WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County, State of Colorado, at a
duly and lawfully called regular meeting held on the 11th day of May,2005,at which meeting there
were present the following members: Chair William H. Jerke, and Commissioners M. J. Geile,
David E. Long, Robert D. Masden, and Glenn Vaad, and
WHEREAS,notice of such meeting and an opportunity to be present has been given to the
taxpayer and the Assessor of said County,and said Assessor, Stan Sessions, being represented
by Duane Robson, and taxpayer R and N Property Consultants, not being present, and
WHEREAS,the Board of County Commissioners have carefully considered the attached
petition, and are fully advised in relation thereto.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the Board concurs with the recommendation of the assessor and the petition
be and hereby is, approved in part, and an abatement or refund be allowed as follows:

respectfully requests that the taxes assessed against the above property for the years A.D.
19 2003, 19_, are erroneous, illegal, or due to error in valuation for the following reasons:

The subject property was mistakenly double-assessed t by the Assessor's Office. R&N Property
Consultants purchased the piece of equipment (a waterjet cutting machine) from CIT in January
2003. R&N arranged to be responsible for the 2003 property taxes(due in 2004), and coordinated
that with the Assessor's Office (see Assessor's Office letter to CIT dated January 15, 2003).
Unfortunately, the seller's accounting department did not coordinate with the property tax
department, and the property tax department filed a declaration with Weld County for 2003. At the
same time, R&N was filing with Weld County. The Personal Property section did not catch the
double assessment at the time, so both parties were assessed for the same property.
Ultimately,both CIT(P 1507899) and R&N(P2434503)were billed for taxes on the same property,
and both parties paid those taxes. Subsequently, CIT then billed R&N for reimbursement of those
taxes, and R&N is responsible to CIT for payment of that billing.
Request R&N be refunded the $6,060.49 paid for 2003 property taxes.

In regards to the equipment leased to Moser Engineering by CIT Technology Financing Services
(Account#P1507899),which was formerly located at 561 E. Garden St., Windsor, CO 80550,
the lessee has agreed to report said equipment on their Personal Property declaration for the 2003
tax year, taxes due in 2004 (Account#1414899).
Per Chris Ruff, acting on behalf of Moser Engineering: Moser Engineering is in the process of
purchasing the equipment outright, and will be responsible for the 2003 property taxes. The
equipment as listed in our records is a 1998 Machining Tool with an original cost of$310,000.
Mr. Ruff's signature on this letter will serve as acknowledgment of this agreement by Moser
Engineering.
In addition, the 2002 taxes for this equipment, which are now due and payable, total $6,665.08.
