The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 16 is designated on the Weld County Road Classification Plan (FHU) as a local gravel road, which
requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
WCR 19 is designated on the Weld County Road Classification Plan (FHU) as a collector status road, which
---,quires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is
,laintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
Our most recent traffic count taken in 2004 on WCR 16 reflects a range from 119 to 128 vehicles. Our most
recent traffic count taken in the five-mile stretch adjacent to the property on WCR 19 reflects 1000 to 2000
vehicles.
REQUIREMENTS:
Access: The applicant is indicating that the main access to the dairy and feeding operation is from WCR 16,
which is identified on the plat drawing on the east side of the property. Utilize this as your main access point to
your facility. There appears to be 18 trailers accessing the farm. I recommend that most of the traffic utilize
the west access road to WCR 19. This access would creates less of an impact in the way of dust problems for
the adjacent property owners.
On-Site Parking: The on-site parking appears to be adequate for the facility and the circulation appears to be
good throughout the operation. I recommend adding gravel as needed to your main internal road system.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off.

The Department has reviewed the septic and water issues for the employee housing proposed on Amended Use
by Special Review#1231, and offer the following comments:
In Regard to the Septic Systems:
1. The application states the reason for the amendment to the USR is to add 4 mobile homes for employee
housing and that the total employee housing units will be 15;
2. The applicant submitted 8 septic permits, 3 of which were for Section 7 which is not a part of this
application; the remaining 5 septic permits account for 6 mobile homes (1 permit serves 2 trailers). All
septic permits list the water supply as 'well';
3. The Department found 3 septic permits issued in 2000; 2 for employee housing (trailers#4 and #10); the
third septic permit is for a modular with an address off CR 19 (different parcel number than listed on the
application) and Central Weld County Water District as the water supply, therefore the Department has
determined this permit is not for employee housing;
Based on this information, the Department has 7 residential septic permits for 8 employee housing units, while the
application implies there are 11 housing units presently on the property. It appears there are 3 septic systems
undocumented on the property. The Department requests a detailed site map (with scale)of the employee
housing delineating: 1)the locations of the mobile homes in existence with the number of bedrooms in each mobile
home and the current number of occupants, 2) septic permit associated with that mobile home, and 3)the septic
location depicted and square footage of the system. This map should be to scale and also locate all the wells on
the property. All proposed housing units should also be delineated on the map with approximate locations for
reference.
In Regard to the Water Supply:
The application has submitted documentation on the following wells:
1. well permit 32591F—permit expired before well drilled
2. well permit 34974 F—replacement permit for above well
3. well permit 45562F
Based on a review of well documentation from the State Engineer's office the Department has also found 2
additional well permits: 52955 F and 52954F. Septic permits SP-0000164 and SP-0000267 list the water supply as
well 52954F. Again, as noted in item #2 under the Septic heading all employee housing units list the water supply
a well. Also, as noted in the same section, there are at least 8 documented employee housing units being served
by multiple wells. The Department requests a separate map delineating: all existing housing units and the
interconnectivity of the water lines to wells. The housing units and wells should be labeled for reference. All
proposed housing units should also be delineated on the map and the well listed as the anticipated water source.
This information is requested in addition to any additional comments received regarding this application. Once this
additional information is received, the Department can complete the review of the septic system and water supply

The Department has reviewed additional septic and water information provided by AgPro for the
employee housing. This documentation included a Septic System Exhibit dated 6/1/2005 and a Site
Plan dated 6/2/2005 for the waterline detail. The Department offers the following comments:
In Regard to the Septic Systems:
The Septic System Exhibit is a representation of the mobile home and septic system locations
based on field observations and comparison with septic permits for the property, and were
conducted by Matt Cain and Sharyn Frazer of AgPro. The property was amended in 1999 and a
total of 14 employee housing units were approved for placement on the property. During
discussions with Sharyn Frazer and Tom Haren regarding the housing/septic systems
discrepancies, the reference to 11 homes was made repeatedly, and that the AMUSR-1231
application intention was to add 1 more employee housing unit, for a total of 15 at full buildout. The
Septic System Exhibit investigation determined that there are currently only 9 employee housing
units placed on the property. In an email from Sharyn Frazer dated today, 6/6/2005, she states that
as the applicant's representative, they are amending the AMUSR-1231 application to eliminate the
addition of any future employee housing units. Therefore, the total employee housing units for
this review will be 14 at full buildout. The original Site Plan for Front Range Dairy, dated
2/23/2005 and submitted in this AMUSR-1231 review delineates a total of 18 employee housing
units. This Site Plan should be amended to correct the total number of employee housing units. As
a result of the Septic System Exhibit preparation, it was determined that there are 2 employee
housing units (trailer#1 and #2) that have undocumented septic systems.
However, the Septic System Exhibit lacks some crucial information needed to determine if the
property is now subject to the Site Application process at the Colorado Department of Public Health
and Environment (CDH). The Septic System Exhibit is lacking the delineation of the existing wells,
and the approximate location of the additional 5 employee housing units and their respective septic
systems.
In Regard to the Water Supply:
All the available septic permits for the employee housing units references that a well is the water
supply. Again, during discussions with Sharyn Frazer and Tom Haren regarding the vagueness in
the application regarding the water supply for the property and specifically the employee housing
units and the need for the requested well-to-residence supply configuration (see Health Department
memo dated 4/11/2005), the Department was told that all employee housing units were served by
Central Weld County Water District (Central Weld water is co-mingled with well water for other dairy
operations). The Department was concerned that the employee housing units might fall under the
requirements of the Drinking Water regulations at the CDH. Based on the AgPro statement, a Site

Plan dated 6/2/2005 delineating the waterline detail was submitted. While this is not as detailed as
requested, the Department will accept this as the water source.
In the Health Department memo dated 4/11/2005, the Department noted that a review of well
documentation from the State Engineer's office found 2 additional well permits: 52955F and
52954F. No further documentation has been submitted regarding the status of these wells. The
Department requests further information on these wells.
In Regard to the CAFO Regulations:
The Weld County Department of Public Health and Environment has reviewed this application. We
have also discussed the application with the applicant's consultant, AgPro. Representatives of
AgPro have indicated that the applicant intends to apply to the Water Quality Control Division of the
Colorado Department of Public Health & Environment for a discharge permit for the facility.
Therefore, our referral comments will reflect this fact.
The Department recommends approval of the dairy expansion with the following conditions:
Prior to scheduling the Board of County Commissioner hearing:
1. The applicant shall submit an updated Septic System Exhibit that delineates: 1) the location
of the existing and proposed employee housing units, 2)the location of the existing and
proposed septic system placement, 3) the septic permit and square footage of the existing
septic systems associated with that mobile home, and 4) the location of the wells. The
updated Septic System Exhibit should be to scale and with the scale referenced. The
updated Septic System Exhibit shall be submitted to Kent Kuster, Water Quality Control
Division of the Colorado Department of Public Health and Environment for review as to the
applicability of the Site Application process as described in the CDPHE Site Location and
Design Approval Regulations for Domestic Wastewater Treatment Works (Regulation 22). A
copy shall also be provided to the Weld County Health Department.
Prior to recording the plat:
1. The Site Plan for Front Range Dairy shall be amended to delineate only a total of 14
employee housing units (the 9 currently on site and the additional 5 proposed housing units).
2. All septic systems located on the property shall have appropriate permits from the Weld
County Department of Public Health & Environment. Employee housing units #1 and#2 do
not have documented septic systems. These existing septic systems will require an I.S.D.S.
Evaluation prior to the issuance of the required septic permits. In the event either or both of
the systems are found to be inadequate, the system must be brought into compliance with
current I.S.D.S. regulations.
3. Documentation regarding well permits 52955F and 52954E shall be submitted to the Weld
County Health Department.
4. Should the CDPHE determine that the existing layout of mobile homes and/or the addition of
new mobile home(s) require Site Application approval (per Regulation 22) the facility shall
provide evidence of Site Application approval. If the facility is not subject to the Site
Application regulations, the applicant shall provide evidence of such.

5. The applicant shall provide the following information to the Weld County Department of
Public Health & Environment:
a. Documentation prepared by a Colorado Registered Professional Engineer, that all
existing wastewater impoundments for the confined animal feeding operation meet
seepage rates as defined in Water Quality Control Commission Regulation 81.5
(2)(b). Documentation for any new impoundment shall be provided 30 days prior to
use of the impoundment
b. Evidence that a Standard Operating Procedure for sludge and manure removal
(cleaning of impoundments to maintain capacity) has been approved by the Colorado
Water Quality Control Division as described in Water Quality Control Commission
Regulation 81.5 (3)(b).
c. A site plan and site layout, which demonstrates that any existing or new
impoundments meet required setbacks to water wells and groundwater as required in
Water Quality Control Commission Regulation 81.5 (6).
6. The facility shall submit an application for a CAFO Colorado discharge permit as provided in
Water Quality Control Commission Regulation 61.
The Department recommends the following conditions as development standards:
1. Water service for all employee housing units shall be provided by Central Weld County Water
District.
2. All septic systems on the property must be maintained in good working order at all times.
3. The facility shall maintain compliance with the requirements of the Site Application in
accordance with Regulation 22 (as determined by Colorado Department of Public Health and
Environment, Water Quality Control Division).
4. The facility shall obtain and comply with their CAFO Colorado Discharge Permit and operate
in compliance with Colorado Water Quality Control Commissions (WQCC) Regulation #61
and #81.
5. There shall be no discharge of manure or process wastewater into surface water from the
production area or land application areas except as provided in the facilities CAFO Colorado
Discharge Permit.
6. Manure and process wastewater shall be applied at agronomic rates and in accordance with
the facility's Nutrient Management Plan and/or Manure and Wastewater Management Plan.
7. The facility shall operate in compliance with applicable Colorado Air Quality Control
Regulations. There shall be no open burning except"agricultural open burning" as defined
by Colorado Air Quality Control Commission's Regulation 9.
8. There shall be no permanent disposal of solid wastes, as defined in the Regulations
Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2), at this site.

9. The facility shall be operated and maintained in a manner to prevent nuisance conditions.

10. The facility shall control fugitive dust on this site and operate in accordance with the facility's
Management Plan for Nuisance Control (current approved plan dated February 2005).
11. The facility shall be operated in a manner to control pests. The facility shall be operated in
accordance, at all times, with their Management Plan for Nuisance Control (current approved
plan dated February 2005). Additional control measures shall be implemented at the request
of the Weld County Department of Public Health and Environment in the event that rodents
(which can be determined to be associated with the facility) are in such a number to be
considered a nuisance condition.
12. The facility shall be operated in a manner to control flies. The facility shall be operated in
accordance, at all times, with their Management Plan for Nuisance Control (current approved
plan dated February 2005). Additional fly control measures shall be implemented at the
request of the Weld County Department of Public Health and Environment in the event that
flies (which can be determined to be associated with the facility) are in such a number to be
considered a nuisance condition. Additional controls shall also be implemented in the event
the Weld County Department of Public Health and Environment receives a significant
number of fly (associated with facility) complaints, and in the judgment of the Weld County
Health Officer, there exists a fly condition requiring abatement.
13. The facility shall be operated in accordance with the odor abatement provisions of their
Management Plan for Nuisance Control (current approved plan dated February 2005).
Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold,
as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations.
Additional controls shall be implemented at the request of the Weld County Department of
Public Health and Environment in the event odor levels detected off site of the facility meet or
exceed the level of fifteen-to-one dilution threshold, or in the judgment of the Weld County
Health Officer, there exists an odor condition requiring abatement.
14. The applicant shall remove, handle, and stockpile manure from the livestock area in a
manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist
or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant
runoff. The surface beneath the manure storage areas shall be of materials which are
protective of State waters. These areas shall be constructed to minimize seepage or
percolation of manure contaminated water. In no event shall the facility impact or degrade
waters of the State in violation of Colorado Water Quality Control Commission Regulation
Number 81.
15. Waste materials, not specifically addressed by other development standards, shall be
handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and
other potential nuisance conditions.
16. The facility shall adhere to the maximum permissible noise levels allowed in the Light
Industrial Zone as delineated in Section 25-12-103 C.R.S, as amended.

A Site Specific Development Plan and Amended Special Review Permit for A Dairy and Animal Feeding
Operation.
AmUSR-1231
1. A separate building permit shall be obtained prior to the construction of any building.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Commercial building plans shall bear the wet stamp of a Colorado registered architect or engineer. Two
complete sets of plans are required when applying for each permit. Commercial building plans require a Code
Analysis Data sheet, provided by the Weld County Building Department. Residential building plans may be
required to bear the wet stamp of a Colorado registered architect or engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application. Current adopted codes include the 2003 International Residential Code;2003 International Building
Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas
Code; 2002 National Electrical Code and Chapter 29 of the Weld County Code.
4. The hospital parlor will require an engineered foundation based on a site-specific geotechnical report or an
open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed
by a Colorado registered engineer.
5.The buildings will probably be classified as follows: B(Animal Hospital)and R-3 (Single Family Dwelling)
occupancies. Fire resistance of walls and openings, construction requirements, maximum building height and
allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the
Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. When measuring buildings to determine offset and setback requirements, buildings
are measured to the farthest projection from the building. Property lines shall be clearly identified and all
property pins shall be staked prior to the first site inspection.

Dear Mr. Gathman:
Pursuant to the State Engineer's August 7, 1995 memorandum to county planning
directors, this office is no longer providing comments on land use actions that do not involve a
subdivision as defined in Section 30-28-101(10)(a), C.R.S. This referral does not appear to
qualify as a "subdivision", however, our office has performed a cursory review of the referral.
According to the referral information there are currently two commercial wells used to serve the
property. However according to the information available in the State Engineer's Office there
appears to be three commercial wells located on the property. Permit nos. 52953-F, 52954-F
and 52955-F were issued December 3, 1999. The permits allow the wells to withdraw up to
73.2 acre-feet annually, in combination. As long as the conditions on the well permits are
satisfied the wells can be used to supply water to the confined animal operation.

Amended Use by Special Review Application
Case Number AmUSR-1231
Thank you for referring the Larry & Margaret DeHaan Amended Use by Special
Review Application to the School District . Based upon expected student
generation rates from what appears to be the possibility of four new single-
family units, the new homes will generate approximately 4 new students to be
accommodated within district. Bus transportation would likely be provided.
It is understood that approval of the proposed amended use does not yet add
residential units to enrollment potential. However, certain school issues
should be considered at this important juncture, including school site
planning, transportation access and facility capacity.
The current facilities that would serve these homes are Twombly Elementary or
Butler Elementary, Fort Lupton Middle School and Fort Lupton High School.

The District is on record as not opposing growth so long as the growth is
planned and is manageable from a student enrollment standpoint. This
development could impact all levels of schools. In addition, even without
this project, completion of other previously approved developments would
generate more students than can be accommodated by the existing schools.
A COMMUNITY WHICH BELIEVES EDUCATION IS A SHARED RESPONSIBILITY

As the volume of developments increases with no alleviation of the existing
capacity conditions, the ability to provide the same quality education for
these new students becomes increasingly difficult. Weld County School
District Re-8 requests the cooperation and participation of the developer to
provide cash in-lieu of land dedication fee, (currently $939 per unit) , to
address the need for future school sites. Further, the District requests
that the County assist with monitoring residential growth working and
consider facility capacity impacts upon the schools in determining whether a
new project should be approved.
We appreciate your cooperation and the opportunity to comment upon the issues
of interest to both the County and the School District. We ask that the
recorded exemption not be approved until the applicant demonstrates that the
cash in-lieu of land dedication fee has been paid, or that arrangements have
been made with the School District. If you have any questions or need
