RESOLUTION RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 67 : 80 :15 FOR A PRIVATE LANDI G STRIP - JIM AND LYNDA McKINSTRY WHERE S, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Meld County Home Rule Chartlr, is vested with the authority of administering the affairs of Weld County, Colorado, and WHERE S, the Board of County Commissioners of Weld County, Colorado hlld a public meeting on the 14th day of January, 1981 at the hou • of 9: 00 o'clock p.m. for the purpose of hearing the application of Jim and Lynda McKinstry for a Conditional Use Permit for a private landing strip on the following described real estat , to-wit: art of the Northeast Quarter of Section 22 , Township 3 North, Range 68 West of -Elie 6th P.M. , Weld County, Colorado WHERElkS, the petitioners were present, and WHERE1IS, evidence was presented in support, and in opposi- tion to, a proval of the Conditional Use Permit for a private landing st ip, and WHERE S, Section 3 . 3.D. Of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon approval of a Conditional Use Permit by the Board of County Com- missioners and WHERE S, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and finds that with he design and controls proposed in the operation, and the development standards contained in the Conditional Use Permit, there is little chance for adverse impacts on the sur- rounding e vironment. In addition I am desirous of outlining the position of the Departmen6 of Planning Services in this matter. The building permit, issued in mid November, was discovered to be in error on Tuesday, November 25, 1980 , when assigning an address for the residence. Gary Kinzie, the contractor, was notified by Cathy Gerstberger, Zoning Inspector, that an error wasldiscovered which should have not permitted issu- ance of the permit initially. U.'he error was allowing con- structionlof a hangar without prior approval of a Conditional Use Permit for the private landing strip. ) It was identified to Mr. Kinzie that the Building Permit would be revoked. Mr. Kinzie stated he would coordinate with the property owner and archiltect to begin proceedings for approval of an air- strip and hangar. On Novemb r 26, 1980, the site was inspected by a building inspector (to determine the status on construction activity. It was de ermined that no activity had been commenced on the ' site. Hat)ing not heard from anyone by December 2, 1980 , our office contacted Gary Kinzie's home and spoke to his wife to advise hiir that something must be done to clear up the prob- lem. Roger Vigil, Building Inspector, was advised by me that he could not approve inspections for the hangar. It was our understanding at this time we could solve the problem so no delay on tfhe house construction would have to occur. Later Mr. Jim Si7cKinstry , December-5;- 1980_-_ Page 2 , on Tuesd y, December 2 , 1980, Cathy Gerstberger again spoke with Gar Kinzie about revising the permits so the residence would not have to be delayed. It was suggested by Mr. Kinzie the airplane hangar be called a garage. He was advised that. it would have to be checked with the Zoning Administrator. It was at this point that I contacted Keith Ames (because I had previously had the pleasure of working with Mr. Ames) . I discused what had occured and it was felt a meeting would aid in correcting the problems . It was also suggested by Mr. AmesIthat the building permits be modified so that the hangar wds re-classified. I felt this was acceptable so long as it wa$ understood that the use of an airstrip on the prop- erty could not take place without prior approval ofappropriate permits . On December 3, 1980 , I met with you and Mr. Ames to re-write the `building permits-; accept revised -architectural plans, and discuss i1equirements for Conditional Use Permit application. It was agreed a Conditional Use Permit was necessary before use on the site of an airstrip was in compliance with the Zoning R4solution. It was also determined that as a non-con- forming Ise, the activity must precede December 26 , 19t3 . It was .my position _that_because the original building permit was revied and no reference was made to the airstrip or hangar use, and lthat 'it was understood that the Conditional Use Permit must be approved before the landing strip could be lawfully used, that no delay would be made by holding or denying any building permit. I am hopeful that we have reached an under- , standing of this matter and I apologize for any inconvenience caused you because of the original oversight by this office. Based on this study, the Federal Aviation Administration (FAA) has no objection provided all traffic pattern' operations are conducted east of the north/south runway, i.e. , all turns to the right when landing or departing runway 36, and all turns to the left when landing or departing runway 18. pEvraa This airspace determination should not be construed to mean FAA approval of the physical) development involved in the proposal . It is only a determination with respect to the safe and efficient use of airspace by aircraft. In making this determination, the FAA has considered matters such as the efflect the proposal would have on the existing or contem- I. plated traffic Patterns of neighboring airports, the effects it would have on the existing airspace structure and projected programs of the FAA, and the effects that existing or proposed man-made objects (on file Panim with the FAA) and natural objects within the affected area would have on mm the proposal .
