HomeMy WebLinkAbout20050832.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST TONY, DAVE, AND TODD FINLEY, AND THOMAS CUSTY FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Tony, Dave, and Todd Finley, and Thomas Custy, VI #0000312, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of November, 2005, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Tony, Dave, and Todd Finley, and Thomas Custy were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until December 8, 2005, to allow adequate time for the property owners to schedule an inspection of the mobile homes to bring the subject property into compliance. The shop for the dismantling of automobiles was constructed in 1984 and was in existence prior to the adoption of the Site Plan Review requirements on August 4, 1987. Therefore, this use is a non-conforming use. Non-conforming use number 412 has been assigned to this property. Please retain this number for further reference. No such nonconforming structure or nonconforming portion of a structure may be expanded, enlarged or altered in a way which increases its nonconformity, except that those structures that are nonconforming by reason of noncompliance with existing setback requirements may be expanded or enlarged so long as such expansion or enlargement does not further diminish the nonconforming setback. No expansion or enlargement of structures shall be allowed within an existing right-of- way. C. Substitution of structures. Should such nonconforming structure be moved for any reason, for any distance whatever, it shall thereafter conform to the regulations for the zoning district in which it is located after it is moved. D. Existing Building Permits. To avoid undue hardship, nothing in this Chapter shall be deemed to require a change in the plans or construction of any structure on which actual construction was lawfully begun prior to the effective date of adoption of the ordinance codified herein or amendment of this Chapter and upon which actual construction has been carried on diligently. Actual construction is hereby defined to include the placing of construction materials in permanent position and fastened in a permanent manner. Where excavation, demolition or removal of an existing structure has begun preparatory to construction, such excavation, demolition or removal shall be deemed to be actual construction, provided that a building permit for the new structure has been issued and the preparatory work is carried on diligently.
