes or standards referenced within the Fire Code, governs
these comments and resulting requirements.
General Comments:
I. Onsite storage and dispensing for re-fueling of equipment shall be accomplished through
the use of listed UL 2085 (con-vault)assembly.
2. Portable fire extinguishers shall be provided in accordance with Uniform Fire Code
Standard 10-1.
3. Two means of access shall be provided to the site. Access roads shall have an
unobstructed minimum of 24 feet in width, constructed of an all-weather surface capable
of supporting Fire District apparatus,have a minimum unobstructed vertical clearance of
13 feet 6 inches, have a maximum inside turning radius of 30 feet and a minimum outside
radius of 50 feet. Dead-end access roads in excess of 150 feet in length shall be provided
with an approved turn-around.
4. Addressing shall be provided at the primary entrance to the site. Addressing numerals
shall be(minimum) 5 inches in height,with a'/, inch stroke width, and mounted on a
contrasting background.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility including Sand and Gravel Mining. We have no objections to the
proposal, however, in reviewing the application we have observed that the applicant
proposes bottled water for employees and portable sanitation facilities as the facility's
sewage disposal. The facility plans to operate at this location for 8 to 12 years and
employ up to 4 individuals, thus we believe a permanent potable water source and an
Individual Sewage Disposal System (ISDS) is more appropriate to serve the sanitary
needs of the employees.
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
2. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
3. The Environmental Health Division of the Weld County Department of Public
Health & Environment (WCDPH&E) was unable to locate a septic permit for an
existing residence (Parcel # 146925000018). Any existing septic system which is
not currently permitted through the WCDPH&E will require an I.S.D.S. Evaluation
prior to the issuance of the required septic permit. In the event the system is
found to be inadequate, the system must be brought into compliance with current
I.S.D.S. regulations. If, in the future, the septic system is removed for mining the
applicant shall provide written evidence to WCDPH&E of the removal.
EXHIBIT
4. The applicant shall submit evidence of a Colorado Discharge Permit System
(CDPS) application from the Water Quality Control Division of the Colorado
Department of Health and Environment for any proposed discharge into State
Waterways. Alternately, the applicant can provide evidence from CDPH&E that
they are not subject to the CDPS requirements.
5. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.
6. The applicant shall provide current evidence that the facility has an adequate
water supply (i.e., well or community water system). If a well is utilized the
applicant shall provide evidence from the Division of Water Resources that the
well is appropriately permitted for the commercial use.
7. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed employee
trailer and shall be installed according to the Weld County Individual Sewage
Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
8. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
11.Portable toilets may be utilized on sites that are temporary locations of the
working face and portable processing equipment, etc. for up to six months at
each location.

12.The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
13.All fuel tanks, septic tanks, temporary buildings, and any other hazardous items
that might wash away during flooding shall be securely anchored and adequately
flood proofed to avoid creation of a health hazard.
14.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
15.The applicant shall obtain a stormwater discharge permit from the Colorado
Department of Public Health & Environment, Water Quality Control Division.
16.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

sand and gravel mining operation. As we discussed,the Wattenberg Lakes project is really an extension
of Aggregate Industries' current operation, known as Platte Valley and operating under AmUSR-905. As
material extracted from Wattenberg will be conveyed to the processing facilities at Platte Valley,we are
wrapping the Wattenberg activities into existing environmental permits and management systems
associated with Platte Valley. These include the following:
• Construction Permit No. 93WE448F for the Platte Valley site, issued by the Colorado
Department of Public Health and Environment,Air Pollution Control Division, dated March 30,
2001. A request for modification of this permit to incorporate the Wattenberg site was submitted
to the State on January 24, 2005. Copies of the current permit and the modification application
materials are enclosed.
• A dust abatement plan for this site will follow the particulate emissions control plan, including
control measures,as contained in the enclosed Construction Permit No. 93WE448F referenced
above and appearing on Page 5.
• Amendment No. 1 Certification to the Colorado Discharge Permit System Permit,Facility No.
COG-500250(CDMG Permit No. M-8-120,Platte Valley), issued by the Colorado Department of
Public Health and Environment,Water Quality Control Division, effective September 23,2003 to
September 30,2007. A request for additional discharge points associated with the Wattenberg
project was submitted to the State on January 13, 2005. Copies of the current authorization and

Aggregate Industries currently contracts with Waste Management Conservation Services for
disposal of empty containers and diesel contaminated soil from all of our facilities at their
NWELD, DADS and CSI landfills. Wattenberg Lakes will be included among the facilities
served by this contract. Safety Kleen provides service for solvent and waste oil at our facilities.
The local waste disposal company to be used for removal of all other wastes is: Waste
Management Disposal Service, State Hwy. 14 &WCR 25, Ault, CO; Phone: (970)686-2800.
• I have obtained clarification from operations personnel regarding the number of employees
projected for the Wattenberg operation,and the reference to an "employee/storage trailer"in the
application materials. The addendum to the application states four(4)employees. I have been
advised that this number is accurate with regard to workers on site who are Aggregate Industries
employees,and would include two to three equipment operators and a laborer. There are,
however contractors who would come on site for various other aspects of the operation. On a
regular basis,approximately every other week, contractor equipment would be brought in to
remove topsoil and overburden material and/or place material in reclamation areas. This would
raise the number of workers on-site to a total maximum of seven (7). Two shifts operating
Monday through Saturday, as proposed, is correct.
With regard to the"employee/storage trailer"stated in the application materials,I have been
advised that this will in fact be a trailer for storing tools and equipment. Employees working on
the Wattenberg site will continue to report through Platte Valley, and a trailer will not be set up
for employee use at Wattenberg.
Proposed permit conditions relating to the number of employees and the trailer were discussed
during the October 16, 2001 Planning Commission hearing. As a result of those discussions,
Item 3.I. requiring an individual sewage disposal system, and Item 3.J., addressing requirements
for an adequate water supply,well or community water system,was deleted by vote of the
Planning Commission. This decision was based upon a maximum of thirteen(13)workers on-
site covering two shifts, as noted by letter dated October 8, 2001,to Kim Ogle in the Weld
County Planning Department and reiterated by Aggregate Industries during the Planning
Commission hearing.
I would note that aspects Aggregate Industries' operations that have a potential to affect the environment
are managed through an Environmental Management System (EMS)comprised of various corporate and
site procedures, such as those enclosed and referenced above. Successful implementation of this system
has resulted in the Platte Valley site obtaining ISO 14001 certification,which is obtained through a third
party audit. Wattenberg Lakes is being wrapped into this overall plan, and the expanded operation will be
incorporated into the ISO certification. This is a proactive approach taken by Aggregate Industries,
whose U.S. operations are the first in the nation to obtain such status in the construction materials
industry.

THIRTY-DAY PRIOR NOTICE REQUIRED OF ALL NEW SOURCES
Even with a permit you cannot legally commence operation or conduct an activity for a new source until 30 days after you have notified the
Division of the start-up date(Section 25-7-114(4)(j)of the Colorado Air Pollution Prevention and Control Act). In most cases,a permit is
applied for and approved before the anticipated commencement date,so the 30 day prior notice causes no problems. Note.this form is not
a Relocation Notice for portable sources.
If,however you plan to commence your operation or activity as soon as you receive the permit,you should estimate the date you expect to
commence(assuming the permit is approved)and fill out and return this form at least thirty days prior to that date. This will avoid a 30-day

THE SOURCE TO WHICH THIS PERMIT APPLIES IS DESCRIBED AND LOCATED AS FOLLOWS:
Sand and gravel pit (known as Platte Valley Pit) operation located in Section 30, T1 N,
R66W, Weld County, Colorado.
THE SPECIFIC EQUIPMENT OR ACTIVITY SUBJECT TO THIS PERMIT INCLUDES THE FOLLOWING:
Material extraction, handling, stockpiling,hauling,and associated conveyors and transfer
points.
THIS PERMIT IS GRANTED SUBJECT TO ALL RULES AND REGULATIONS OF THE COLORADO AIR
QUALITY CONTROL COMMISSION AND THE COLORADO AIR POLLUTION PREVENTION AND
CONTROL ACT C.R.S.(25-7-101 et seq),TO THOSE GENERAL TERMS AND CONDITIONS INCLUDED
IN THIS DOCUMENT AND THE FOLLOWING SPECIFIC TERMS AND CONDITIONS:
1. Visible emissions from processing equipment and transfer points shall not exceed twenty percent
(20%)opacity during normal operation of the source. During periods of startup, process
modification, or adjustment of control equipment visible emissions shall not exceed 30% opacity
for more than six minutes in any sixty consecutive minutes. Opacity shall be measured by EPA
Method 9. (Reference: Regulation 1, Section II.A.1.&4.)
2. The particulate emission control measures listed on the attached page (as approved by the
Division) shall be applied to the particulate emission producing sources as required by Regulation
No. 1, Section III.D.1.b.
3. This source shall be limited to a maximum production rate as listed below and all other activities,
operational rates and numbers of equipment as stated in the application. Daily records of the
actual production rate shall be maintained by the applicant and made available to the Division for
inspection upon request. (Reference: Regulation 3, Part B,III.A.4)
Sand and gravel production shall not exceed 7,500 tons per day or 1,500,000 tons per year.

4. Fugitive particulate emissions shall not exceed the following limitations (as calculated in the
Division's preliminary analysis): (Reference: Regulation 3, Part B, Ill A4)
Particulate Matter: 54.36 tons per year
PM10 (Particulate Matter<10 m)' 12.12 tons per year.
Note: Compliance with these fugitive emission limits shall be demonstrated by not exceeding the
production limits in condition number 3 and by following the attached particulate emissions
control plan.
5. Emissions of air pollutants from transfer points shall not exceed the following limitations (as
calculated in the Division's preliminary analysis): (Reference: Reg. 3, Part B, III.A.4)
Particulate Matter 0.56 tons per year
PM10 (Particulate Matter<10 m) 0.27 tons per year.
6. This permit is for the activities specified above, any additional process equipment(i.e. crushers,
screens, etc.)to be located at this site must have a separate permit from the Division.
(Reference: Reg. 3, Part B, IV.E.)
7. A revised Air Pollutant Emission Notice (APEN)shall be filed: (Reference: Reg.3, Part A,II.C)
a. Annually whenever a significant increase in emissions occurs as follows:
For any criteria pollutant
For sources emitting less than 100 tons per year,a change in actual emissions of five tons
per year or more, above the level reported on the last APEN;or
For sources emitting 100 tons per year or more, a change in actual emissions of five
percent or 50 tons per year or more,whichever is less, above the level reported on the last
APEN submitted; or
A change in actual emissions, above the level reported on the last APEN submitted, of 50
pounds of lead.
For any non-criteria reportable pollutant:
If the emissions increase by 50%or five(5)tons per year,whichever is less,above the level
reported on the last APEN submitted to the Division.
b. Whenever there is a change in the owner or operator of any facility, process, or activity; or
c. Whenever new control equipment is installed, or whenever a different type of control
equipment replaces an existing type of control equipment; or
d. Whenever a permit limitation must be modified; or
e. No later than 30 days before the existing APEN expires.

8. All conveyors and transfer points will be subject to the New Source Performance Standards
requirements of Regulation number 6, Subpart OOO whenever there is primary crushing capacity
greater than 150 tons per hour(portable equipment) or 25 tons per hour(fixed equipment)at this
location as follows:
a. Visible emissions from conveyors and transfer points shall not exceed 10% opacity.
In addition, the following requirements of Regulation No. 6, Part A, Subpart A, General Provisions,
apply.
a. No article, machine, equipment or process shall be used to conceal an emission which
would otherwise constitute a violation of an applicable standard. Such concealment
Includes, but is not limited to, the use of gaseous diluents to achieve compliance with an
opacity standard or with a standard which is based on the concentration of a pollutant in
the gases discharged to the atmosphere. (§60.12)
b. Written notification of construction and initial startup dates shall be submitted to the
Division as required under§ 60.7.
c. Records of startups, shutdowns, and malfunctions shall be maintained, as required under
§60.7:
d. Compliance with opacity standards shall be demonstrated according to§60.11.
e. At all times, including periods of start-up, shutdown, and malfunction,the facility and
control equipment shall, to the extent practicable, be maintained and operated in a
manner consistent with good air pollution control practices for minimizing emissions.
Determination of whether or not acceptable operating and maintenance procedures are
being used will be based on information available to the Division, which may include, but
is not limited to, monitoring results, opacity observations, review of operating and
maintenance procedures, and inspection of the source. (Reference: Regulation 6, Part A.
General Provisions from 40CFR60.11)
9. All previous versions of this permit are canceled upon issuance of this permit.

1. The production or raw material processing limits and emission limits contained in this permit are based
on the production/processing rates requested in the permit application. These limits may be revised
upon request of the permittee providing there is no exceedance of any specific emission control
regulation or any ambient air quality standard. A revised air pollution emission notice (APEN) and
application form must be submitted with a request for a permit revision.
2. This source is subject to the Common Provisions Regulation Part II, Subpart E, Upset Conditions and
Breakdowns.She permittee shall notify the Division of any upset condition which causes a violation of
any emission limit or limits stated in this permit as soon as possible,but no later than two(2)hours after
the start of the next working day,followed by written notice to the Division explaining the cause of the
occurrence and that proper action has been or is being taken to correct the conditions causing said
violation and to prevent such excess emission in the future.
3. The emission levels contained in this permit are based on the following emission factors(any change in
operations may change these factors):

PARTICULATE EMISSIONS CONTROL PLAN FOR MINING AND PROCESSING ACTIVITIES
THE FOLLOWING PARTICULATE EMISSIONS CONTROL MEASURES SHALL BE USED FOR
COMPLIANCE PURPOSES ON THE ACTIVITIES COVERED BY THIS PERMIT, AS REQUIRED BY THE
AIR QUALITY CONTROL COMMISSION REGULATION NO.1, SECTION III.D.1.b. THIS SOURCE IS
SUBJECT TO THE FOLLOWING EMISSION GUIDELINES:
a. Mining and Processing Activities -Visible emissions not to exceed 20%, no off-property transport of
visible emissions.
— b. Haul Roads -No off-property transport of visible emissions shall apply to on-site haul roads, the
nuisance guidelines shall apply to off-site haul roads.
c. Haul Trucks -No off-property transport of visible emissions except that when operating off the
property of the owner or operator,the applicable guidelines shall be no off-vehicle transport of visible
emissions.
Control Measures
1. Adequate soil moisture must be maintained in topsoil and overburden to control emissions during
removal. Watering shall be implemented if necessary.
2. Topsoil and overburden stockpiles shall be compacted and revegetated within one year.
3. Emissions from material handling(i.e. removal,loading,and hauling)shall be controlled by watering at
all times unless natural moisture is sufficient to control emissions.
4. Vehicle speed on unpaved roads and disturbed areas shall not exceed a maximum of 15 m.p.h.Speed
limit signs shall be posted.
5. Vehicle speed on haul roads and service roads shall be restricted to 15 miles per hour. Speed limit
signs shall be posted.
6. Unpaved haul roads shall be watered as often as needed to control fugitive particulate emissions such
that the above guidelines are met.
7. Reclamation works and sequential extraction of material shall be initiated to keep the total disturbed
areas at any one time to a minimum.
8. Material stockpiles shall be watered as necessary to control fugitive particulate emissions. Aggregate
materials shall be sprayed with water during material loading into the storage bins or stockpiles.
9. Plant entryway,truck service roads,and concrete batching areas shall be graveled.Watering shall be
implemented if emission guidelines above are not met.

GENERAL TERMS AND CONDITIONS: (IMPORTANT! READ ITEMS 5,6,7 AND 8)
1. This permit is issued in reliance upon the accuracy and completeness of information supplied by the applicant
and is conditioned upon conduct of the activity, or construction, installation and operation of the source, in
accordance with this information and with representations made by the applicant or applicant's agents. It is valid
only for the equipment and operations or activity specifically identified on the permit.
2. Unless specifically stated otherwise, the general and specific conditions contained in this permit have been
determined by the APCD to be necessary to assure compliance with the provisions of Section 25-7-114.5(7)(a),
C.R.S.
3. Each and every condition of this permit is a material part hereof and is not severable. Any challenge to or appeal
of,a condition hereof shall constitute a rejection of the entire permit and upon such occurrence,this permit shall
be deemed denied ab initio. This permit may be revoked at any time prior to final approval by the Air Pollution
Control Division(APCD)on grounds set forth in the Colorado Air Quality Control Act and regulations of the Air
Quality Control Commission(AQCC),including failure to meet any express term or condition of the permit. If the
Division denies a permit, conditions imposed upon a permit are contested by the applicant, or the Division
revokes a permit, the applicant or owner or operator of a source may request a hearing before the AQCC for
review of the Division's action.
4. This permit and any required attachments must be retained and made available for inspection upon request at the
location set forth herein. With respect to a portable source which is moved to a new location, a copy of the
Relocation Notice(required by law to be submitted to the APCD whenever a portable source is relocated)should
be attached to this permit. The permit may be reissued to a new owner by the APCD as provided in AQCC
Regulation No. 3,Part B, Section III.B.upon a request for transfer of ownership and the submittal of a revised
APEN and the required fee.
5. Issuance(initial approval)of an emission permit does not provide"final"authority for this activity or operation of
this source. Final approval of the permit must be secured from the APCD in writing in accordance with the
provisions of 25-7-114.5(12)(a)C.R.S.and AQCC Regulation No.3,Part B,Section IV.H. Final approval cannot
be granted until the operation or activity commences and has been verified by the APCD as conforming in all
respects with the conditions of the permit. If the APCD so determines, it will provide written documentation of
such final approval,which does constitute"final"authority to operate.Compliance with the permit conditions
must be demonstrated within 180 days after commencement of operation.
6. THIS PERMIT AUTOMATICALLY EXPIRES IF you (1)do not commence construction or operation within 18
months after either the date of issuance of this permit or the date on which such construction or activity was
scheduled to commence as set forth in the permit,whichever is later;(2)discontinue construction for a period of
18 months or more;or(3) do not complete construction within a reasonable time of the estimated completion
date. Extensions of the expiration date may be granted by the APCD upon a showing of good cause by the
permittee prior to the expiration date.
7. YOU MUST notify the APCD at least thirty days(fifteen days for portable sources)prior to commencement
of the permitted operation or activity. Failure to do so is a violation of Section 25-7-114.5(12)(a),C.R.S.and
AQCC Regulation No. 3, Part B, Section IV.H.1., and can result in the revocation of the permit. You must
demonstrate compliance with the permit conditions within 180 days after commencement of operation as stated in
condition 5.
8. Section 25-7-114.7(2)(a),C.R.S.requires that all sources required to file an Air Pollution Emission Notice(APEN)
must pay an annual fee to cover the costs of inspections and administration. If a source or activity is to be
discontinued, the owner must notify the Division in writing requesting a cancellation of the permit. Upon
notification,annual fee billing will terminate.
9. Violation of the terms of a permit or of the provisions of the Colorado Air Pollution Prevention and Control Act
or the regulations of the AQCC may result in administrative,civil or criminal enforcement actions under
Sections 25-7-115(enforcement),-121 (injunctions),-122(civil penalties),-122.1 (criminal penalties), C.R.S

Dear Chris:
Aggregate Industries (Al) requests additional discharge points added to CDPS Permit#500250.
Starting this spring, Al will begin mining operations on an adjoining parcel to the Platte Valley
Mine. Material excavated from this property will be conveyed to the Platte Valley Site for
processing.
Attached you will find an amended NPDES/discharge point map. We request 3 mobile discharge
points (004, 005, and 006) on the west side of the South Platte River—known as Wattenberg
Lakes -to facilitate groundwater dewatering activities during the life of the mine (10-15 years).
The pumping rates will be 5.04 mgd for all three pumps.
Additionally, due to flooding conditions last summer, we request an additional mobile discharge
point(003) at the Platte Valley Site. We anticipate that this extra discharge point would be used
in the event of flooding or other conditions that cause an increase in the groundwater table. Pump
capacity for 003 would be 5.04 mgd. As the adjoining site comes into operation,discharges from
the Platte Valley Mine site will decline. However,due to reclamation activities, discharge points
will need to remain active.

facility. As a condition of this permit, a copy of the SWMP must be provided to the Division upon request.
The permittee is encouraged to read the general rationale for an understanding of how this permit was developed and read the permit to see
what requirements exist. In the permit, effluent limitations and monitoring/reporting requirements are specified in Parts I.B. and LC;special
notification requirements for effluent violations are addressed in Part ILA.
This is a Division initiated amendment to add outfall 002,which was erroneously omitted in the previous iteration of this certification. As
such,there is no amendment fee associated with this correction.

3. RESPONSIBILITIES
3.1 Site Representatives and Operational Management are responsible for the management of fuel, oil, and chemicals used
and retained on site.
3.2 Environmental Team members are responsible for advising the Site Representatives and Operational Management to
ensure that fuel,oil, and chemical management is in accordance with federal, state,and local regulations.
4. PROCEDURE
4.1 Site Representatives shall ensure that storage tanks are labeled to indicate the contents.
4.2 Site Representatives shall ensure that fuel,oil, and chemical tanks meet local, state, and federal regulations.
4.3 Site Representatives shall define which employees at their site handle fuel, oil, and chemicals.
4.4 Site Representatives shall ensure that employees who handle fuel, oil, and chemicals are trained on spill prevention and
spill response.
4.5 Site Representatives shall ensure that spill response equipment is available on site.
4.6 Site Representatives shall develop and implement a system to inspect fuel, oil,and chemical storage and maintain
records of the inspections.
4.7 Fuel and oils shall be inspected at least weekly. Inspections shall include pipings, fittings, supports, valves, tanks and
containment structures.
4.8 Site Representatives shall ensure that fuel, oil, and chemicals are stored in such a way that a release can be contained,
either through secondary containment, site grading, or other effective practices.
4.9 Site Representatives shall establish and implement emergency procedures in accordance with CP 11 to cover spills of
fuel, oil, or chemicals.
4.10 Site Representatives shall establish, implement, and post procedures where applicable to cover the delivery of fuel, oil,
and chemicals by bulkers onsite.

4.11 Site Representatives shall establish, implement, and post procedures where applicable to cover fueling activities on
site.
4.12 Environmental Team Members shall inform Site Representatives of what threshold quantity they would like to be
notified if a spill of fuel, oil, or chemicals takes place on site
4.13 Site Representatives shall report spills of fuel, oil, and chemicals to Environment Team Members.
4.14 When required by law, Environmental Team Members shall notify the appropriate regulatory agency of spills of fuel, oil,
or chemicals and record this in the applicable sites External Communication component of ENVOY.
4.15 All employees are responsible for complying with and notifying their Site Representative if operations are not being
performed in accordance with fuel, oil, and chemical procedures.

CP 20 - Waste Management
1. PURPOSE
The purpose of this procedure is to define how the Company shall manage, store, and dispose of waste generated by the
Company's activities, products, or services.

3. RESPONSIBILITIES
3.1 Site Representatives and Operational Management are responsible for the collection, storage, and disposal of wastes at
their site(s).
3.2 Operational Management is responsible for ensuring relevant methods of recycling waste are implemented where
applicable and financially reasonable.
3.3 Environmental Team Members are responsible for advising Site Representatives and Operational Management to ensure
the collection, storage, and disposal of waste is in accordance with federal, state, and local regulations.
4. PROCEDURE
4.1 Site Representatives shall ensure that wastes are stored in designated areas.
4.2 Site Representatives shall ensure that waste collection containers, with the exception of general trash containers, are
clearly labeled indicating the types of waste they are holding.
4.3 Site Representatives shall ensure containers are suitable to store the type of waste they are holding.
4.4 Site Representatives shall ensure that waste is disposed of or recycled in a timely manner.
4.5 Site Representatives shall develop and implement a system for inspecting waste storage areas.
4.6 Site Representatives shall develop and implement a system for maintaining their records of waste generation.
4.7 If applicable, Site Representatives shall develop and implement site procedures where corporate procedures do not exist
to cover the collection, storage, and disposal of regulated waste.
4.8 USED OIL STORAGE&DISPOSAL:
4.8.1 Used oil containers must hold the amount of used oil being transferred into the used oil container and the container
must be in good condition with no leaks.
4.8.2 The container must be labeled'Used Oil'unless in Massachusetts or if it burned in a space heater in New Hampshire.
If In Massachusetts,the used oil container must be labeled 'Hazardous Waste, Waste Oil,Toxic' and have an accumulation
start date. If used oil is burned in New Hampshire, the container must be labeled 'Used Oil for Recycling'.
4.8.3 The used oil container must be covered at all times except when oil is being transferred into the container. Draining oil
filters into the container is considered transferring into the container. When the oil filters have finished draining, the filters
must be removed and the oil container closed.
4.8.4 Used oil must be collected and disposed of or recycled by an EPA approved contractor.

4.8.5 Used oil cannot be transported by Aggregate Industries' employees in quantities greater than 55 gallons unless an
EPA ID number is obtained.
4.9 All employees are responsible for complying with and notifying their Site Representative if operations are not being
performed in accordance with waste procedures.

Details PROCEDURE FOR STORAGE AND DISPOSAL OF
UNIVERSAL WASTE
Employees who are responsible for storing and disposing
of universal waste shall follow this procedure.
USED BATTERIES:
1) Store used batteries in designated storage area only.
2) Store batteries inside a building and on an impervious
surface.
3) Make sure battery area is labeled 'Used Batteries'
or'Universal Waste'. If it is not, notify Site Rep so he/she
can label it.
4) Do not dispose of batteries in dumpster.
5) Contact Site Representative to have batteries recycled
properly.

PROCEDURE FOR STORAGE AND DISPOSAL OF UNIVERSAL WASTE
Employees who are responsible for storing and disposing of universal waste shall follow this procedure.
USED BATTERIES:
1)Store used batteries in designated storage area only.
2)Store batteries inside a building and on an impervious surface.
3)Make sure battery area is labeled'Used Batteries' or`Universal Waste'.If it is not,notify Site Rep so
he/she can label it.
4)Do not dispose of batteries in dumpster.
5)Contact Site Representative to have batteries recycled properly.
MERCURY-CONTAINING USED FLUORESCENT BULBS:
1.)Check to see if your used fluorescent bulbs contain mercury.If they have green tips,they do not contain
mercury and can be disposed of in the dumpster. If the tip is not green,follow the rest of this procedure.
2.)Place used light bulbs in a container labeled 'Used Light bulbs'or`Universal Waste'.
3.)Make sure the accumulation date is listed on container.If it is not,notify Site Rep so he/she can label
appropriately.(Accumulation cannot exceed one year.)
4.)Do not break light bulbs.
5.)Do not dispose of light bulbs in dumpster.
6.)When the used fluorescent bulb container gets near full,contact your Site Representative for the pick-up
and recycling of the used bulbs.

3.)Transfer used oil into the used oil container.
4.)Make sure container is labeled 'Used Oil'. If it is not,contact Plant manager to re-label it.
5.)When the used oil container gets near full,contact Plant manager to arrange for the pick-up and
recycling of the used oil(Sam Hill).
6.)When Sam Hill picks up used oil,make sure to get quantity removed and a signature on the manifest
(manifest should state that the used oil contains less than 1 000ppm halogens. If it states differently,have
Plant manager call the Environmental Department immediately!)
7.)Place one copy of the manifest in the Fact File.

I have reviewed the submitted letter(dated February 1, 2005)and documents submitted by Aggregate Industries Representative,
Connie Davis, regarding USR-13250 Conditions.
Condition 3B-Waste Handling Plan A waste handling plan/documents has been submitted and is approved by this department.
This condition is satisfied.
Condition 3C-APEN and Emissions Permit A copy of the letter/application to the Air Pollution Control Division for modification
regarding a change in production has been submitted. This condition has been satisfied.
Condition 3D-CDPS application. A copy of the written request (dated January 13, 2005)to the Water Quality Control Division for
additional discharge points has been submitted. This condition has been satisfied.
Conditon 3G- Dust Abatement Plan. A Dust Abatement Plan Air Pollution Control Divison required Control Measures has been
submitted and is approved. This condition has been satisfied.
Conditions 3H, 3J and 3K have not been satisfied.
