RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST GERALD AND JANET ROTH FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Gerald and Janet Roth, VI #0500158, are allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of May, 2005, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Gerald and Janet Roth were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until July 10, 2005, to allow adequate time for the property owners to complete all
inspections on the mobile home and a Certificate of Occupancy issued to bring the subject property
into compliance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0500158 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Gerald and Janet Roth to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties, with an instruction
for delay of action upon such referral until July 10, 2005, to allow adequate time for the property
owners to complete all inspections on the mobile home and a Certificate of Occupancy issued to
bring the subject property into compliance.

REMEDY
To bring the property into compliance, all inspections shall be completed on the accessory to the farm mobile
home and a certificate of occupancy issued.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney for
immediate action but delay action for 60 days to allow the property owners to complete the project as they
have been busy with farming.
CASE HISTORY
October 13, 2004 Letter to pick up permit and pay fees.
October 20, 2004 Form signed stating owner acknowledges expiration date.
March 15, 2005 Letter advising of expiration date for mobile home permit.
April 20, 2005 Certified letter indicating the violation case is scheduled before the Board of County
Commissioners.
April 25, 2005 Left message for property owners to call me as they had contacted the electrical
inspector requesting an extension. I spoke with the Building Official who advised to
go ahead with the violation hearing.
April 26, 2005 Phone call from property owner. They are attempting to be finished with this project
by May 10, 2005. They have been busy with spring farming and calving.

a meeting with the Board of County Commissioners on May 10, 2005, at 10:00 a.m., to consider the
violations. The property is in violation of the following Section(s)of the Weld County Code:

questions the Board of County Commissioners might have regarding the violation.
The Department of Building Inspection will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that

Section 29-7-130 of the Weld County Code states that a certificate of occupancy shall be obtained on all
mobile, manufactured, or factory-built homes no later than one hundred eighty(180)days after the permit is
issued. On October 20,2004,you were issued a permit for a block and tied mobile home for accessory to the
farm at 24401 County Road 66 which expires on April 18,2005, and there are numerous inspections yet to be
completed. In the event this permit is not completed by that date a meeting may be scheduled with the Board
of County Commissioners to explain the reasons for the delay. The Board will determine if an extension is
warranted or if the case should be referred to the County Attorney for legal action.

It has come to the attention of the Department of Building Inspection that a permit for a 12 X 60 mobile home
for an accessory to the farm at 24401 County Road 66 was submitted on April 12, 2004. This permit has not
been issued and the fee of$996.00 has not been paid. We have also not received the height,year,make and
serial number of the home or the signed "Owner Installer Disclosure Statement."
if the permit is not issued and the balance due paid within 10 days from the date of this letter the application
will expire. At that time, it will be necessary to submit a new application.
