The meeting was called to order by Chair, Michael Miller, at 1:30 p.m. ROLL CALL Michael Miller Bryant Gimlin John Folsom Absent James Welch Absent James Rohn Absent Bruce Fitzgerald "_ Chad Auer Doug Ochsner Also Present: Don Carroll, Char Davis The summary of the last regular meeting of the Weld County Planning Commission held on February 15, 2005, was approved as read. The following case will be continued: CASE NUMBER: USR-1498 APPLICANT: Tim &Jeanne Iverson PLANNER: Michelle Martin LEGAL DESCRIPTION: Part of Section 34, T6N, R66W of the 6th P.M., Weld County, Colorado. REQUEST: A Site Specific Development Plan and Special Review Permit for a Major Facility of a Public Utility(110 foot Monopole Antenna Tower with equipment shelter at the base of the tower) in the A(Agricultural)Zone District LOCATION: /% mile east of CR 31 (59th Ave) and north of CR 62 1/4 (F Street). Kim Ogle, Department of Planning Services, indicated the application had been withdrawn. The following case will be heard: CASE NUMBER: USR-1499 APPLICANT: Windsor Assembly of God Church PLANNER: Kim Ogle LEGAL DESCRIPTION: Lot B of RE-2581 being part of SW4 of Section 4, T6N, R67W of the 6th P.M., Weld County, Colorado. REQUEST: A Site Specific Development Plan and Special Review Permit for a Public and Quasi Public Building (Church) in the A (Agricultural)Zone District LOCATION: North of and adjacent to CR 72; East of and adjacent to SH 257. Kim Ogle, Department of Planning Services presented Case USR-1499, reading the recommendation and comments into the record. The Department of Planning Services is recommending approval of the application along with the Conditions of Approval and Development Standards. Bruce Fitzgerald asked about height of the cross and whether it was 47 '/z feet to the top of the cross or ridgeline of the building. Mr. Ogle stated it was the ridgeline of the church or structure. Bryant Gimlin asked if there was an agreement with the ditch company. Mr. Ogle stated there not a signed agreement at this time but the applicant is working with the ditch company and should have an agreement prior to recording the plat if the application is approved by the Board of County Commissioners hearing. Le rvutivane_a- - '--/`'- Z005 2005-1009 Michael Miller asked if the intention was to get an agreement with the ditch company as a Condition of Approval. Mr. Ogle stated that was the intent and the condition would be Prior to recording the plat. Todd Hodges,Todd Hodges Design, representative for the applicant, provided clarification on the project. Mr. Hodges provided a presentation that included information on the proposal. The church is approximately 12,000 square feet in size. The location and design of the church on the site was with the surrounding neighbors in mind. The access will be off CR 72 onto the site. There was contact with the referral agencies and the surrounding property owners with no negative feedback on the proposal. There are conditions that the applicant would like to continue to work on with staff before the Board of County Commissioners hearing. The applicant is working with the ditch company directly. Bryant Gimlin asked about the status with Windsor and their annexation request. Mr. Hodges indicated they have met with Windsor and have been before their Planning Commission. They have designed the site with Windsor's design corridor in mind. Annexation is not a good alternative at the time. There are no services available and there may be other options with Severance. This application meets the intent and they would like to move forward. Mr. Gimlin asked if the design included the storm water drainage. Mr. Hodges indicated they have designed a back up with a detention facility that would meet the Windsor criteria. Doug Ochsner asked about Windsor requesting a dedication of additional right of way. Mr. Hodges indicated that already exists according to a previous recorded exemption plat. There is presently 60 feet on the plat,this is 50 foot dedicated and a 10 foot easement. Michael Miller asked where the nearest sewer line was located. Mr. Hodges indicated it was approximately 2 /% miles away. Ms. Davis, Weld County Health Department, added the regulations indicated that a septic system will be fine but when the system fails they will be required to attach to the line to public sewer if there is capacity to serve. Ms. Davis added that according to Windsor the sewer line is two years out. Mr. Hodges stated that attaching to a sewer line is not feasible for the church at this time. Chair asked if there was anyone in the audience who wished to speak for or against this application. Melvin Medhurst, North Shore Acres HOA member, indicated his concern for the area being developed as something other than residential estate size lots. They are opposed to church building in the center of the estate size lots bringing the additional traffic and noise. Charlotte Medhurst, neighbor, indicated she does not believe the church fits in their neighborhood. The neighbors have invested a great deal of money to live further from town. The church will bring a density and activity that will decrease the standard of living and home value. If Ms. Medger would have known a church was going to be built there she would not have purchased her property. There is currently an increase in traffic on CR 72. The church will bring further loss of safety for the area. Ms. Medger wondered why a church would build there, is a majority of parishners from this area? ti Bryant Gimlin asked if the alternative was a residential development would there be a lesser impact. Ms. Medger stated there could only be a few homes and Windsor stated they would keep this in acreages. Chad Auer asked where Ms. Medger is located and how old the subdivision it. Ms. Medger stated she is south of the development and their subdivision is approximately five years old. Jeff Dykstra, neighbor, indicated he would rather see a church located in this area adverse to a commercial type structure. The church represents a safer entity which is more suitable for families with children. Bret Larimer, representative for Whipo LLC, an adjacent owner, indicated he has no objections to this proposal. Chair closed public portion. Todd Hodges added that this area is urbanizing which is occurring throughout the entire area. Churches are better suited in residential areas. The density that Windsor is proposing for this area is far greater than the County requirements. Mr. Hodges added that the applicant agrees with all the Conditions with the understanding that the applicant will continue to work with staff on addressing certain conditions and have them addressed prior to the Board of County Commissioners hearing. Doug Ochsner moved that Case USR-1499, be forwarded to the Board of County Commissioners along with the Conditions of Approval and Development Standards with the Planning Commissions recommendation of approval. Chad Auer seconded the motion. The Chair asked the secretary to poll the members of the Planning Commission for their decision. Michael Miller, yes; Bryant Gimlin, yes; Chad Auer, yes; Doug Ochsner, yes; Bruce Fitzgerald, yes. Motion carried unanimously. Doug Ochsner commented that this area is urbanizing but it is unreasonable to wait for two years to annex into Windsor.
