RESOLUTION
RE: AMENDMENTS TO PERSONNEL POLICY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, upon the adoption of the Weld County Personnel
Policy Manual, the Board of County Commissioners did include
Section 1. 5 which indicated specifically that:
1. 5 The Personnel Department will rate the applications
in accordance with the job requirements and furnish
a listing of the top six applicants from within the
County work force. If less than six only the qualified
will be submitted. The department head must inter-
view all County employees listed on the certified
eligibility list. An interview form will be completed
on each applicant. The department head may select
from this list, may reject all applicants if they do
not meet the requirements or may request that outside
recruitment be taken and consider one or all six
along with the outside applicants.
WHEREAS, the Board of County Commissioners, in reviewing
said policy, 4esires to include to Section 1.5 the following:
1. 5. 1 Upon approval of the department head, a permanent full
time employee who had resigned within one year in good
standing with the county may be rehired. Upon re-employ-
ment, the employee shall be subject to all conditions
of employment, including a six (6) or twelve (12)
month probationary period, applicable to new employees,
and shall start at the entry level if date of
termination is thirty-one days or more.
WHEREAS, the Board of County Commissioners did adopt Section
1.15 as follows:
1. 15 Written, physical agility, polygraph test, oral board
examinations and a complete background check, will be
required on all applicants for a position with the
Sheriff' s Department before final selection and hire.
WHEREAS, the Board of County Commissioners, in reviewing
said policy, desires to include to Section 1.15 the following:
1. 15. 1 A former deputy, returning after thirty-one (31) days,
or within one year from his/her effective resignation
date, must apply through the Personnel Department,
complete all required paper work, but shall not be
required to complete the written test unless the criteria
or test has changed. He/She must pass the physical
agility, polygraph, and have a background investigation
completed. The person must also complete the drug form.
Only the Sheriff may conduct an interview in lieu of
the oral board.

1.15.2 Separate eligility lists will be maintained for the
Deputy and Security Specialist.
A. ExperienceiCertified. Applicants: Limited to CLETA
certified applicants only. List will be maintained
from date of completion of applicant processing.
Preference will not be given to returning officers
not covered under other sections of these policies.
B. Challenge Certified Applicants: Those applicants
who may challenge CLETA certification. List will
be maintained from date of completion of applicant
processing.
C. InexperiencaiApplicants: List will be maintained
based on the score achieved for a period of one
year from date of completion of applicant processing.
A 50% wiitten score, based on an open and competitive
examination, and a 50% oral based score will be used.
(50/50 breakdown will reduce the potential for bias.)
D. Former Deputies: Those selected for employment in
accordance with paragraph 1. 5.1 and 1. 15.1 will be
maintained on a separate listing by date of
application.
E. An applicant shall remain on the list for one (1)
year from date of completion of applicant processing,
unless self initiated removal is requested. An
applicant may not retest while on the eligibility
list.
1. 15.3 When the Sheriff or his designee requests candidates to
fill a position(s) , the Personnel Department shall
provide the names of the required number of candidates
to fill the vacancy(ies) . The names shall be in
descending order by scores. In addition, all candidates
on the former Deputy list shall be considered along
with all other applicants. The candidate shall be
required to pass a polygraph test prior to final
selection. If a candidate is rejected, specific reasons
shall be provided to the Personnel Department. The
Personnel Department shall then provide additional
names until all listed positions are filled or all
lists exhausted.
WHEREAS, the Board of County Commissioners, in reviewing
Section 1.18. 1, desires to amend this policy to read as follows:
1. 18. 1 All new employees, except law enforcement personnel,
will be placed on probation for the first six months
of their employment. At the satisfactory completion
of the probation period the employee will be granted
a day of vacation for each month of employment prior
to completion of probation. Then, as a member of the
permanent work force, they will accrue vacation at
the rate as Stipulated in paragraph 6. 1 of the
Personnel Policies. Sick leave, which is a privilege
granted by the county, will be granted at the rate of
one day per month after the completion of the first
30 days of employment, and may be used as required in
accordance with paragraph 6. 2.
WHEREAS, the Board of County Commissioners desires to
include the following additionsto Section 1. 18 :
1. 18. 2 All new law enforcement personnel will be placed in a
training/probation status for the first twelve (12)
months of their employment. At the satisfactory
completion of the first six months of the training/
probation period, they will be granted six (6) days
of vacation for their use. Upon successful completion
of the second six months and completion of the training/
probation period, they will be granted an additional
six (6) days of vacation and then will accrue vacation
at the rates established in paragraph 6. 1 of the
Personnel Policies. Sick leave, which is a privilege
granted by the county, will be granted at the rate of
one day per month at the completion of the first 30
days of employment, and may be used as required in
accordance with paragraph 6. 2.
1. 18. 3 The training/probation of twelve months for law
enforcement personnel shall not be extended, and the
employee has no grievance rights while in the
training/probation status, and may be terminated
for any reason without cause, except discrimination.
A performance evaluation will be completed at the
end of each 90 day period. The employee will
receive a pay step increase at the satisfactory
completion of each of the steps (entry, qualified)
in accordance with Weld County Pay System. The
satisfactory completion will be recorded through
the use of the county evaluation instrument.
1. 18. 4 These policy changes will not affect current employees,
but only employees hired on or after the date of final
approval of these changes by resolution of the Weld
County Board of County Commissioners.
WHEREAS, the Board of County Commissioners did adopt Section
3.5 as follows:
3. 5 County policy also requires that all permanent salaried
employees become a member and contribute to the Weld
County Retirement Plan. During the period of member-
ship in the plan the employee will be required to con-
tribute, by means of payroll deductions, 4% of the
total monthly compensation up to $400 .00, and 6% on
that portion which is in excess of $400. The County
will match the contribution made by the employees.
The effective date is the first day of the month on
or after employment. Health Department employees and
the District Attorney are excluded from this since
they are members of P.E.R.A.
WHEREAS, the Board of County Commissioners, in reviewing
said policy, desires to include to Section 3. 5 the following:
3. 5. 1 An employee terminating employment from the county,
for whatever reason, will have returned, his contribution
plus applicable interest only, to the county retire-
ment plan. The employee's contribution will not be
returned any earlier than thirty-one (31) days after
his/her last day of work or date of application for
refund, whichever is later, nor any later than ninety
(90) days from the last day of work or date of application
for refund, whichever is later.
WHEREAS, the Board of County Commissioners, in reviewing
Section 6. 7 wishes to delete this section as adopted on December 31,
1980 and amend Section 6.7 to read as follows:

6. 7 Workers Compensation Leave - When determined by the
Director of Personnel, Workers Compensation Leave may
be granted to an employee who sustains an injury or
occupational illness as a result of or in the act of
performing the job. In the event the employee is
incapable of performing the normal functions of the
job, he/she will receive regular full salary for a
period not to exceed three (3) days from the date of
injury. At the end of the third day the employee will
receive 66 2/3 percent of his/her normal salary, minus
employee generated deductions for the period of injury
leave or until otherwise ordered by the Industrial
Commission or a Court of final jurisdiction. During
the Workers Compensation Leave, an employee does not
accumulate sick or vacation leave. Before the injured
employee is allowed to return to work, a written release
is required from his/her doctor stating that the
employee will be able to assume full working responsi-
bilities and duties. The injured employee must keep the
Personnel Department informed of his/her condition on a
monthly basis. Injured employees who can perform less
demanding job duties will be assigned such light duties
by the Personnel Department in coordination with
department heads. Depending on the injury, an employee
may be assigned to other duties until he/she is-able to
be reassigned to his/her normal job.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that the amendments to the Personnel policy as
stated herein be, and hereby are, approved.
BE IT FURTHER RESOLVED by the Board of County Commissioners
that said section shall be incorporated into the Administrative
Manual and published by the Director of Finance and Administration
for dissemination to all County departments.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 1st
day of September, A.D. , 1982.
