The Applicant has proposed a well as the source of adequate water for Lots A-D. Property owners are advised that the quantity of water available for usage may be limited to specific uses, i.e., "Domestic Use Only,"etc. Because each situation is unique, the Department of Planning Services encourages property owners to contact the Office of the State Engineer, Division of Water Resources (1313 Sherman Street, Room 818, Denver, Colorado 80203. Phone 303-866-3581), to discuss each individual situation. 3. Topographic or physical features of the proposed Lots A-C,such as ravines,ditches,streams etc.may limit the area available for a new or replacement septic system. C. A 60 foot wide joint access and utility easement extending across Lots A, B and C of RE-4138 and Lots A, B and C of RE-4139 from County Road 94,for the benefit of Lots A, B, C and D of RE-4138 and Lots A, B, C and D of RE-4139, shall be shown clearly on the plat. The joint easement shall be dedicated for the use as shown using the language set forth in the Weld County Code, Appendix 24-F.E. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts,including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens,field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; Page 4 smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads,no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal from roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas,in many cases,will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches,electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important,not only for their safety,but also for the protection of the farmer's livelihood. Parents are responsible for their children. 5. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County Department of Planning Services.Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days from the date the Administrative Review was signed. The applicant shall be responsible for paying the recording fee. 6. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. As you requested the following items were inspected with regards to the newly constructed road: Depth of gravel —The depth of the Class 6 is unknown but J. Rodriguez claims it was placed at 6 inches. The Class 6 is in place but not compacted. There is no verification of compaction of road as a Proof Roll test was not conducted and compaction tests have not been completed. Width and Length of Road —800 feet in length and 36 feet in width, cul-de-sac not included in inspection. Street Signs—Street signs were not in place. J Rodriguez claims that the Weld County Planning Department would not allow him to place street signs at this time. Stop Sign —Stop sign was in place 25 feet from centerline of WCR 94, see attached picture. Storm Water Drainage— Ditches are cut in at a 2:1 slope on left/right sides of road. Further work is needed to allow drainage off of the property and along WCR 94. Currently there is no outlet for storm water in the ditches due to sediment piles at the end of the ditches, see attached pictures. Culvert—A 15 inch culvert has been installed along the entrance to the property. It has been recommended that straw bails be used at the base of the slope to allow the majority of sediment to settle out and not accumulate within culvert. Currently there is approximately 2-5 inches of sediment and debris deposited within the culvert, see attached pictures. This proposal is consistent with application standards found in the most current Procedural Guide. Domestic and Irrigation Water Supply statements: Domestic water is proposed through individual wells. Irrigation water is not associated with the site. Sewage Disposal statement: All future septic construction shall be permitted through the Weld County Department of Environmental Health and Environment. Current Property Use: The property is being used for Range activities. Future Property Use: The future property use will be residential and those uses allowed by the existing agricultural zone district. Unique Site Characteristics: There are no characteristics unique only to this site. Building Envelope Designation: The designation of a building envelope on the proposed Lots A - C is not applicable to this application as these lots cannot further subdivide and are small in relative size. The proposed Lot D does not necessitate designation of a Building Envelope. Current Land Use Permits Associated with the Property: Currently, no special land use permits are associated with either lot. 1 This proposal is consistent with the Exemption standards of Section 24-8-40 of the Weld County Code as follows: 24-8-40.A The water supply for all proposed lots is adequate in terms of quality, quantity and dependability. Wells are the proposed source of water. 24-8-4033 An adequate sewer service is available to serve the uses permitted on all proposed lots. The sewer service shall comply with the requirements of the • applicable zone district and the Department of Public Health and Environment. All proposed shall be served by individual sewage disposal systems (septics) permitted through the Weld County Department of Public Health and Environment. 24-8-40.C An access is, or can be made, available that provides for safe ingress and egress to a public road. AU accesses shall be in accordance with Chapter 8, Article II of this Code. Safe access is available to the proposed lots. An Existing access from Weld County Road 94 serves the property. The proposed Lots A, B and C shall share an access point. Access points shall remain as illustrated on the attached maps. This application, and support materials contained herein serve as an Access Plan for the property. Lots A— C shall share an access. The justification for the retention of all access points illustrated on the attached RE Map is due to continued and future agricultural practices on site. Due to the property length being one mile, it is imperative that two access points are available to Lot D. This will decrease the potential degradation of the existing vegetation on site. 24-8-40.1) The proposed recorded exemption will comply with Chapter 23, Article V of the Weld County Code. All lots shall comply with Article V, Chapter 23 of the Weld County Code. This section of the Weld County Code stipulates regulations for development in overlay district areas. This proposal is not in the Geologic Hazard Overlay District, the I-25 Mixed Use Development District, the Greeley/Weld County Airport Overlay District or the floodplain as determined through review of documents on file with the Weld County Department of Planning Services and FEMA FIRM Community Panel 4080266 0325C. A copy of this property on this map is included with application materials. The property is not within an Intergovernmental Agreement Urban Growth Boundary or a standard Urban Growth Boundary area as determined by review of current maps located in Chapter 19 of the Weld County Code. The site is located approximately '/z mile north of the standard Urban Growth Boundary for the Town of Pierce and approximately 3 miles south of the Town of Nunn. 24-8-40.E The proposal is consistent with the policies and goals of Chapter 22 of this Code. This proposal is consistent with the goals and policies outlined in the Weld County Comprehensive Plan, Chapter 22 of the Weld County Code. This proposal considers the current and future use of the property in determining the proposed lot 2 configuration and proposed shared access point, therefore conforming to the underlying principles of orderly development. A. Goal 3, as found in Section 22-2-60.C indicates, "Provide mechanisms for the division of land which is agriculturally zoned." The Recorded Exemption process was established to subdivide agriculturally-zoned. This application is for a four-lot Recorded Exemption. Further, A.Policy 3.3.3 as found in Section 22-2-60.C.3.c states that safe and adequate access onto County roads shall be evaluated. This proposal stipulates that proposed Lots A, B and C share one common access point with the concurrent Recorded Exemption located east of this property. Therefore, six proposed lots will share one access point. An access agreement/easement shall be noted at the sale for all future owners of these lots. The access agreement/easement shall stipulate the access will cross Lots A and B for the benefit of Lots A, B and C on both Recorded Exemption applications R.Policy 2.4, as found in Section 22-2-190.B.4 stipulates, "Conservation of natural site features such as topography, vegetation and water courses should be considered in the project design." These exact features were considered when designing the location of all proposed lots. 24-8-40.F The proposal is consistent with any adopted intergovernmental agreement, if applicable. This proposal is not within an Intergovernmental Agreement area per Chapter 19 of the Weld County Code. 24-8-40.G The proposal has taken into consideration master plans of affected municipalities. The proposed use should not alter activities of surrounding municipalities as it is not within an Intergovernmental Agreement Urban Growth Boundary area per Chapter 19 of the Weld County Code. The proposed property use will be residential and uses allowed by the Agricultural zone district. 24-8-40.J The proposal is consistent with sound land use planning practices. This proposal has considered the current and future land use of the property to determine proposed property boundaries, therefore conforming to the underlying principles of orderly development. The proposed division between Lots A, B and C from D is based upon past and current uses of the property. This division would 3 allow Lots A, B and C to share an access, reducing access points on the County Road network. 24-8-30.K The proposal is consistent with the Statement of Purpose as expressed in Section 24-1-30 of this Chapter. The Statement of Purpose of Section 24-1-30 details eighteen criteria used to achieve orderly and efficient development in Weld County. This application meets, exceeds, or does not impact the following criteria: 24-1-30.A Assisting orderly and integrated development. This proposal has considered the current land use of the property to determine proposed property boundaries, therefore conforming to the underlying principles of orderly and integrated development. Utilizing current land use patterns for this property in determining the Recorded Exemption lot boundaries ensures the ability for continuance of activities on site. 24-1-30.B Promoting the health, safety and general welfare of the residents of the County. Water service and sewage disposal will be accomplished by safe means as stated previously in this application. 24-1-30.C Ensuring conformance of land subdivision plans with the public improvement plans of the County and its various municipalities. The resulting parcel sizes are compatible with surrounding parcels and consistent with existing development in the area. The uses allowed on these parcels shall be those allowed by right in the agricultural zone district. 24-1-30.D Ensuring coordination with public municipal improvement plans and programs. This proposal should not affect municipalities in the area as it is not located within an Intergovernmental Agreement Urban Growth Boundary per Chapter 19 of the Weld County Code. 24-1-30.E Encouraging well-planned subdivisions by establishing adequate standards for design and improvement. Agricultural uses will continue on portions of the property that are viable based on water availability and historical farming procedures. 24-1-30.K Ensuring that irrigation water currently associated with a farm or rural unit of land will be retained for agricultural uses. Irrigation water is not associated with the property. 24-1-30.L Preserving natural vegetation and cover and promoting the natural beauty of the County. This proposal does not detract from preserving natural vegetation and cover. creation of a home site on non-productive land, the potential for reduced weed invasion has decreased. The natural vegetative cover occurring on the proposed Lot D will foster wildlife through landscaping and habitat preservation. 24-1-30.M Preventing and controlling erosion, sedimentation and other pollution of surface and subsurface water.
