HomeMy WebLinkAbout20050319.tiff RESOLUTION RE: VACATION AND DISCLAIMER OF RIGHT, TITLE AND INTEREST IN AND TO DRAINAGE EASEMENT -TOWN OF FREDERICK 683 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a request on behalf of the Town of Frederick, Colorado, for the Board to vacate and disclaim its right, title and interest in and to a drainage easement ("Drainage Easement") located in the NE'/ of the NE% of Section 25, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, a copy of said request is attached hereto and referred to herein as Exhibit "A," with said request including as an attachment thereto a survey plat prepared by Gillans Incorporated showing Drainage Easement, and WHEREAS, Weld County was granted Drainage Easement by instrument recorded in the Office of the Weld County Clerk and Recorder on June 18, 1979, at Book 872, Reception Number 1794086, a copy of which is attached hereto and referred to herein as Exhibit "B," and WHEREAS, Drainage Easement has been annexed into the Town of Frederick ("Frederick"), and Frederick now desires that Drainage Easement be replaced with a smaller, more direct drainage easement which will be owned by Frederick, and WHEREAS, Weld County has no further need for Drainage Easement and the Board now deems it appropriate to grant Frederick's request. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Drainage Easement shown on the survey plat in the attached Exhibit A and granted to Weld County by instrument recorded in the Office of the Weld County Clerk and Recorder on June 18, 1979, at Book 872, Reception Number 1794086 (Exhibit B), be and hereby is vacated. RE: Request to Vacate and Disclaim Right, Title and Interest COLORADO in and to Drainage Easement The Town of Frederick has requested that the Board vacate and disclaim any and all right, title and interest in and to a drainage easement located on the southwest corner of the intersection of WCR's 13 and 18. A copy of a survey plat showing the drainage easement is attached. The County got this drainage easement by grant from Joseph E. Jones in June, 1979. I suspect that it was to deal with drainage issues for the two roads at that intersection. Apparently, Frederick intends to install a new box culvert as shown on the plat. The roads and property where the drainage easement is located have been annexed by Frederick. Back in September, 2004, Commissioner Masden signed the attached letter, saying that Weld County had no objection to Frederick vacating the drainage easement. A week ago, I received a phone call from Dick Leffler on behalf of Frederick, asking that the Board vacate Please feel free to let me know if you have any question., regarding this Memorandum. ce T. Box 435 Frederick, CO 80530 Re: Proposed Vacation of Drainage Easement Dear Mayor Doering: Pursuant to a letter received from Robert Harris, Director of Surveying, Borne Engineering, dated September 15, 2004, the Board of County Commissioners of Weld County understands that Frederick proposes to vacate a drainage easement located in the NE'/4NE'/4 of Section 25-2-68, which was granted to Weld County by Joseph E. Jones in May, 1979. The Grant of Perpetual Easement was recorded in the office of the Weld County Clerk and Recorder on June 18, 1979, at Reception No. 1794086. The Town has annexed the property where the drainage easement is located and intends to install a box culvert about 40 feet north of the easement to accommodate the necessary drainage. It is the Board's further understanding that the Town desires to obtain from Weld County a letter of support for the vacation. Enclosed are copies of Mr. Harris' letter, the Grant of Perpetual Easement, and the Drainage Easement Vacation Exhibit. Weld County has no objection to the Town's vacation of the drainage easement and supports the same. This easement is located in the proposed Vandeventer Subdivision Filing No. 1 which is currently under review by the Town of Frederick. More specifically, the site is at the southwest quadrant of Weld County Roads 18& 13, located in the Northeast 1/4 of the Northeast 1/4 of Section 25, Township 2 North, Range 68 West of the 6Th P.M. The existing drainage channel located in the easement will be removed and replaced by a box culvert in a different location. The proposed box culvert will have a new easement dedicated to the Town of Frederick. Per the Town of Frederick Easement Vacation Process, they are requesting a Letter of Support from affected agencies.
