Approved with Conditions
The Weld County Department of Planning Services has determined through an administrative review that the
standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is
approved with the following conditions in accordance with information submitted in the application and the
policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Topographic or physical features of the proposed Lots A, B and C, such as ravines, ditches, streams

etc.may limit the area available for a new or replacement septic system. Prior to recording the plat the
Weld County Department of Public Health and Environment recommends that the applicant review the
Weld County Code pertaining to septic systems to assure that any installed septic system will comply
with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size
to allow the installation of a septic system the lot may need to be enlarged.
3. The West Greeley Soil Conservation District has provided information regarding the soils on the site.
The applicant shall review the information and use it to positively manage on site soils.
4. Prior to recording the plat:
A. The applicant shall submit a proposed building envelope(s) for Lot D to the Department of
Planning Services for review. Upon approval by the Department of Planning Services, the
building envelope shall be delineated on the plat.Additional building envelopes shall be labeled
alternative building envelope. All building envelopes shall take into consideration impacts to
productive farm ground as well as the location of incompatible uses, flood plain, ditches,
wetlands, geological hazards, accesses, preferable locations, oil/gas easements and oil/gas
structures which must meet setbacks as required by Section 23-6-10 of the Weld County Code.
B. In accordance with Section 23-3-50. E of the Weld County Code, the plat shall indicate the
building setbacks of a 200-foot radius of any tank battery and a 150-foot radius of any wellhead
for the oil and gas structures adjacent to Lot A, Lot B and Lot C.
C. The plat shall be titled: Recorded Exemption No. 1055-14-2 RE-4237
D. Lots A, B, C shall share an access, no circle drives or additional accesses shall be granted.The
access shall be located along the east property line. If this is not a viable location, the applicant
shall submit information indicating why.The access road shall be graded and drained to provide
all weather access. Accesses shall be placed in such a location as to have adequate sight
distance in both directions, shall not be placed below the crest of a hill or where physical
obstructions are present.A 30 foot wide joint access and utility easement,for the benefit of Lots
A, B, C and D,shall be shown clearly on the plat. The joint easement shall be dedicated for the
use as shown using the language set forth in the Weld County Code, Appendix 24-F.E.
E. Lot D shall use the existing agricultural /oil and gas/ditch road access points necessary for
agricultural operations as no additional accesses shall be granted.
F. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe(CMP)is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
G. County Roads 46 and 45 are is classified by the County as local gravel roads,which require 60
feet of right-of-way at full build out. The applicant shall verify the existing right-of-way and the
documents creating the right-of-way. If the right-of-way can not be verified, it shall be dedicated.
The plat shall delineate the existing right-of-way and the documents which created it.
H. The applicant shall address the requirements of Weld County School District RE-1 as stated in
the referral response dated September 11,2005. Evidence of such shall be submitted in writing
to the Weld County Department of Planning Services.
I. Lots A, B and C shall comply with the one(1)acre net minimum lot size required by Section 24-
8-40.L of the Weld County Code.

J. Lot D shall comply with the one-hundred twenty (120) acre net minimum lot size required by
Section 24-8-20.C.3 of the Weld County Code.
K. The applicant shall provide the Weld County Department of Planning Services with a Statement
of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original
parcel.
L. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
No building or structure as defined and limited to those occupancies listed as Groups A,
B, E, F, H, I, M and R in Section 302.1 of the 2003 International Building Code, shall be
constructed within a 200-foot radius of any tank battery or within a 150-foot radius of any
wellhead. Any construction within a 200-foot radius of any tank battery or 150-foot radius
of any wellhead shall require a variance from the terms of the Section 23-3-10 of the
Weld County Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Lot A, Lot B and Lot C are not eligible for a future land exemption in accordance with
Section 24-8-20.C.3 of the Weld County Code.
4) All structures requiring building permits shall be located within the designated building
envelope.
5) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
6) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that the Lots have an adequate water supply of
sufficient quality, quantity and dependability.
7) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
8) Building permits shall be obtained prior to the construction of any building. Buildings that
meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20
and Section 29-3-20.B.13 of the Weld County Code do not need building permits,
however,a Certificate of Compliance must be filed with the Planning Department and an
electrical and/or plumbing permit is required for any electrical service to the building or
water for watering or washing of livestock or poultry.
9) Any disturbance of wetlands shall require the applicant to contact the Army Corps of
Engineers for permits pursuant to Section 404 of the Clean Water Act.

10) Effective January 1, 2003, Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11)
11) Effective August 1, 2005, Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the Capital Expansion Impact Fee and the
Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40)
12) Potential Purchasers are hereby notified that a confined animal feeding operations are
located in the area. Off-site impacts that may be encountered include noise from trucks,
tractors and equipment; dust from animal pens and odors from animal confinement,
silage, and manure.
13) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States,ranking fifth in total market value of agricultural
products sold. The rural areas of Weld County may be open and spacious, but they are
intensively used for agriculture. Persons moving into a rural area must recognize and
accept there are drawbacks, including conflicts with longstanding agricultural practices
and a lower level of services than in town. Along with the drawbacks come the incentives
which attract urban dwellers to relocate to rural area:open views,spaciousness,wildlife,
lack of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring farms, those features which attract urban dwellers to rural Weld County
would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well run agricultural activities will generate off-site impacts,including noise from tractors
and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field
work, harvest, and gravel roads; odor from animal confinement, silage, and manure;
smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers
in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply
be moved out of the way of residential development without threatening the efficient
delivery of irrigation to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found
to be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and County roads outside of
municipalities. The sheer magnitude of the area to be served stretches available
resources. Law enforcement is based on responses to complaints more than on patrols
of the county and the distances which must be traveled may delay all emergency
responses, including law enforcement, ambulance, and fire. Fire protection is usually
provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads,no matter how often they are bladed,will not provide
the same kind of surface expected from a paved road. Snow removal priorities mean
that roads from subdivisions to arterials may not be cleared for several days after a major
snowstorm. Snow removal from roads within subdivisions are of the lowest priority for
public works or may be the private responsibility of the homeowners. Services in rural
areas, in many cases,will not be equivalent to municipal services. Rural dwellers must,
by necessity, be more self-sufficient than urban dwellers.
Children are exposed to different hazards in the county than in an urban or suburban

setting. Farm equipment and oil field equipment, ponds and irrigation ditches,electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs, and livestock present real threats to children. Controlling
children's activities is important,not only for their safety,but also for the protection of the
farmer's livelihood. Parents are responsible for their children.
5. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services.Upon approval of the paper copies the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services'
Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld
County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days from
the date the Administrative Review was signed. The applicant shall be responsible for paying the
recording fee.
6. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be
sent to maps@co.weld.co.us.
7. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not
be recorded within the required sixty(60)days from the date the Administrative Review was signed a
$50.00 recording continuance charge may be added for each additional 3 month period.
8. The Weld County Department of Planning Staff's approval of this Recorded Exemption Application is
based on satisfying the Conditions of Approval.Should an applicant be unwilling or unable to meet any
one of these conditions within 60 days of approval,then this case will be forwarded to the Weld County
Board of County Commissioners with a staff recommendation for denial.

I, Frank L. Boulter, also known as Frank Lester Boulter, also
known as Frank Boulter, of Greeley, Weld County, Colorado, do
hereby execute this General Power of Attorney with the intention
that my agent hereinafter named shall be able to act in my place in
all matters .
SECTION 1 - DESIGNATION OF ATTORNEY
1 . 1 I constitute and appoint my wife, Ila J. Leavy, or my
son, David S . Boulter, to be my co-attorneys-in-fact or agent
( "agent" ) , to act for me, in my name and in my place . I trust both
of my agents and insure that they will act in my best interest .
Because my son, David S . Boulter, lives in Kansas, it may be
inconvenient for both of my attorneys-in-fact to be required to act
together. I direct that either of my co-attorney' s in fact are
able to act under this General Durable Power of Attorney
individually and without the consent or approval of the other co-
attorney-in-fact . If one of my agents shall cease to act due to
death, incapacity or resignation, then the remaining person shall
be my sole attorney-in-fact or agent ( "agent" ) , to act for me, in
my name and in my place .
SECTION 2 - EFFECTIVE DATE AND GENERAL PROVISIONS
2 . 1 This General Power of Attorney shall be effective as of
the date of execution by me .
2 .2 This General Power of Attorney shall not be affected by
my incapacity or disability, it being my specific intention that my
agent shall continue to act as such even though I may not be
competent to ratify the actions of my agent .
2 .3 Third parties may rely upon the representations of my

SECTION 3 - POWERS
3 .1 General Grant of Power: I give to my agent full power to
do everything necessary in my name or for my benefit which I could
do if I were personally present and able . It is my intention that
my agent may perform any act and exercise any power, duty, right ,
or obligation that I could perform or exercise . Such authority is
intended to relate to any person, transaction, or interest
concerning real and personal property, including intangible
property interests, in which I now have an interest, and property
in which my interest is subsequently acquired. I empower my agent
to delegate authority to others . In addition thereto, and not in
limitation thereof, my agent shall also have the powers set forth
below.
3 .2 My agent may collect and receive, with or without the
institution of suit or other legal process, all debts, monies,
gifts, objects, interest, dividends, annuities, and demands that
now are due, or may hereafter become due, owing or otherwise
payable or belonging to me . My agent may use and take all lawful
actions in my name or otherwise to recover the same and to
compromise the same .
3 .3 My agent may sell, convey, lease, exchange, mortgage,
pledge, release, or otherwise deal with, dispose of, or encumber
any of my property, either real or personal . This shall include
the power to borrow money or otherwise obtain credit upon such
terms, conditions, and covenants as my agent considers to be
appropriate .
3 .4 My agent may appear on my behalf in any litigation in
which I am, or may become, a party during the duration of this
General Power of Attorney.
3 . 5 My agent may give discharges, releases, consents, and
receipts on my behalf .
3 . 6 My agent shall have the power to deposit funds in my name
in any banking or savings institution, or in any "money market"
account, whether or not insured.
3 .7 My agent shall have the power to pay any and all bills,
accounts, claims, and demands now due by me or becoming due by me
subsequent to the execution of this General Power of Attorney. In
connection therewith, my agent may withdraw funds from and draw and
sign checks in my name upon any bank or trust company, savings
institution, or money market fund in which I may have any funds on
deposit .
3 . 8 My agent may endorse all checks drawn to my order for
deposit in any account in which I have funds on deposit or in any
new account opened in my name .

3 . 9 My agent shall have the power to hold, invest , reinvest,
and otherwise deal with and manage all property in which I have any
interest .
3 . 10 My agent shall have the power to sell, convey, transfer
or surrender any securities which I may own, or to purchase
different securities . In connection therewith, my agent may
execute in my name or on my behalf any stock power or other
instrument in order to effect any such sale, conveyance, transfer,
surrender or purchase .
3 . 11 My agent shall have the power to enter into or renew any
agency or custodian agreement with any bank or trust company at my
expense for the investment or safekeeping of any property. This
shall include the power to revoke any agency or custodian
agreement, whether the agreement is entered into by me, by my
agent, or by any other person.
3 .12 My agent shall have unrestricted access to, and the
right to, enter into any safe deposit box, vault, storage
warehouse, or other depository which I may own that may be
registered in my name or in which any property may be held for me,
including the authority to drill the safety deposit box if the keys
have been misplaced.
3 .13 My agent shall have the power to prepare, make, execute,
and file any and all federal, state, local, or other tax returns,
claims for refunds, or declarations of estimated tax, requests for
extensions of time, petitions regarding tax matters, and any other
tax-related documents, including offers, waivers, consents,
agreements and any power of attorney required by any taxing
authority. This power shall include the power to represent me
(directly or through attorneys, accountants, or other agents) in
any matter before the Internal Revenue Service, or any other
federal, state, or local agency, and to execute federal tax form
2848 or any other power of attorney required by the Internal
Revenue Service . In connection with such representation, my agent
may execute consents extending the statutory period for the
assessment or collection of taxes, may pay all taxes and interest
thereon which I may properly owe or which may be assessed against
me, may contest the validity of any proposed assessment , exercise
any election available to me under federal , state or local tax law,
and may receive any tax refunds to which I am entitled, and act for
me in all tax matters for all tax periods and years before the
Internal Revenue Service and any other taxing authority.
3 .14 My agent shall have the power to execute, seal ,
acknowledge, and deliver any instruments, documents, or papers
deemed necessary or advisable with respect to any of my property.
3 .15 My agent shall have the power to apply for a Certificate
of Title upon, and endorse and transfer title thereto, for any

automobile, truck, pickup, van, motorcycle, or other motor vehicle
in which I have any interest .
3 . 16 My agent shall have the power with respect to insurance
and annuity transactions to procure, continue, modify, change,
convert, sell, encumber, take a loan against, withdraw cash value,
assign or terminate any contract of insurance or annuity which
insures me or provides an annuity to me or another person. My
agent shall not have the power to change beneficiary designations
on a life insurance policy insuring my life or on an annuity naming
a beneficiary after my death.
3 . 17 My agent shall have the power with respect to estate,
trust or other beneficiary transactions to act for me in all such
matters to accept, reject, disclaim, receive, assign or exchange
any share or interest I may claim or be entitled to as a
beneficiary.
3 .18 My agent shall have the power with respect to benefits
from social security, medicare, medicaid or any other governmental
program, or civil or military service pension, to act for me to
file and prosecute a claim for me to any benefits under such
programs, and to accept, settle or compromise any claims for me
with respect to any benefits .
3 .19 My agent shall have the power to transfer all or any
part of property owned by me or in which I have an interest, to the
trustee of any revocable trust created by me during my lifetime,
such that the same is held and becomes a part of the corpus of that
trust to be dealt with in accordance with the terms of such trust .
My agent shall have the power to create, amend or revoke any trust
and transfer all or part of my property into such trust as my agent
may deem appropriate . My agent shall also have the power to demand
and receive, just as I could, any income or principal held in trust
of which I am a beneficiary. And my agent shall have the power to
revoke any trust created by me .
3 .20 My agent shall have the power to grant, bargain, sell,
convey and lease for oil, gas and mineral purposes any and all real
estate which I may own or in which I may possess any interest ,
wherever situate, for such price and on such terms which my agent
deems best, and to make, execute, acknowledge and deliver good and
sufficient documents of conveyance for the same, with or without
covenants of warranty; to sell, assign, transfer and convey any and
all oil and gas leases and royalty and mineral interests which I
may own or in which I may possess any interest, wherever situate,
for such consideration and on such terms as my agent deems best,
and to execute good and sufficient assignments and conveyances for

and all information, statements, data, account balances, and any
and all other records regarding any and all financial affairs of
mine, including such records from any banks, financial
institutions, financial planners , securities brokerages, or any

It is my intent by this power to allow for my agent to be able to
obtain all financial information in order to handle all of my
financial affairs .
3 .22 In addition to all of the powers conferred herein, and
not in lieu thereof, I grant to my agent all of the powers
conferred or provided by the Colorado Fiduciaries ' Powers Act , as
it may hereafter from time to time be amended.
SECTION 4 - RATIFICATION, USE OF PHOTOCOPY, REVOCATION OF PRIOR

The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are
as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCRs 45 and 46 are local gravel roads and require a 60-foot right-of-way at full build out. The applicant shall
verify the existing rights-of-way and the documents creating the rights-of-way. If the rights-of-way cannot be
verified, they shall be dedicated.
The 30-foot residential easement roadway crates a stand-alone lot between Lots A, B and C. The other option
is to place the 30' easement on the east property line.
REQUIREMENTS:
The Weld County Public Works Department recommends approval of this application.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is
dedicated, private, or deeded to provide adequate access to the parcel.
In accordance with Section 24-7-50 J of the Weld County Code, Chapter 24, Article VII, the flag lot
configuration will be avoided where possible. The minimum width of a flag lot is 30 feet.

Weld County School District RE-1 has developed methodology for Land Dedication and/or In Lieu
Payments. The current In Lieu Payment amount per single family unit is $1,054.20. Based on the

1. Trust Property. The Grantor does hereby transfer and
deliver to the Trustees the property listed in the schedule annexed

hereto, to have and to hold the same and any cash, securities or

other property which the Trustees may, pursuant to any of the provi-
sions hereof, at any time hereafter hold or acquire all of such
property being hereinafter referred to collectively as the trust
estate, for the uses and purposes and upon the terms and conditions
herein set forth.
2. Dispositive Provisions. The Trustees shall hold,
manage, invest and reinvest the trust estate and shall collect the
income therefrom and iispose of the net income and principal as
follows:
(a) During the lifetime of the Grantor, the Trustees
shall provide for the Grantor sufficient funds for him and his wife,
Fannie Boulter, to live in the same style and manner as they now
r
enjoy, and if the Grantor or his wife should require medical care,
hospitalization, special care at home, in a nursing home or other
facility, the Trustees shall make provision therefore out of in-
come and if necessary out of the principal of the trust estate.
Such payments may be made directly to the Grantor or for the benefit
of the Grantor or his wife. The amount, time or times of such pay- ✓
ments shall always be within the sound discretion of the Trustees.
(b) Upon the death of the Grantor the Trustee shall
thereafter apply and distribute the trust estate as follows:
(1) The Trustee shall pay from principal of the
trust estate the expenses of the last illness, the funeral and

burial expenses of the Grantor. In addition thereto the Trustee •
shall pay all inheritance, gift, death or succession taxes from the
( principal of the trust estate which may be due from the Grantor,
the trust estate, or from a beneficiary by reason hereof.
(2) The Grantor's wife, Fannie Boulter, has a
substantial estate in her own name or which may be held for her in
trust. The trustee shall determine at my death how much of the prin-
cipal of the trust estate should be held to reasonably provide for
the reeds of my wife after my death taking into consideration all
other sources of funds available to her. To that end the trustees
in their sole and absolute discretion shall provide from the income
or principal of this trust such funds as they believe may be
reasonably required for my wife, her health and comfort.
(3) After the Trustees have determined what part
of the trust property shall he retained for my wife, they may in
their absolute discretion make a distribution of that part of the
trust property which in their opinion is not required for the bene-
fit of Fannie Boulter to my children, who are Frank Lester Boulter,
William Boulter, John Walter Boulter, James Boulter and Mary Louise
Boulter Connor, share and share alike. If any of my said children
should precede me in death then the share which he or she would have
been entitled had such deceased child survived shall be paid and
distributed to his or her descendants, per stirpes, and if none, to •
my descendants, ner stirpes. C. �
(4) As to any part of the trust, the Trustee shall _l
not be required to distribute all income each year. They may keep
and retain the income, distribute the same to Fannie Boulter or to
my children as described in paragraph 2. (3) above or add the same 1�

maintenance of my wife Fannie Boulter, the Trustees may distribute

John Welter Boulter, James Boulter, Mary Louise Boulter Connor,
share and share alike. In the event that any of my said children
should precede me in death, the share which would have been dis-
tributed to such deceased child shall be paid and distributed to
his or her descendants per stirpes, and if none, to my descendants
per stirpes. -.
i6) The Trustees in their sole and absolute dis-
cretion may keep and retain title to the real property which is
part of the trust estate for a period of reasonable time and it
is suggested but not required that five years following my death
or the death of my wife whichever is last to occur is a reasonable
time. The Trustees may sell the real property or any part thereof
to facilitate distribution or they may make conveyance of the real
property to the beneficiaries in undivided interests if in their
sole and absolute discretion the best interests of the beneficiaries r
would be served by distributing the same in kind.
(7) In any event the trust
property and accumulated

income shall be paid and distributed to the beneficiaries ten years
after my death or the death of my wife, whichever is last to occur.
3. Trust Powers, The Trustees shall have and exercise
all of the pertinent powers conferred upon fiduciaries by the pro-
visions of the Colorado Fiduciaries' Powers Act now in force or as
.. hereafter amended.
4. Compensation of the Trusteese The Trustees shall be
entitled to receive and retain as the compensation for their ser-
. vices any sum which shall not be in excess of the fee charged by the
Greeley National Bank of Greeley, Colorado, for services of a
Trustee under the circumstances of this trust.

5. Resignation or Removal of a Trustee. (a) In the
event that either Frank Lester Boulter or William Boulter should
cease to act as Trustee hereunder for any reason, the other may
act as sole Trustee.
(b) In the event that both Frank Lester Boulter and
William doulter should cease to act as Trustee or in the event
•
they are unable to agree in the administration of this trust or
merely wish to resign, the Greeley National Bank of Greeley,
Colorado, its successor or appointee shall become successor Trustee.
Any successor Trustee shall have from and after its appointment or
succession to office hereunder and without any assignment or other
action by any person, all of the title, interest, rights and powers
including discretionary rights and powers which are the provisions
of this agreement granted to and invested in the Trustee named
herein.
• 6. Spendthrift Clause. The interest of any beneficiary
in principal and income of the trust estate shall not be subject
to assignment, alienation, pledge, attachment, or claims of creditors
of such beneficiary.
7. Situs. The Grantor declares that this agreement and
1 the trust created hereby shall be construed under and regulated by
the laws of the State of Colorado, and that the validity and effect
of this agreement and of this trust shall be determined in accordance
with the laws of that state, and that the Trustee shall not be re-
quired to account in any court other than one of the courts of that
state.
B. Amendment and revocation. The Grantor reserves the
right at any time or from time to time, without the consent of any
person and without notice to any person other than the Trustee, to
revoke or modify the trust hereby created in whole or in part, to
change the beneficiaries hereof, or to withdraw the whole or any
part of the trust estate by filing notice of such revocation,

RE: Water Service to No Worries Inc.
Dear Ms. Brethauer:
This letter is in response to a request for water service to serve the following property described as
follows:
W '/2 of Section 14, Township 4 North, Range 65 West, Weld County, Colorado.
Water service can be made available to the above described property, provided all requirements of
Central Weld County Water District, Northern Colorado Water Conservancy District and the U. S.
Bureau of Reclamation are satisfied. Please note that you are responsible for confirming that this
property has met the requirements of Northern Colorado Water Conservancy District and the
Bureau. Central Weld cannot issue a tap until all requirements are satisfied. A water main
extension will be required to provide water service to this property.
New service will have to meet the criteria stated in the Water Shortage Contingency Plan adopted
by the Board on June 20, 2002. Due to the rapid cost increase of raw water, existing tap fees may
not apply for water service to this property. The District will not notify, by separate letter, any
prospective landowners or land purchasers of tap fee or line extension cost increases. The cost of a
tap fee and/or line extension will have to be paid in advance to the District by the prospective
customer in accordance with District policy.
Central Weld County Water District requires that contracts be consummated within one (1) year
from the date of this letter or this letter shall become null and void unless extended in writing by the
District. Please contact the Central Weld office for further information regarding water service.
