HomeMy WebLinkAbout20051660.tiff RESOLUTION RE: APPROVAL OF TEMPORARY PERMIT FOR A TAVERN LIQUOR LICENSE FOR VIPER2, INC., DBA BORDERLINE GALLEY AND COFFEEHOUSE AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Viper2, Inc.,dba Borderline Galley and Coffeehouse,68947 Highway 85,Carr, Colorado 80612, presented to the Board of County Commissioners of Weld County, Colorado, an application for a Transfer of Ownership of a Tavern Liquor License,for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, said License previously held by Busy, Inc., dba Borderline Galley and Coffeehouse, and WHEREAS, Section 12-47-106.5, C.R.S., which became effective July 1, 1991, allows for the issuance by the Board of County Commissioners of a temporary permit to the transferee of an existing liquor license to authorize the transferee to conduct business and sell alcoholic beverages at retail in accordance with said license, subject to compliance with certain conditions, and WHEREAS, Viper2, Inc., has complied with all of the conditions set forth in said Section, and WHEREAS,Viper2, Inc., has also submitted the required application fee for said temporary permit of$100.00. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that having examined said application and other qualifications of the applicant for the transfer of the Tavern Liquor License and having considered said request for a temporary permit, does hereby grant to Viper2, Inc., dba Borderline Galley and Coffeehouse, 68947 Highway 85, Carr, Colorado 80612, a Temporary Permit to conduct business and sell malt, vinous and spirituous liquors for consumption by the drink on the premises only, at retail at said location in accordance with the license previously held by Busy, Inc.,dba Borderline Galley and Coffeehouse, subject to all other rules and regulations set forth by the Board of County Commissioners of Weld County, Colorado, for a period of 120 days, or until such time as the application for Transfer of Ownership is approved by the State of Colorado, whichever shall occur first. Masdep� / nt f`ney I IAA V Glenn aad Date of signature: 4' - O-O -&S 2005-1660 LC0047 PLEASE POST NEAR EXISTING LICENSE TO WHOM IT MAY CONCERN: On the 6th day of June, 2005, Viper2 Inc., dba Borderline Galley and Coffeehouse, submitted an application for a Transfer of Ownership for a Tavern, with said license previously being held by Busy, Inc., dba Borderline Galley and Coffeehouse and expiring on October 16, 2005. Until the Transfer of Ownership has been considered by the Board of Commissioners and notification has been received from the State advising whether this Transfer of Ownership request has been approved or disapproved, the Board hereby authorizes the continued sale of malt, vinous, and spirituous liquor at this establishment which is located at 68947 Highway 85,Carr,Colorado 80612, under a Temporary Permit which has been approved by the Board on June 6, 2005, effective June 7,2005. This Temporary Permit allows Viper2, Inc.,dba Borderline Galley and Coffeehouse, to conduct business and sell malt, vinous and spirituous liquors for consumption by the drink on the premises only, at retail at said location in accordance with the license previously held by Busy, Inc., dba Borderline Galley and Coffeehouse, subject to all other rules and regulations set forth by the Board of County Commissioners of Weld County, Colorado, for a period of 120 days, or until such time as the application for Transfer of Ownership is approved by the State of Colorado, whichever shall occur first.
