SITE SPECIFIC DEVELOPMENT PLAN AND USE
BY SPECIAL REVIEW
ANSWERS TO QUESTIONNAIRE:
1.From NW corner of property approximately 5 acres for the following:
a. parking lot - average 300 cars
b. horse racing
c. event to be held once a week (usually on either Saturday or Sunday)
d. training during the week
2. This is an approximately 60 acre property zoned agricultural and this event will not affect
such zoning.
3. A USR for recreatinal activities and uses including a racetrack and race courses per
section 23-3-40.C.1 of code is allowed.
4. Site consists of lots A& B, both owned by the Gutierrez'. This site is strictly agricultural
and inlcude the following: Residential home in lot B; County grader shed, Fulton Ditch, Public
Service transmission line and oil & gas encumbrances.
5. The following are described in detail:
a. Amount of people will vary from 200 to 1,000
b. No employees, all volunteers
c. On any given Saturday or Sunday hours will be from 10:00 a.m. to approximately
6: 00 p.m. Daily practices during the week during the day hours of 8:00 a.m. to
6:00 p.m.
d. None at this time. Perhaps temporary horse sheds and bleachers are being
considered for a later time.
e. Type of animals include horses, approximately 20 to 30 during event and
existing livestock in pasture; appriximately 20.
f Regular cars, pick-ups and horse trailers. These will be in and out once during
event.
g. Fort Lupton Fire District.
h. Current well is for domestic and livestock. Permit has been submitted to include
commercial use in existing well. This will be primarilly for horses and people
attending event.
i. Port-a Johns as needed. These are serviced the day of the event and for every
event thereafter.
j. N/A there is no need to store anything. Event area is totally vacated after every
event.
6. Existing landscape is native grasses. This will not change.
7. N/A

9. No construction needed. Protective pipe fence already exists.
10. No storage needed; trash bins will be set throughout area- weekley trash pick-up
is scheduled. Entire area is cleaned after event no later than the following day. An area
has been designated for horses participating. There is usually not enough waste
to be picked up, therefore it is mixed with the soil.

To Whom It May Concern:
I am currently submitting this letter to serve as a letter of support on behalf of Mr. &
Mrs. Martin Gutierrez.
I would like to introduce myself. My name is Betty A. Roybal. I am the Director of the
Ricardo Falcon Memorial Community Center. The Ricardo Falcon Memorial Community
Center is a non-profit, tax-exempt organization, which is located in the City of Brighton.
The Ricardo Falcon Memorial Community Center was established in 1973. Our goal
at that time was to provide recreational activities to the low Income, disadvantaged, minority,
youth of our community, as an alternative to the streets. Since its inception the Falcon Center
has developed and implemented programs for our community. Programs to meet the
communities unmet needs. A list of the programs available to the community along with
descriptions will be attached.
One of these programs is called the Summer Recreation Program. The Summer
Recreation Program is offered for a 6 to 8 week period from June to August. This program
allows these 10 to 12 children daily recreational activities at little or no charge. The Center
does not charge a registration fee for the program, nor do we charge a weekly fee. The
Center does however, charge for our weekly swimming, and fieldtrips. We try to alternate
the fieldtrips with one fieldtrip, which is free, and one that requires a fee in order to avoid
financial strain on the families.
This year we were given the opportunity to conduct 2 fundraisers at the Gutierrez
Ranch. The first one was held on Saturday June 7, 2003, and the second was held July 26,
2003 at these fundraisers Martin & Berta Gutierrez offered our organization the gate
admissions and also the concessions. The Falcon Center requested that the parents who
were signing up their children for our program come in and volunteer for the day, Any monies
made would go directly to the Summer Recreation Program and hopefully eliminated any out
of pocket expenses for the families. Not only did the parents show up, they brought their
children and everybody pitched in to make the fundraiser a success. Because of Mr. & Mrs.
Gutierrez generosity we were able to gross over$4,000.00 for our program. This enabled the
Falcon Center to provide all the activities at no charge and also allowed us to take the
children places where we had been unable to take them before due to the cost.
The second fundraiser we held was to be used for transportation expenses as we
have an older van and it needed some work done to it and we did not have the money.

Again we requested volunteers and once again the children and their parents came through
for us again and we were able to gross over$5,000.00.
The Falcon Center feels very fortunate to have met the Gutierrez Family, they have
given our organization a way to make some very good money for the programs we offer.
Mr. Gutierrez runs the training sessions very professionally. Prior to the fundraiser, a
meeting between the organization and Mr. & Mrs. Gutierrez takes place. Information
regarding the organization and non-profit status are provided to Mr. & Mrs. Gutierrez. A site
visit is then conducted and Mr. Gutierrez explains where your organization will be set up. Mr.
Gutierrez has kindly constructed a covered area for the concessions at no cost to the
organizations. Mr. Gutierrez explains about the gate admission fee, and advises what would
be easier for the group as for as collection of the gate admission fee location and signage.
Mr. Gutierrez also has his employees conduct a thorough search of any and all
vehicles entering the property for alcohol. No alcohol is allowed on the property. During the
fundraising occasions at the Gutierrez Ranch we have not witnessed any problems what so
ever. In fact everyone treats Mr. &Mrs. Gutierrez with the utmost respect.
Mr. & Mrs. Gutierrez come along constantly to make sure everything is okay, and
have offered us extra ketchup, mustard and a larger cooler and anything else they could to
make things easier for us. It is not often that you find people like the Gutierrez' who are
willing to constantly help organizations with these fundraisers, and without their help our
children summer program would not have been as fun as it was this past year.

benefit event at 7717 WCR 31 Fort Lupton, C.O.
It will be a year in December that t suffered a massive heart attack. Since, 1 have not been able to
return to work much less afford to pay the high medical bills. These monies will tremendously
help in these endeavors.

Mr. Gutierrez,
Thank you for concern and attempts to legally conduct the match racing of horses on your
property. As you are aware, the Division of Racing Events' concerns about the match racing
on your property was investigated. That investigation was concluded in September 2003.
The Division's investigation did not find any violation of Colorado statutes involving racing
statutes, the criminal code or any violation of the Colorado Racing Commission Rules.
The Division's primary concern during the investigation was the welfare of the racing
animals and whether they were nominated or entered to race in Colorado during the
Arapahoe Park live racemeet season. Also of concern was whether any person licensed by
the Division to participate as a jockey or horse trainer at Arapahoe Park, was participating in
the match races on your property.
The Division is aware that you are attempting to obtain the necessary permits required by
Weld County to legally conduct the match racing on your property.
The Division will continue to maintain its concerns that persons licensed by the Division and
animals nominated for racing at Arapahoe Park do not participate in match racing through
out Colorado during the Arapahoe Park live race meet season.

CHARITY EVENTS
Through these events, several people/organizations are helped financially. The events are
organized as follows:
a. a certain individual(s) and/or organizations approach us with a need and provide us
with proper proof, i.e., doctor bills, hospital bills, unemployment, scholarships, summer camps,
etc.
b. horse owners are notified and asked to participate in this endeavor. As they agree
to bring their horses, a schedule is set for match races depending on how many participate.
c. the people, organization hosting the event are then notified of a date, usually on
Saturdays and they man the gates entering the property. It is at this time that a fee or donation is
requested.
d. by choice, the people sometimes sell soda pop, water, and hot dogs that have also
been donated so that they may raise additional funds.
Because this is an extremely popular event (especially with the Mexican people) there is quite a
lot of attendies at all times. Due to these events being strictly charity events, people attending
readily donate and the fund raiser is usually very successful.
Out of these funds, we ask the people hosting to help with the cost of port-a-johns and security
personnel. Port-a-johns are set throughout since this is usually an all-day event. Also, these are
cleaned for every event. Security personnel do a minimal search of vehicles since alcohol is
strictly prohibited.
We ask that these people bring trash bags for the various trashcans set throughout as well and that
they help with the clean up.
We also ask that these people provide us with a receipt and/or copy of deposit receipt to their
financial institutions of the finds that were raised.

March 8, 2003. This fundraiser was a benefit for my son Nathan Lender to offer financial
